Polling Shows Turnout Will Be Critical to Prop 19′s Success

The fate of Proposition 19, which would legalize marijuana in California, is still very much up in the air. Depending on which most recent polls you look at, the measure is either winning by a few points or losing by a few points. Looking into the crosstabs of the polling on this proposition, it is clear that the success or failure of Prop 19 rides on the ability of its supporters to get out the vote.

Prop 19 Polls: Look at the Trends

A new poll from California’s PPIC has Prop 19 down, 49% to 44%. Our Jon Walker analyzed the results this morning, suggesting that the wild swing from PPIC’s last poll is suspect. It’s easy to get caught up in poll after poll as the newest snapshot, so it’s always important to look at the trends from all the polling on the topic. No matter what, though, the bottom line is: turnout, turnout, turnout. But let’s take a closer look at what’s happening.

I’ve got a slightly different take than DDay on the news that Fidelity just established a policy requiring lenders to warrant all foreclosure sales going forward. I take it as an admission from Fidelity National that it cannot or will not adequately do that main part of its job: review the documents on a house and make sure the documents say what they appear to say.

Ninth Circuit Grants Temporary Stay to DADT Injunction Before Hearing the Case

A three-judge panel of the Ninth Circuit Court of Appeals has put a temporary stay on the worldwide ban on discharges of gay and lesbian service members under Don’t Ask Don’t Tell. However, this doesn’t mean that stay will continue; in fact, the three judges haven’t even heard the case.

I’m not surprised by this — but I simply don’t understand how the Obama Administration can claim they haven’t found anything fundamentally flawed (though that could be HuffPo’s formulation) when thousands of people have been thrown out of their homes based on documents whose signers falsely attested to those documents.
