The question is: how important to John Boehner is defending DOMA? Important enough to get behind bars?
Amanda Terkel at HuffPost lays out Speaker Boehner’s problem:
In March, the House Bipartisan Legal Advisory Group (BLAG) voted along party lines to defend DOMA, the federal law that defines marriage as between one man and one woman. Its decision came after Attorney General Eric Holder announced the administration would no longer argue in support of the law after it concluded that the law is unconstitutional.
At the behest of Speaker John Boehner (R-Ohio), the House General Counsel has signed a contract with former solicitor general Paul Clement to pay his firm, Bancroft PLLC, at a rate of $520 per hour for the case. If expenses go above the cap of $500,000, there is the opportunity to raise it.
The Speaker realizes he has a problem: he’s repeatedly asked AG Holder to put up the money he otherwise would have spent on DOMA, because BLAG has no appropriated budget. AG Holder has ignored Boehner’s repeated requests for money.
The mystery deepened during a House Legislative Branch Appropriations Subcommittee hearing on Thursday.
Rep. Michael Honda (D-Calif.) pressed House General Counsel Kerry Kircher on the matter. Although the contract states that “the General Counsel agrees to pay the Contractor for all contractual services,” Kircher said he was told by the House Republican leadership that no funds would come out of the Office of General Counsel’s budget for this purpose.
If Speaker Boehner has committed federal funds to Clement’s firm absent an authorization or appropriation, he may have violated the federal Anti-Deficiency Act:
On April 26, the three Democratic members of the Committee on House Administration wrote to Boehner, concerned about the source of the funding.
“How much of the cost will be borne by the budget of the House General Counsel?” wrote Reps. Robert Brady (D-Pa.), Zoe Lofgren (D-Calif.) and Charles Gonzalez (D-Texas). “This Committee is aware that the office of the General Counsel does not have $500,000, let alone the millions of taxpayer dollars which may be required to defend at least 12 DOMA-related lawsuits. If funding for the contract is reprogrammed or transferred from another source, what is that source and what is the approval authority?”
Americans have been pretty well convinced, by the House GOP no less, that there simply isn’t any extra money lying around except that due to waste and fraud. Did Speaker Boehner create some of his own waste and/or fraud?
There are criminal penalties for violating the Antideficiency Act. Chris Geidner pointed me to those penalties, which can be found at 31 U.S.C. § 1350.:
An officer or employee of the United States Government or of the District of Columbia government knowingly and willfully violating section 1341 (a) or 1342 of this title shall be fined not more than $5,000, imprisoned for not more than 2 years, or both.
Given how severe the financial situation is for the U.S. government (as we’re constantly reminded by the House GOPers), this certainly warrants jail time.
Speaker Boehner may need to decide soon: is one-man-one-woman opposite marriage — that specifically excludes same-sex couples — worth going to prison for? How important to the Speaker is DOMA’s defense? Important enough to check into the GrayBar Motel?
Just to keep two married dudes or two married ladies from having their legal marriage federally recognized? Is it worth it to The Boehn to be sure these folks can’t touch one another’s social security survivor benefits, or are prohibited from sponsoring each other’s immigration request, or are treated differently from other married people at tax time when they include their legal spouse in their employer health plans?

No energy to look all that up at the moment, but if the Speaker’s Office legal talent doesn’t include attorneys qualified to practice in such courts, that’s quite interesting. That would be flying blind. And wouldn’t surprise me.

I’m sure all of The Boehn’s legal talent is kept terribly terribly busy ensuring all his fundraising and golf outings conform to federal election law. No leftover counselors for something as sophisticated as DOMA.
Kind of funny, though, that none of those lawyers thought to tell The Boehn to wait for an appropriation before signing the contract with Paul Clement (either the first one or the second one). You’d think they kept him out of this kind of trouble as a condition of staying on the payroll.

It’s hard to tell whether LDS is more motivated by fear of teh gay or love of teh cash.

I had a most unpleasant Mormon missionary experience yesterday.
Long story short, I had an idea to get Spocko involved about working on targeting specific local Mormon ward and stake Presidents; you know, go on offense.
I can’t tell you how much I want Mormons exposed for the frauds they are.

