Walker Awards al-Haramain for Executive Branch Surveillance Abuse

Judge Vaugn Walker has issued an extremely significant decision in the illegal wiretapping case of al-Haramain v. Bush/Obama. He has awarded damages and attorney fees to the plaintiffs on their claims of illegal and unconstitutional surveillance by the US government.

From Elena Kagan’s first comments about Cheney’s illegal wiretapping program yesterday, it sounds almost like she’d vote for rule of law in the al-Haramain case (though the case is probably in the gray area of cases on which she should recuse herself).

Feingold, Durbin, and Wyden Demand the OLC Opinion on Exigent Letters

As I reported yesterday, the Dawn Johnsen-less OLC wrote an opinion on January 8 retroactively authorizing the FBI’s inappropriate use of the exigent letters to snoop on Americans’ telecomm records.

Now, Senators Feingold, Durbin, and Wyden, have demanded that opinion from Eric Holder. Of note, they tie their demand into DOJ IG Glenn Fine’s comment that DOJ should notify Congress of the opinion and this use of exigent letters so it can consider legislation on that count.
