It’s a pretty sad day when political elites like Rahm Emanuel have their misdeeds shielded by obfuscation like this, but I’m happy to have a discussion about what Rahm did at Fannie and Freddie – and what he has done since that time.
Jed Lewison says that the allegation “that Emmanuel and the White House are not only covering up past corrupt practices but are also creating an $800 billion slush fund with which they can carry out even more corruption — is reminiscent of the fanciful allegations that Bill Clinton killed Vince Foster and Ron Brown.”
He dismisses any inquiry into Fannie/Freddie malfeasance because — well, Republicans are racists:
Fannie Mae and Freddie Mac are key elements in the right-wing narrative about the recession. Their script goes something like this: ACORN, Fannie, and Freddie worked with the Democratic Congress to pressure banks to lend to “risky” borrowers, using the Community Reinvestment Act as their leverage. This storyline is totally false, but wingers love it because it not only absolves the financial and real estate industries of responsibility for the financial crisis, but it puts the blame squarely on the backs of blacks and Latinos. Absent evidence, lending credibility to the this right-wing shibboleth is a great disservice.
Rather than parrot right-wing myths that have nothing to do with the question at hand, let’s look at the evidence. The fact that the White House is contemplating doubling the limit of their commitment to Fannie/Freddie to $800 billion (even though they’ve only used $112 billion) was reported by that famous right-wing rag the New York Times on December 16:
Now, according to people close to the talks, officials are discussing the possibility of increasing that commitment, possibly to $400 billion for each company, by year-end, after which the Treasury would need Congressional approval to extend it. Company and government officials declined to comment.”
This is somehow meaningless because Michelle Malkin hates ACORN.
The fact that Rahm Emanuel was on the board of Fannie and Freddie from 2000-2001 when executives laid out their plans to deceive shareholers so they could pad their bonuses was reported by Hot Air the Chicago Tribune:
On Emanuel’s watch, the board was told by executives of a plan to use accounting tricks to mislead shareholders about outsize profits the government-chartered firm was then reaping from risky investments. The goal was to push earnings onto the books in future years, ensuring that Freddie Mac would appear profitable on paper for years to come and helping maximize annual bonuses for company brass.
Maybe Vince Foster wrote the report by the Office of Federal Housing Enterprise Oversight (OFHEO), the oversight board for Fannie/Freddie, which “provided evidence that non-executive members of the Board were aware, and supportive of, management in this regard, including the use of derivatives to improperly manage the earnings of Freddie Mac.”
Rahm claims he just “doesn’t remember” what happened during that time, but the White House turned down the Tribune’s FOIA request for the board minutes and correspondence from the time Rahm was there. They claimed it was “commercial information,” even though at the time of the request Freddie was wholly owned by the federal government.
Probably Ron Brown’s doing.
Wild-eyed McCarthyite Ryan Grim of the Huffington Post is the one who reported that the Inspector General for Fannie and Freddie, Ed Kelley, had been removed earlier this year. Kelley’s independent authority to conduct investigations was challenged in May, and he was demoted to internal auditor shortly thereafter using a loophole in a law passed in 2008 which folded two oversight agencies (OFHEO & FHFB) into one (FHFA):
The mortgage industry is one of the most susceptible to fraud, yet one of the areas Kelley said he doesn’t get into is criminal investigation.
“We don’t have the authority to do criminal investigations,” he said. “It’s the very reason why they set up IG offices themselves, [as opposed to] internal audit offices.”
The administration has not appointed an Inspector General to replace him, despite repeated warnings.
The law with the “loophole” that kept Kelley from operating as Inspector General at the FHFA, even though he had done so at the FHFB, was the Housing and Economic Recovery Act of 2008. Cosponsored by Rahm Emanuel. (Here’s Rahm speaking on the floor of the House in support of the bill, which bailed out Fannie & Freddie).
As Yves Smith notes, “The Administration has taken a decidedly hostile stance towards the agency.” It’s been 16 months since the law took effect. No Inspector General has been appointed, though one has been removed. This despite the fact that the Administration has been warned multiple times by Congress, the FHFA and TARP Inspector General Neil Barofsky, who calls it “a serious gap in oversight.”
And now they want to throw $400 billion more at Fannie and Freddie. But we’re not supposed to ask for an investigation, because Jed says it “would be a massive burden on a White House that is already struggling with enormous problems with no end in sight.”
I think I heard that a couple of times during the Bush years.
I think what we’re seeing is a breakdown of the progressive online community into those who are willing to overlook extreme financial malfeasance if “our guys” are the ones doing it, and those who don’t want to be part of “our guys” if that’s the price. Count me in with the latter group, because the hypocrisy of the former is what led to the Bush dead-enders and their irrational embrace of George Bush beyond limit. A small cabal who can only interpret things through personalities is going to lose the rest of the country pretty quickly, because most people actually believe that these continuous bailouts are part of the “enormous problems” we are struggling with.

I was a Quality Control Appraiser for big mortgage company unit of a Fortune 100 Bank. We specifically combed through the appraisals for appropriate value. And we had to BEG some of the other big banks to meet their 3% CRA lending (They had to do their own to keep their Delegated Endorser status to be able to continue doing business with Fannie & Freddie.)
So lo and behold, 1999 rolls around, and Citi wants to buy Travellers in direct contravention of Glass Steagall. (That would be Rubin, btw.) So they just get rid of Glass Steagal!
So now EVERYBODY wants in the CRA game, cause,what the hell, you can securitize/gamble on them. Problem was Fannie and Freddie’s charter needed changing to do this, and they didn’t, so voila in 2000 Rahm pulls this cocky and in my eyes, criminal shit.
And btw, to pull off this backdoor TARP asset buying? I still think their charters need changing to make it legal.

