The CIA attacks on the Senate, designed to impede, alter or influence the outcome of a report on torture, coupled with a lack of concern from the White House and the Department of Justice, as well as apparently by the chair of the Senate Intelligence Committee itself, are another example of our new world, a Post-Constitutional America where the old rules of an aging republic no longer apply.

While under oath in an Congressional oversight hearing Director of National Intelligence James Clapper answered a prepared question with a lie. Even after given ample time to correct his answer Clapper stuck to his intentional statement. It was only after the NSA leak that the public had proof of his deception.

I don’t care what you think about the health care law, a structure of government with a judicial review that feels free to parse legislation line by line and make what amount to ideological pronouncements on what can go forward and what cannot sounds a death rattle for progressive governance over time.

Voters have every reason to despise their current members of Congress. We have nearly 10 percent unemployment, no economic turnaround in sight, an overwhelming feeling that Washington is filled with corruption to benefit Wall Street at the expense of regular people, and a Senate stuck in endless gridlock, incapable of passing simple laws to help people.
