I’ve just now read that Dawn Johnsen, a true liberal, has officially withdrawn her candidacy to head of Office of Legal Counsel:

“I am deeply honored that President Obama, the Attorney General and a strong majority of the U.S. Senate have demonstrated faith and confidence in my ability to lead the Office of Legal Counsel,” Johnsen said in a statement asking for the withdrawal. “OLC plays a critical role in upholding the rule of law and must provide advice unvarnished by politics or partisan ambition. That was my guiding principle when I had the privilege to lead OLC in a past administration. Restoring OLC to its best nonpartisan traditions was my primary objective for my anticipated service in this administration. Unfortunately, my nomination has met with lengthy delays and political opposition that threaten that objective and prevent OLC from functioning at full strength. I hope that the withdrawal of my nomination will allow this important office to be filled promptly.”

The withdrawal represents a major blow to progressive groups and civil liberties advocates who had pushed for Johnsen to end up in the office that previously housed, among others, John Yoo, the author of the infamous torture memos under George W. Bush.

But the votes, apparently, weren’t there. Johnsen had the support of Sen Richard Lugar (R-Ind.) but was regarded skeptically by Sen. Ben Nelson (D-Neb.) — primarily for her positions on torture and the investigation of previous administration actions. A filibuster, in the end, was likely sustainable. Faced with this calculus, the White House chose not to appoint Johnsen during Senate recess, which would have circumvented a likely filibuster but would have kept her in the position for less than two years.

It has been clear for well over a year that the prevailing powers in the White House are 180 degrees out of harmony with Johnsen on civil liberties and the rule of law, especially the prosecution of war crimes, and that there was no way in hell they’d let her be confirmed. Yet another fuck-the-hippies move that gets blamed on the Republicans. Obama could have given her a recess appointment along with the rest. I was surprised that she did not withdraw immediately.

Agreed. I remember trying to make arguments to justify stuff at that age. I was barely coherent. I defaulted to religion for morality (and later found that your religious education could be flawed) for legal stuff I defaulted to technical legal or illegal and tended to be boy scout straight arrow.

I found the phrasing and reasoning interesting. Things like “flexed the muscle of the majority” and the reasoning that they were justified because Constance was an attention getter that it was here drama demands that were the problem.

I was also interested in the community at FDL and the response. I know that you have to be very careful with what you say about them because they will use that to dismiss the criticism. So one person who called them a hick became “we are all not Hicks!”

What was especially distressing was all the Christian groups they belonged to. I know a bunch of Christians who could point out to the pastors the flaws in their understanding.

I intend to do just that in series of diaries; point out the flaws and misundertsandings. Language is inherently flawed, and we all suffer that in terms of meaning.

Good! I have friends with Mdivs from the various schools at the graduate theological union in the east bay and I’ve asked for something like this.
I still remembering arguing with a priest about the catholic churches reasoning on the issue “you can be a dog, but don’t bark”‘and thinking how stupid it was. this guy who dated a friend of mine came up to me after the class to talk about it he thought that what I said was great. I knew he wasn’t gay because he dated my friend Denise. We were just a couple of guys who knew the church position was wrong. I didn’t have the theology to back it up but I knew it was wrong.
A year after the class I ran into Denise and asked About him. “He and his boyfriend left the Midwest for the coast ” she was his cover and it was so good her parents wondered when they were getting married.
I always wanted to ask him how that class was from his point of view.

Mr. Herbert says we need “A Voice of Reason,” and that we need sane voices to counter right-wing extremism. Next month, one such group of progressive thinkers celebrates its 10th anniversary.
