New York Times has tweeted confirmation.
Vaughn Walker rules: “Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license.”
“The state does not have an interest in enforcing private moral or religious beliefs without an accompanying secular purpose.”
Ruling enjoins enforcement of California’s Proposition 8.
One note: this adds a new twist to the CA election in November. If the GOP takes over the Governor or AG seats, the state could jump in with its resources on the appeal.

That depends if the judge puts a stay on his ruling while it is appealed. If there is no stay, same-sex marriages could conceivably resume immediately.

When challenged, however, the voters’ determinations must find at least some support in evidence. This is especially so when those determinations enact into law classifications of persons. Conjecture, speculation and fears are not enough. Still less will the moral disapprobation of a group or class of citizens suffice, no matter how large the majority shares than view. The evidence demonstrated beyond serious reckoning that Proposition 8 finds support only in such disapproval. As such, Proposition 8 is beyond the constitutional reach of the voters of their representatives.

I can see another constitutional amendment ballot initiative and every living and breathing republican will be out to vote. This ruling will get overturned by the Supremes anyway, so it really does nothing except to energize the republican base.

I hope to god that our Supreme Court will overturn this horrible decision …. or this date will be remembered as the end of this nation’s voter’s faith in the belief that “each vote” does count … otherwise every voter referendum will be overturned by judges !!

please read my response to ‘ratfood” — when the Supremes rule on this the votes will count and that will be the “constitutional” ruling on this matter.

If voters had been allowed to decide the matter, slavery likely would have continued in those states and perhaps in others. Sometimes a majority of voters are on the wrong side of history and on the wrong side of the Constitution. The will of a majority of voters cannot be used to deny equal rights of a minority. That is essentially what Walker’s ruling addresses.
