Police in a northern California town thought they had an open-and-shut case when they seized more than two pounds of marijuana from a couple’s home, even though doctors authorized the pair to use pot for medical purposes.
San Francisco police thought the same with a father and son team they suspected of abusing the state’s medical marijuana law by allegedly operating an illegal trafficking operation.
But both cases were tossed out along with many other marijuana possession cases in recent weeks because of a California Supreme Court ruling that has police, prosecutors and defense attorneys scrambling to make sense of a gray legal area: What is the maximum amount of cannabis a medical marijuana patient can possess?
No one can say for sure how many dismissals and acquittals have been prompted by the ruling, but the numbers are stacking up since the Supreme Court on Jan. 21 tossed out Patrick Kelly’s marijuana possession conviction.
The high court struck down a 7-year-old state law that imposed an 8-ounce limit on the amount of pot medical users of marijuana could possess. The court said patients are entitled to a ”reasonable” amount of the drug to treat their ailments.
One would think that a Half Pound of Pot would be a ‘reasonable’ amount…!
Here, anything over 2 oz’s could bring jail time…! 2 pounds and you’d definitely would be facing enhanced charges…!

I was just over in the tread responding to someone who was possibly a troll or maybe just unclear on the concept.
It really helps to talk this stuff out here. I’ve gotten great comments from folks like Kelly, Loo Hoo, Suzanne, Teddy and thingscomeundone. So many nice smart people here.
I’ll keep you informed if anyone responds. (And Kelly if you write someone in Denver let me know.)
I did win $100 in our NCAA basketball pool today. And my 16-year old nephew is heading to DC this week as part of a young Democrats contingent. He’s worried registration may cause him to miss a lecture by Simon Johnson (one of his faves.) When I was 16, I was trying to remember where my wallet was.
One thing that I KNOW will happen is that the TPE people will find the tread and start spinning. This is a battle fought in the media and they have a willing audience who don’t really want to do any thinking. That is why I tried to deliver a twist on the easy narrative the normally use.
The TV people are harder to reach when you are not there to mess up the visual narrative or point out the violent signs.
What I often do is try and find a different stakeholder who is unhappy with what is happening. City governments are always cash strapped and probably don’t appreciate being the free private security for the tea partiers.
I know the people in LA didn’t appreciate it. Neither did the people in San Diego, Washington and Florida. (all people I called and talked to, you see I do my homework).
So right now one of the TPE people is reading this and figuring out how to respond. I’m sure the will find a way to be the vicitm.

That isn’t half the problem in SF right now — the police department crime lab has been compromised by a tech who took home samples, apparently. More than 300 cases have been dismissed this week, with about 1400 needing to be dismissed next week. Apparently it’s not just cocaine, but also 0*ycotin the person stole.
Only because the proof in cases more than two years old has been destroyed will they not have to resist challenges from convictions older than that — it’s possible every single SF drug case will go away that’s less than two years old.
So why spend it on fundraisers for Dick Army and Sarah Palin?
Right. It’s not like they have any real authority to throw around. Neither hold office, neither ever will again, and their cred is starting to fray (if they ever had it to begin with).
i am hopeful spocko’s hard work will pay off in the TPEx having to pay for the services they are grifting now. i am hopeful that if this wedge works, it will expose the underbelly of the grifters.

On my mind; I’ve been caretaking my parents. My mother has probably mid-level dementia and drew the line in the sand for her independence at wound care. She has ulcers on her leg that could lead to Gangreen. As her mother’s did resulting in an amputation when she was 100 and too old to withstand general anesthesia. . She started to refuse to let me bandage her wounds. We fought. I lost. I turned to my defense team and called all the people in Medicare,etc. , with tears in my voice…the Wound Care nurse is coming out tomorrow.
I’m saying all this sordid stuff to reinvigorate us to fight for Medicare for all.
We can’t be Wankers and not fight for these Health Care Rights for every citizen. And the illegal immigrants who need to be monitored for contagious disease.
Uh,…that’s kind of a downer .
But, it’s time to reorganize our allies.
