If for some reason there is a concurrence or dissent from Justice Michael Savage Scalia what will be his archaic antebellum precedent this time? I can guess:
“Notwithstanding “[t]he myth of an era of non-government provided health care” in the first 100 years of the Republic, the States enacted numerous laws enabling private individuals to steal the leeches of any non-propertied person, or even compel a Native American to provide them with a leech, newt, toad, pig’s blood, or ram penis. All manner of medical care was provided not by the state but by private individuals such as witches, witch doctors, barbers, druids, medicine men and shamans. The fact that the state did not require an individual be provided with a leech from the communal swamp did not harm a person’s medical care whatsover, other than free market provided malaria and dropsy. Oh, and ditto.
C’mon Scalia, you are always the Justice that puts the “dick” in dicta.

About Firedoglake
The SCOTUS is pretty much like most American workplaces. Raving dittoheads like Nino are constantly humored while they aggressively support what ever they heard on Fox or Rush.
I don’t know why Thomas is still allowed to serve. The guy never asks questions and he admits it’s because he’s usually made up his mind before he hears the case.
Good morning, pups. Today we’ve got Kristof and Collins. Mr. Kristof has our “Election 2012 Pop Quiz!” He has a question: How well have you been paying attention to the men running for president? Take this quiz to find out. In “The Best Mailgirl Ever” Ms. Collins says the whole world is going to remember Nora Ephron for her writing and movies. A rather hefty chunk of the world is going to remember her as a dear friend.
Here they are.
The coffee and tea are ready, I’ve got cold drinks in the fridge, and blueberry pancakes for breakfast. If we’re doing predictions about what the SCOTUS will do, here’s Laurence Tribe’s. I fear he’s wrong, but he’s closer to the Court than I. Have a great day.
At least he’s honest about it. I think that true of all the supremes, except possably Kennedy and Ginsberg.
As for why he’s allowed to serve still, well, my question is still why/how did he get there in the first place.
I think when they look back on this time, they’ll mark Thomas appointment to the court as the start of America’s collapse.
Boxturtle (That’s where I put the mark)
My prediction: Individual mandate goes down, everything else stays. Much confusion results.
Boxturtle (Regardless, I predict Thomas writes his own separate opinion)
Republicans don’t “serve”. They rule. Or they ruin.
I like you very much boxturtle but what I’ll never understand is why everybody is convinced the United States is going to “collapse”. The corruption, plutocracy and constitutional issues that face us these days have all been done in the past and have been much, MUCH worse. Even the torture and abuse of people for believing differently has been carried out and one of the worst perpetrators was awarded with a General’s star for his efforts. Want an example of all of those happening at the same time? Read about Camp Douglass in Chicago. While the CO of Andersonville was hanged for cruelty he couldn’t avoid, (his guards got the same rations the prisoners did), the cruelty and torture carried out at Camp Douglass was based on nothing but revenge and vindictiveness and the imposition of martial law and arrests of citizens for trying to deliver humanitarian aid was due to the CO just trying to polish his bona fides. Look it up. Look up “Riding the Mule”. This has happened before and almost certainly will happen again and probably without causing the dissolution of the country.
Perhaps collapse is too strong a word. But I remember when I was a child:
1) The police were our friends.
2) The papers reported the news.
3) The courts upheld the constitution.
4) Assasination was against the law.
5) University was both affordable and available.
6) I wasn’t worried about finding a job when I graduated.
7) I was optimistic about the future.
This is not the same country I grew up in. And most of the changes are not for the better.
Boxturtle (Admittedly, I could only get three TV channels back then)
I think the lack of leadership (reason?) on climate change is also a game changer. The world has never been in such a state and the corporatism and corruption can only lead to unprecedented disaster.
So, chance here for romney to win it all. Just say you will repeal whatever is left of ACA and put in medicare for all. Point, set, match, game over.