Before this is finished, how does the AG get to choose which laws he wants to defend and which he can ignore?
I seem to have those about twice a year. Didn’t know there was another kind.
If it helps the little people, ignore it.
It would be awkward for the Republican Speaker of the House if he committed to spend funds he has not asked the House to allocate for the purpose he’s spending them on, and obtained Senate confirmation for such spending and obtained the president’s signature to such a spending bill. That law, BTW, is intended to protect the House’s constitutional prerogative as the originator of all spending bills, as well as to ensure that all monies spent by any branch of government have, in fact, been authorized before it’s spent.
Perhaps there’s a contingency or other authorized fund that Mr. Boehner can tap, the spending authority for which arguably includes the legal defense of DOMA. More likely, he intends to attach the authorization as a rider to the next handy piece of legislation the Senate and president will have to agree to, such as the one for raising the government’s debt limit.
If not, Boehner. Petard. Hoist. Attaboy.
Frankly, I don’t expect Mr. Boehner is worried. If push comes to shove, Mr. Obama will tell Mr. Holder not to embarrass his ardent political opponent, or some ham-fisted lobbyist will arrange a think tank or Koch subsidy that will cover all those expenses without charging the public purse. That won’t cure the problem, however, if the violation hinges on committing to an expenditure, even if it is not made.
Beyond that, Mr. Boehner is convinced that any crime can be ratified and its perpetrators immunized from liability for it by the simple expedient of passing a law. Works for domestic spying and redefining torture. There is still that little bit about actually passing a law, though.
It starts by concluding that as a matter of law, enforcing DOMA would violate other laws that take precedence.
They get all ‘minority rights persecuted!’ when under attack, as I recall from post-Prop 8. But they need to learn, the hard way, that there are lines religious leaders shouldn’t cross in civic life.

These two boys yesterday morning just didn’t see me coming. I chased them off my porch and followed them to my next-door neighbors; the lesbians.
When L answered I started shouting “These are those Moromon fucks who screwed up Prop 8!”
L started in on them, and the backed down to the sidewalk again. I told them “Look, I’m going to follow you everywhere you go in this neighborhood and ruin your mission today. Get it? Make your call to your mission leader right now, and leave this neighborhood.” (They don’t ride bikes here in Denver. They get dropped off and call in to get picked up.)
After some more back and forth, and me cursing, they did.
But I was just so angry at their incursion into my neighborhood, my neighbors. I’m going to go on offense.
In SF, I used to invite them in, then explain that I, too, recruit.
Had about a 50/50 success rate.

This issue as well as the criminal entaglements of John Ensign and the C Street Irregulars should get daily up dates on Rachel Maddow’s show. Sister Rachel should run her daily updates back to back with a running calendar count of the number of days each crime has been exposed without disposition.
These two scandals could very well bring the entire structure of the fascist party crashing down on itself before the new election year hits the clock. Boehner’s having a right to assistance from the Justice Department would mean that Justice’s government lawyers are slaves (I got this from the logic of Congressman Paul Ryan on the evils of Obamacare and the evil of any right to medical care because it made Doctors slaves).
Justice must offer the job to the market and pay whatever price is demanded by the lawyer in the legal insurance plan’s Boehner geographic area insurance group that is permitted by the legal insurance plan’s insurer to take Boehner’s case.

About Mormon missionaries–I read somewhere, sorry can’t remember but the source was credible, that the average number of converts per mission is between 1 and 1.5. That is for a two year mission. Must be a hell of a lot of missionaries out there to get new converts–oh, wait! Mormons have a lot of children because it is the only way to keep the LDS growing in the U.S. Heck, Mormons may even be a minority in Utah by the next century–I can hope, can’t I?
The missionary work has many purposes, conversion is only one of them.
It’s a right of passage. It develops superb foreign language fluency. It gives the core of Mormon believers an unusual shared bond, a camaraderie born of similar, but at the same time very different experiences. It is a significant learning and growth experience for the young people, who learn two things above all beyond their language skills and how to get around on their own: that support from other Mormons and their church is the key to survival, and the key to that is contacts and social networking. Personal relationships that survive those two years often last a lifetime.
Apart from the considerable cohesion it gives Mormons as a group, it has helped make the Mormon church one of the wealthiest on a per capital basis in the world, with worldwide contacts, not bad for a relatively small church. I don’t know how that speeds the pathway to heaven; it generates considerable power here on earth.
Actually Bohner would just add himself to a large group of Republicans in the unindicted co-conspiritor population. Our DOJ has surely improved since Fredo was its guide, but not as much as some of us mught wish.
Actually Obama and Holder have said only “part” of DOMA is unconstitutional and they still oppose marriage equality.
Well, if I were the blackmailing type during any negotiating, I would get Johnny-boy in and tell him that he either sends up a clean Debt Ceiling bill or he could really take that vacation he’s always wanted to work on his putting at one of those Club Fed prisons. Then, if I were a real a*****e, after I got my debt ceiling bill, I would just keep holding it over his head until the election.
