For now, confirmed Yes votes hit 200, with 209 opposed. With leaners, we’re at 207-212. And if they get all the Yes votes who voted that way the last time, they have 217.

President Obama is offering Representatives supposrt above and beyond the current elections cycle, while playing bad cop to this good cop is MoveOn.org, promising to raise money for primary challengers for Democrats who vote against the bill.

AP’s 10 Phantom Health Care Votes Keep Dwindling

As I told Rick Klein and David Chalian on TopLine yesterday, if you don’t think the endangered Freshmen and Sophomores in the House are driving the car right now, think again. Remember that magic number of 39 Democratic votes needed to join with the Republican for a majority? Well, that’s how many Freshmen and Sophomores were willing to ban together in the “oust Rangel” effort — rather than have the issue hung around their necks as a millstone in 2010:

Joe Crowley, an ally of Rangel who has also played a leadership role at the Democratic Congressional Campaign Committee, is leading the whip count efforts on Rangel, acting as a go-between between the vulnerable freshman and sophomore Democrats, on the one hand, and Rangel and Democratic leadership on the other.

They were willing to buck leadership to oust the Chairman of the Ways and Means Committee to keep their seats.

There’s no reason that members should be taking contributions from industries they regulate as members of a committee. Nor should they be on one that pays an immediate family member. Evan Bayh’s wife went around soliciting participation on boards of businesses regulated by the Senate Banking Committee when her husband was appointed. Family members are one of the principal ways that cash finds its way into the pockets of members of Congress (Tom DeLay, Tom Daschle, Chris Dodd, etc. etc.)

If a member of Congress feels the need to take donations from a particular industry, or if their family member feels a strong need to do so, the member should resign from the committee and find a different one. There are plenty of ways to serve that don’t involve such conflicts of interest.
