Defense Argues Warrantless Surveillance Requires New Trial in Portland Car Bomb Plot

The defense for a a young Somali-American man, who was convicted of trying to bomb a Christmas tree lighting ceremony in Portland, Oregon, after being targeted and arrested in an FBI sting operation, has requested that a court vacate his conviction, suppress evidence, dismiss the indictment in his case or grant a new trial.

The government, according to a defense motion, “directly violated Congress’ instruction” to notify the court and the defense that it would be using data from communications “collected, retained and accessed through warrantless electronic surveillance.”


Agent Provocateur? Sometimes Notes Get Destroyed, Sometimes They Don’t

A government filing submitted last month addresses the defense’s requests for notes regarding various interactions Mohamud had with the FBI. It describes two sets of hand-written notes from a FBI agent(s). The first are the notes an FBI agent took after Mohamud got stopped at the airport last year.

Those handwritten notes were preserved.

But there was another set of handwritten notes–those documenting the July 30 meet at which a recording device failed. Those notes were not preserved.

It’s beginning to seem as if the Feds knew they had got their man, and only needed to generate a violent plot around him to save thousands of lives from danger they managed to make up for Mohamed to implement, with their extensive assistance.

Public Defender for Mohamed Mohamud Suggests “Potential for Entrapment” at Arraignment

As long as there’s a public defender alert enough to recognize the potential for entrapment, and the import of the missing recording and recording device of the first meeting between Mohamud and the FBI, I think we can presume this defendant is in competent legal hands.
