The conservatives of the Supreme Court sure reflected their rich life experiences in discussing the Voting Rights Act yesterday.
Of course Antonin Scalia self-proclaimed “originalist” showed that his original thought ends with whatever he heard on FoxNews last week.
Justice Antonin Scalia suggested that the continuation of Section 5 of the Voting Rights Act represented the “perpetuation of racial entitlement,” saying that lawmakers had only voted to renew the act in 2006 because there wasn’t anything to be gained politically from voting against it.
That, again, comes from a guy who says legislative intent is bunk.
Something is certainly bunk.
And then there was this gem from Roberts.
“Is it the government’s submission that citizens in the South are more racist than citizens not in the South?” Roberts asked.
My suggested response may be inappropriate, but no less than Robert’s statement:
“You bet your Cracker-Ass their governments are, Mr. Chief Justice.”
The words “Slavery”; “Jim Crow”; “Miscegenation Laws” mean anything to you? Let alone what was going on in Florida this November?
There’s a statue now.
See, problem solved.

Roberts almost sounds jealous that the South is more racist than the North.
Scalia isn’t a Southerner, but he sounds pretty racist to me. :-)
Applying the Voting Rights Act to all states would be fine with me.
Good morning, pups. Today Mr. Blow is flying solo, since Ms. Collins is off. In “Vulnerability of the Vote” he says the fundamental question is whether states that have a history of voter suppression should forever have to live with the legacy of that past. He thinks the Act should be expanded, and I agree with him.

There’s that e-word again, which you know means something is about to be cut. African-Americans have not earned the right to vote, just like SS recipients have not earned the return of their payroll deductions over all those years.
The important thing is whatever Kennedy said. We already know 8 of the 9 votes.
I think the idea of extending the VRA to all states is a good one. The GOP in the northern states is busy doing what the south did.

Thanks, attaturk, if it’s a racial entitlement, then Scalia is making it into white privilege, not to be extended to Others. Roberts is suggesting the vote doesn’t belong to areas outside the south, as well. What a cabal of anti-democratic injustice in one bunch of robed dunces.
Why stop at Scalia? IMO Thomas is the worst of the bunch and Alito is just another Scalia, just not as smart.

These are poor arguments. Who cares if the racism is greater in the south or not. The purpose of the law is to reduce the effect of racism where ever and to whatever extent it might obtain. It is a completely other argument about whether there should be an application of the law in the north but there is no doubt that it should continue to apply as it currently does. There is a mechanism to get out from under this law – the bailout. One must show that one’s state, county, city etc. has had no discrimination in terms of voting for 10 years. If these people had met that criteria, they would be out in a flash.
As Sotomayor told the attorneys for Shelby Co. That this case got a review in the coathanger coat is a sad event, as the vote of Congress to extend the existing legislation is what they will set aside if voting in favor of Shelby. That would be taking Congressional powers away from the elected congress, and is not the justices’ constitutional role.
True. But I don’t think they’re looking for a ruling based on law, they’re planning a ruling based on ideology and they need something to hide behind.

However, another aspect of Scalia’s rant in this case is that it is giving Obama supporters a chance to rave about his appointees Sotomayor and Kagan because they upset normal SCOTU decorum a little bit. Thus in today’s WaPo Msnbc Contributor trumpets: “you [Scalia] may have the votes, but you’re going to have a fight.”
But if Ginsburg is the next to retire, and in the next four years, both of which seem likely, O is surely going to pick someone to her right to keep the Senate Republicans from blocking the appointment, maybe even someone who will join the conservative majority.

As I have said many times before the south is a “whole different world” and we should have built a fence down there along time ago and let them be in their own country. And now is the time to start lobbying for a elected Supreme Court.

Scalia, Alito, Thomas and Roberts are all right-wing insurrectionist thugs who think that anything beyond subjection to totalitarian despotism is an entitlement. They are political saboteurs, insidious enemies of the United States,against freedom, against human dignity. They injure and insult the Constitution in every utterance and ruling they make. Any and all measures should be taken to expunge them all from the Supreme Court with all haste.
