Supporters of Proposition 8, the California initiative banning marriage equality, which was declared unconstitutional by the Ninth Circuit Court of Appeals yesterday, plan to take their fight directly to the Supreme Court, if their reaction to yesterday’s ruling is accurate. Their statements trashed the Ninth Circuit and said they always believed the issue should be settled by the Supreme Court.

The Ninth Circuit Court of Appeals found California’s Proposition 8 unconstitutional this morning, relying on arguments used by Supreme Court Justice Kennedy in another case. This furthers a process that will almost certainly end in the Supreme Court, with a precedent-setting ruling on the right of same-sex couples to marry. However, the ruling today is limited to the circumstances of the California initiative.

Two major year-end pieces of legislation were readied yesterday, and in this case, House and Senate negotiators reached agreement on the measures, expecting to pass them by the end of the week. First, appropriators agreed to a $1 trillion omnibus spending bill covering the rest of the fiscal year (to September 30 of next year) on domestic spending. They also agreed on the defense spending bill, which still allows indefinite detention of suspects.

Leave it to the Aussies to come up with the ad that LGBT activists have clamored for throughout all our fights with the fundie-bangelicals over our basic human right to marriage equality. Every time our own USA organizations launch a marriage equality advertising campaign, their ads focus on straight allies, supportive relatives of LGBT couples, or members of the political class: hardly ever do we see affected couples.

At 12:01am, the military’s Don’t Ask Don’t Tell policy was formally repealed. Gays and lesbians can now serve freely in the US Armed Forces. The official notice from the US Army was released last night, in a completely understated document. “The law is repealed,” says the letter from Army Chief of Staff Ray Odierno, Secretary of the Army John McHugh and Sergeant Major of the Army Raymond Chandler. “It is the duty of all personnel to treat each other with dignity and respect, while maintaining good order and discipline throughout our ranks. Doing so, we will help the US Army remain the strength of the Nation.”

Our criminal justice system is entirely broken if the unsettling behavior of homicide victims is allowed as a justification for their murder, in middle school. This jury needs to do its job, not moan about how hard this decision is. It wasn’t hard for Brandon McInerney to get a gun and kill Larry King.
