Jeff Sessions, Jon Kyl and John Cornyn disparaged the late Supreme Court Justice Thurgood Marshall on the opening day of Elena Kagan’s confirmation hearings, dismissing him as an “activist judge” in what appeared to be a raw attempt to score political points, I wondered: “Have you no sense of decency, at long last?”

But we’ve been assured that, even though both Obama Supreme Court appointees replace retiring Republicans, both these “Democratic” appointees will drag the Court further to the Right. Both are further Right than the Republicans they’re appointed to replace. Another betrayal by the Obama Administration, and the mainstream press, who should be a watchdog rather than a lapdog.

There are other factors, such as Brown’s refusal to admit he was a Republican. Hell, try to even find the word “Republican” anywhere on his (Obama-emulating) campaign website!

Certainly there were other factors. Not least among them were the Democratic voters who decided that it was a safe Democratic seat so why interrupt their long weekend to go vote? Still, it worked out great for the Democrats.
Coincidentally I read a scathing Taibbi piece in Rolling Stone this morning about the press. Even though he gets long and pedantic at times, Glenn Greenwald is one of my favorites when he gets off on the MSM (and hack columnists), and Taibbi’s piece reminds me of that.

I’ve noticed that Kagan always refers to each Senator by name. Other nominees simply say “Senator” whereas Kagan consistently sez “Senator [insert fool's name here].”
I learned in some kind of training that my employer provided that using someone’s name is considered flattering by them.

Geez, I listened to the thing off and on, more on than off, all day and that didn’t stand out. My first problem with her is her disagreement with Marshall’s ideas and rulings. Then there’s that neoliberal thing.
