Congressional leaders in both parties made a deal to extend three expiring provisions of the Patriot Act for four more years with little debate. Earlier this year, the same provisions – roving wiretaps, court-approved access to business records, and “lone wolf” provisions allowing surveillance on foreign citizens without connections to terrorists – were extended for 90 days.

If the facts are as alleged, 20-year-old Saudi citizen Khalid Ali-M Aldawsari sounds like a potentially much more dangerous person than the number of aspirational terrorists the FBI has entrapped of late. So I am grateful that Con-Way freight officials alerted the Lubbock Police Department when Aldawsari attempted to have them receive his shipment of phenol, an ingredient in picric acid.

When the House passed a 10-month extension of key provisions of the Patriot Act last night, it was assumed that the Senate would follow suit quickly. And they will vote on the measure tonight. However, they will narrow the extension to three months, in a move with bipartisan support.

It was naive of anyone to think that any executive branch would willingly give up their own power. Congress, thanks to Republican doddering, made the effort to put the slightest of brakes on that power temporarily. But they were promptly told that they endangered America, so that will be that.

Too clever by half, the House GOP leadership allowed only 40 minutes of debate on the extension of the PATRIOT Act today, and brought the bill up for a vote under a rule allowing no amendments and requiring two-thirds of the body to vote YES.
Well, that didn’t happen. Apparently, the Tea Party Congresscritters discovered their love for the constitution, Amendments One and Four inclusive, while taking the opportunity to stand up to their leadership’s lackadaisical attitude toward the Act’s extension.

If you blink today, you may miss the House of Representatives passing an extension until the end of the year of several provisions of the Patriot Act that expire in February. They will try to pass it under the suspension of the rules, meaning that they will need a 2/3 vote, but also that nobody can offer amendments. And they will spend a whopping 40 minutes of debate on the topic.
