The serious problems surrounding auto-enrollment in the new Affordable Care Act exchanges are just starting to get real attention. The problem isn’t a lack of good solutions though. The real problem is that the exchanges weren’t intended to work well for regular people.

In the very near future the Supreme Court will rule on the constitutionality of the Affordable Care Act. One likely outcome is the court strikes down the individual mandate but leaves the rest of the law intact.

Depending on how the Supreme Court rules this month regarding the individual mandate, some of the law’s supporters many soon start looking for a replacement which can serve a similar role in getting more people to buy insurance.
