CBS News, April 15, 2007:
Despite the conviction of his former chief of staff in a high-profile trial, Vice President Dick Cheney said today that he has not had an opportunity to speak to his friend, I. Lewis "Scooter" Libby, the highest-ranking official of the Bush administration to be convicted of federal crimes.
Oh really? From the NY Post :
March 21, 2007 — THAT Vice President Dick Cheney spoke to Hudson Institute members Monday at the Union League Club. Asked about a possible pardon for Scooter Libby, he smiled and said, "You can imagine how I feel about that." Libby himself was seated in the front row.
Okay so three weeks earlier Shooter was speaking to Scooter, maybe Scooter just couldn't speak back. But that seems just like the kind of neocon hairsplitting that launched us into full-scale war. It certainly qualifies as GOP logic.
Emptywheel and I were arguing as to whether Patrick Fitzgerald will make the case that Libby ought to go directly to jail rather than stay out on bail pending appeal. Marcy thinks that Fitz won't take a position and I don't agree. If Libby is allowed to stay out on bail Fitzgerald's case is over, he remains the impervious firewall who can probably count on an eventual pardon from a winking, nodding Cheney and his ventriloquist's dummy sitting in the White House. I say Fitzgerald does not have it in him to idly sit by and watch that happen. He may not have included a "go straight to jail" recommendation in his sentencing memorandum but I can't help but believe he'll find some pretext to bring it up in court.
