Prop 8 Supporters Too Scared to Testify, Now Only Too Bold to Whine After Decision

Proposition 8 was built with deliberate lies that Maggie Gallagher, Tony Perkins, Peter Sprigg, and the rest of those pushing it were too fearful to defend in court. But none of these people had the guts to stand up in court, take an oath, and attest to the veracity of the claims they made regarding what allegedly would happen should marriage equality become legal in California, because they knew that the lawyers attacking the law – David Boies and Ted Olson – would call them out and reveal their deception.

 

New York’s Enlightenment & Some Thoughts On Perry Prop8 Case

Between last night’s marvelous happening in New York, the clear cut and admirable new policy by the Obama Administration, and the ever enlightened movement of society, I think the writing is on the wall for the California Supreme Court, and I think they will indeed find that the D-Is have the requisite standing, the 9th will roll with that and away we go to the United States Supreme Court. I truly believe the New York passage will leave such a marker that will carry all this through, and that is a beautiful thing.

Boies, Olson React to New Obama Policy on Constitutionality of DOMA

The Obama Administration this morning made an abrupt and seismic shift in its legal policy and position on DOMA (Defense of Marriage Act). It is a change that will have far reaching and important ramifications, and already has in the Perry v. Schwarzenegger Prop 8 case.

Ninth Circuit Punts On Perry Prop 8; Certifies Standing To California

We have unexpectedly quick news out of the 9th Circuit Court of Appeals on the Perry v. Schwarzenegger Proposition 8 marriage equality appeal. As you will recall, the case is in the 9th on appeal from the three week long evidentiary trial in the Northern District of California last January in front of Judge Vaughn Walker with closing arguments made on June 16 (summary of EW live coverage here) and Judge Walker’s opinion finding such marriage discrimination unconstitutional was issued on August 4th.
The current appeal had oral argument less than a month ago, on Monday December 6th.

Now we have the surprisingly fast first decision, if you can call it a “decision”. It is really a disguised punt.

Thirty two years ago today at 10:55 AM, openly gay city supervisor Harvey Milk was shot and killed in his office at City Hall in San Francisco. The message of hope that he preached, however, continues on, and his strategy of building coalitions and rejecting life in the Veal Pen is one progressives need to remember and repeat — that’s how you give hope.

The Stay Issue in the Perry Prop 8 Case

Judge Walker set an accelerated schedule for consideration of DI’s Motion For Stay in California’s Proposition 8 ban on marriage decision. The real defendant, the State of California, has already filed opposition to the stay, through the Attorney General, the Governor and the City of San Francisco.
