That’s not right.
Clay, 77, and Harold, 88, still lived together in their home and cared for one another, having put medical directives in place that allowed one to decide for the other what was best in case of emergencies. But in a perfect example of ‘you are only as protected as your government decides’ they were separated after Harold suffered a fall at home:
One evening, Harold fell down the front steps of their home and was taken to the hospital. Based on their medical directives alone, Clay should have been consulted in Harold’s care from the first moment. Tragically, county and health care workers instead refused to allow Clay to see Harold in the hospital. The county then ultimately went one step further by isolating the couple from each other, placing the men in separate nursing homes.
While ignoring Clay in deciding about Harold’s care, Sonoma County also decided they’d like to make financial decisions for the couple. A court said the county couldn’t do that, but unfortunately allowed limited access to one of Harold’s bank accounts to pay for his care. Then it gets worse:
Without authority, without determining the value of Clay and Harold’s possessions accumulated over the course of their 20 years together or making any effort to determine which items belonged to whom, the county took everything Harold and Clay owned and auctioned off all of their belongings. Adding further insult to grave injury, the county removed Clay from his home and confined him to a nursing home against his will. The county workers then terminated Clay and Harold’s lease and surrendered the home they had shared for many years to the landlord.
Harold died alone. Clay has nothing left of their possessions except a scrapbook of photos Harold assembled during his last three months of life. After 20 years of life together, these men were separated, their home torn asunder, their possessions auctioned off, and their lives ruined.
That’s not right. But it happened, in America, despite the couple’s best laid-plans.
Kate Kendall of NCLR tells us that while Clay will never see Harold again in this life, others have stepped up to help him:
With the help of a dedicated and persistent court-appointed attorney, Anne Dennis of Santa Rosa, Clay was finally released from the nursing home. Ms. Dennis, along with Stephen O’Neill and Margaret Flynn of Tarkington, O’Neill, Barrack & Chong, now represent Clay in a lawsuit against the county, the auction company, and the nursing home, with technical assistance from NCLR. A trial date has been set for July 16, 2010 in the Superior Court for the County of Sonoma.

None of us has any rights as long as any of us are denied those rights.
Minimally, everyone involved should be immediately fired and forced to pay restitution. Ideally, that would be followed by a substantial jail sentence.
Patrick wrote a letter to the Press-Democrat and told them he wouldn’t be patronizing their lovely little towns (Healdsburg, Sonoma) or their wine (*lots*) or their dairy (Clover-Stornetta). I’m hoping community pressure makes the County settle with Clay, and fast.

No, but it is one way to make them understand in some small way the extent of what they have done and make them suffer for it.
Might actually be able to get some jail time in there after all.

But it is sort of amazing there wasn’t someone in the process who stood up and said, “Hey, you can’t do that!” isn’t it?

There are supposed to be institutional checks on these kinds of things, but as we have seen here, all too often they either do not work or are absent. It becomes even worse, when like this couple, you are largely isolated and not wealthy.

Non-affluent seniors get kicked around by local governments all the time, particularly in cases involving eminent domain. Several elderly couples in the neighborhood where I used to work had to leave the homes they had lived in for decades when the city decided they could put the property to better use.
The case of Harold and Clay is so appalling. Clearly they were singled out for special abuse simply because they were gay. I can’t believe Sonoma County would have behaved this way if they had been two elderly siblings sharing a home.

I live in Sonoma County, one of the loveliest regions on the North American continent, if not the planet. In terms of politics, it’s about as liberal as you can get. So this story is very disturbing. I tried searching the archives for mentions of this story in the Santa Rosa Press Democrat’s web site and came up empty. And isn’t that the way with newspapers in predominantly rural areas? The bad stuff always gets swept under the carpet. Once again, you have to wonder what is driving editorial decisions? I think if that Harold and Clay’s tragedy was more widely known in Sonoma County, you’d see a helluvan outcry.

I’m sure everyone involved in this sad abuse of these gentlemen would call themselves a good, god-fearing Christian. Shame on all of them.
God that’s heartbreaking. Sue the hell out of anyone involved. Is there in way to find out who in the county was responsible for these acts? Get them fired.

I lived in the town of Sonoma for years. I am writing to folks I can think of who may be able to get some press on Harold and Clay.
Then you should publicly picket the paper’s office, with signage, and demand why they don’t cover this.
While previously having faxed, called and sent a PR Release of the story and your intent to the paper, and to major news stations for radio and tv that are received in their area/your area.
News room info is available thru google, take less than half an hour to access it all and compile a media list.
Phone calls, a brief half hour for 10 radio/tv stations if you can afford the calls out side of your county.
A half hour or hour to do a PR Release with all the details, linky’s and more if you are inexperienced at PR Releases.
Some hand held signage done by yourself.
And picket the office.
If you can’t do it, ask someone else to do it.

For this I will find time to help, online. Can’t travel, can’t be there, but will help online where I can.
This shit can happen to all of us as we age, and lose power of attorney over ourselves, our spouses. Providing there IS any power of attorney, and living wills, rules of visitations, etc. that we DID have drawn up before something happens.
My rage is for the couple involved, my outrage extends that it can happen to any of us.
A line must be drawn. It must.
This is why I stay in the job I have — HR offers benefits for same sex couples and the political air is always, always gay friendly.

There’s NO reason just one or two people in Sonoma can’t make a HUGE stink about this and get SF based MSM media attention, hold Sonoma media accountable, stir up Sonoma State Students, and more.
Harold deserves it, Clay’s legacy demands it, and it’s the decent thing to do for them, and as you and I have said, and others, for all of us.

This story is starting to go viral and it needs to be reported in the mainstream media. The local paper that is refusing to report the story the Santa Rosa Press Democrat is owned by the New York Times. Why not go straight to the top and complain to the Times itself? This morning the Facebook group for Harold and Clay had 200 people. Now there are over 2000.

“Joe My God” had this story last Friday. I sent a link to that story to Rachel Maddow. I’m hoping she gives it some coverage this week.
This sounds exactly like what it is; a horrible story! The fact that the county can heap this kind of abuse and suffering on human beings and treat them worse than animals in the zoo is appalling…and disgusting. WTF is wrong with the abusers and our society that they get away with this crap?
It’s agreed that more people should know about this. The fact that it hasn’t gotten out more makes one wonder how many other incidents like this occur, not only in California’s Sonoma County, but in many, if not most other places here in the United States as well.
THIS IS WHY WE MUST HAVE MARRIAGE EQUALITY AND NEVER SETTLE FOR ANYTHING LESS!!!!!!!
