If we see military action in Iran in the next several months, you can trace part of the reason back to a redistricting quirk in the San Fernando Valley and a debate between Democratic House Representatives Howard Berman and Brad Sherman, redrawn into the same district. They spend most of the night trying to be the most belligerent to Iran and most solicitous to whatever Israel wants.

We now have an innovation in executive power. During the Bush Administration, mid-level functionaries would be found to write legal justifications for waging war, committing acts of torture, or what have you. Now, during the Obama Administration, the top lawyers are free to give their considered opinion on these issues. But the President will simply overrule them.

We are now engaged in an illegal war against Libya. Yesterday, the official 60-day window for the War Powers Act expired, and there was no action to approve military use by Congress, yet we continue to be involved in direct military action in Libya. With this, a new precedent has been firmly established. The President of the United States can now unilaterally and freely wage war on any country or attempt to kill anyone anywhere on earth, for as long as the President wants. It is truly frightening god-like power solely vested in a single individual.

Obama is implicitly suggesting here that Libya presents an imminent threat to the United States, albeit an indirect one. This sort of satisfies the War Powers Act, which limits US military action to that circumstance. But Obama makes no inference to seeking Congressional authority within 60-90 days, as required. That’s because of this bank shot on Libya representing an imminent threat to the nation.

Midway through his presidency, when Bob Woodward about how history would judge the War in Iraq, George W. Bush responded: “History. We don’t know. We’ll all be dead.” Instead, in a 2006 essay in Rolling Stone, the prominent historian Sean Wilentz argued that a substantial majority of U.S. historians already considered the Bush administration to be a “failure” (81% in a poll conducted by the History News Network). Wilentz predicted that Bush would “be remembered as the very worst president in all of American history.”
