One does wonder what form of bullshit will spew forth from the Antonin Scalia this morning?

After all he’s been uttering homophobic statements for years. And today, in a case involving the Constitutionality of the DOMA he’s looking at his second straight day of gays and lesbians asking to be treated like equals.

Washington is awash in pride as proud families and couples, gay and straight, march and rally outside the Supreme Court. Meanwhile inside Scalia says he has a “Longstanding and profound fear of homosexuals”, so should he just recuse himself? I have friends who are afraid of clowns, cats, dogs, spiders, avocados…but teh gays? Like, why?

It seems to me that any U.S. Supreme Court Justice belching out homophobic nonsense like this needs to recuse himself from the Prop 8/DOMA cases coming up on the docket.

A few days ago, I was certain that the Ever-Less-Supreme Court would be coming down with the health care reform decision that day. So let’s try it again…today the Court will come down with the decision.

If for some reason there is a concurrence or dissent from Justice Michael Savage Scalia what will be his archaic antebellum precedent this time?

It’s one thing to call yourself an “originalist” as a jurist, but one would think a Supreme Court Justice in the 21st Century would not treat a “State’s Right” to harass ethnic groups like Roger Taney would. But Antonin Scalia is determined to ignore that whole Civil War thing, let alone Amendments 13 through 15 and — in short and only with a little irony –about the last 3/5ths of American history:

Wonder how these two will decide? The suspense is killing me.

A busy week for two Supreme Court Justices

Your right to privacy is going to require you to not need a job…or benefits. Well, so much for that penumbra.

We live in a bright line society. It turns out that means there are no enforceable laws.

We need a Supreme Court Justice who will undo the poisonous statutory construction rules of the corporatist Justices. A Senator to ask questions to determine whether we are getting a Democratic version of Federalist Society pro-business nominee.
