US Charges KSM, 9/11 Plotters… Again

By: Tuesday May 31, 2011 2:15 pm

How many times have we faced this stage already? How many times over could we have prosecuted KSM already if we had just used existing, rather than Kangaroo, courts? How many more years will it take to determine whether KSM can plead guilty so as to martyr himself?

Did the US Intend to Torture Bin Laden’s Children?

By: Monday May 9, 2011 6:50 am

In the midst of the ongoing orgy of adulation for Seal Team Six killing Osama Bin Laden and the former Vice President appearing on television to advocate a return to waterboarding as official US torture policy, there has been little attention to the fact that Pakistan took several wives and children of Bin Laden into custody after the US raid of the compound. The US now seeks access to these family members. Did the US intend to torture these children with insects as they did Khalid Sheikh Mohammed’s children, if the helicopter on which they would have flown had not been destroyed?

NY Police Chief Ray Kelly, Who Fought US-Based Terror Trials, Is Possible Next FBI Director

If so, and Kelly is indeed nominated, this is a contemptible plan.

Holder: Moving KSM Trial to Gitmo Is Wrong Decision, But We’re Doing It Anyway

By: Monday April 4, 2011 2:01 pm

There was something I appreciated about the Holder press conference capitulating on trying the 9/11 defendants in civilian trials.

He didn’t try to spin it as a good idea.

Obama 2012 Presidential Campaign: Brought to You by a Massive Capitulation on Civilian Law

Because nothing says “laying the foundation” of a Presidential campaign and “inspiring new” supporters like caving to fearmongering.

Eight Years Ago Today, KSM Was Probably Being Waterboarded for 179th Time

By: Wednesday March 23, 2011 9:30 am

It seems to me we’re never going to see that report until after the eight-year statute of limitations on torture expire for everything described in the report that clearly exceeded John Yoo’s expansive interpretation of what constitutes torture.

KSM Asked About His Sons in December 2006

By: Tuesday September 7, 2010 6:01 am

In a letter sent December 15, 2006 to his brother–sent just months after KSM first became accessible to the Red Cross at Gitmo and described as the first his family received from him–KSM includes a request for photos of his sons. The request is particularly important given reports that the US captured two of KSM’s sons–then aged around 6 or 7 and 8 or 9–and interrogated them to get information on KSM.

Right to Counsel at Guantanamo? It Depends

Best as I understand it, the shiny new military commission manual says the following about right to counsel. . . .

Chuck and Huck Take Their Show on the Road

Say, have you noticed how often Chuck Schumer has been nuzzling up to Lindsey “Huckleberry” Graham lately?

GOP Will Not Accept GTMO-for-KSM Deal; Rahm-Graham Bargain Pointless

By: Monday March 8, 2010 8:09 am

This is the deal Lindsey Graham thinks he can use to get the White House to abandon a civilian trial for Khalid Shaikh Mohammed: Republican support for the closure of Guantanamo Bay. According to the more sophisticated explanation/rationalization I’ve heard for accepting the deal, it’s not so much that Graham can really bring along Republicans as much as he can provide political cover for reticent Democrats to vote for what in 2008 was a bipartisan consensus position, endorsed by even George W. Bush and John McCain. This is the world we live in.