I think I would have to see the details to really have a full understanding of what’s going on but I’ve been under the assumption for a while that the Senate is the non-functioning governmental body. It cannot do its job which is to reform and improve the lives of Americans.
It is broken and it’s completely bought and paid for by the insurance companies and I think it’s indicative that we just found out today that the insurance companies are claiming victory on this battle –supposedly not over — they’re already claiming victory because they’re going to have a mandate forcing people to buy their crappy products with few restrictions on their ability to do the sort of business practices, the unethical business practices that have created this problem in the first place.
So, how do the folks at Daily Kos reconcile Markos’s assessment above with the need to embrace this legislation?
To them I would simply ask: What do you imagine drives legislation like this forward in Wshington? Is it or is it not Wall Street and the health care industrial complex? And if the same folks who passed it are still in power next month or next year or next decade, why in the world would we ever expect “improvments”? Based on what evidence. You know, so far?

So, as with any non-executive member of the Board, he is presumed to have been present (having accepted fees for attending) at all meetings.
One would think Rahm, and the White House he heads, would be happy to release minutes of meetings that correct the reported facts: that non-executive directors were all aware of the accounting gimmicks to move revenue to out-years for purposes of stock manipulation and bonus accrual.
But that, alas, has not happened.

He ain’t saying. FOIA may not be operative – at the time Fannie and Freddie were private entities (with an implied federal backstop). That said, it looks bad that the FOIA requests are being fought, this isn’t transparency.

Are you crazy or just completely uninformed as to how corporations are set up? The whole reason directors are there is to watchdog. They have a fiduciary duty to speak up and protect shareholders from management that might get out of control. They aren’t just supposed to sit around drinking coffee and calculating the value of their stock options while being informed that management is planning on committing fraud on the shareholders. This isn’t the good Samaritan scenario. It’s as if the guy hired by the Samaritan to be his body guard and personal physician watched him get beat up and left him there to die. My guess is there’s an element of picking the guy’s pockets while he was unconscious in there as well.

Our own “job” here is only to read Jane’s post and decide whether or not she connects enough dots to warrant an investigation of what Emaunuel did or did not do back then. We don’t “prove” anything. We argue only that others fully capable of investigating Emanuel’s role on the board will be able to demonstrate reasonably what happened. And whether laws were or were not broken.
What counts here is something we call intellectual and moral integrity. In other words, would we demand the same sort of investigation if the person accused was a staunch ally of ours politically. Or someone we personally admire.
I’d like to think I would. But I don’t deny my motivation here is piqued in part by the fact that Rahm Emanuel embodies everything I argue about regarding the Bilderberg agenda in Washington.
He is crony capitalism personified inside the beltway. And I think these charges if proven would demonstrate it all the more.
But, again, that’s just me trying to be as honest [about my own complex motivation] as I can.

PLEASE also find Greens, socialists (*gasp*), and respected activists and academics to side with you on this. This will help crush the belief by people on sites like DKos that you’re secretly a Republucan or being played by the right or just a CT nut like Jed is trying to claim now.
You have to make this less about you and Republicans. Right now it just appears, “Jane and Republicans want…”, which obviously raises red flags with the loyal Democrats. I think much of DKos is wrong about this, but you’re also making it easy for them to focus on a distraction and to ignore/miss what you’re trying to do.

I’ll answer the question:
1/ Emanuel doesn’t seem to have done anything that isn’t pretty standard practice in banking/business. It seems he didn’t do enough when a board member, so you could certainly suggest that he shouldn’t be put on the boards of too many mortgage companies, but what other bearing does this have on his position now? You seem to be suggesting that this has something to do with the government supporting the GSEs but other than that they are the same companies, I can’t really see what link you are trying to draw.
2/ This has been investigated already, it seems, so it’s hard to know what you think should be happening, aside from a witch hunt. This was not a secret when Obama appointed him, so presumably Obama was a/ okay with it and b/ not of the opinion that it actually was a damaging scandal to his government, which it in fact does not seem to me to be. I don’t know the details of the accounting “trick” that was used to misstate earnings, but it’s pretty common in the business to do that and although your reports suggest that Emanuel knew something illegal was being done, that’s not necessarily so. There’s a gap between “I knew they were doing something dodgy” and “I knew they were breaking the law”. Both are worthy of reprimand, but only the latter is really a cause for breaking out the ducking chair.
3/ The government’s rationale seems fairly sound to me because the GSEs are in fact commercial enterprises, regardless that the government is the majority shareholder. The principle that the government can own shares in a commercial enterprise is nothing new.
4/ Even if Emanuel had killed Vince Foster, personally, in the dining room with the lead pipe, that would be no reason for buddying up with Grover Norquist. There is a huge difference between “our views coincide on this issue” and “meet my new teammate”.
What’s disturbing is seeing previously good posters lining up to cheer Jane for doing something you’d decry in any other leftleaning figure.
Oh, and:
5/ Norquist is far far worse than Emanuel. Yeah, Emanuel is right of centre and that kind of sucks but Norquist would destroy everything you hold dear. When you say “he’s someone I can team up with”, you give implicit endorsement to him. This is not the same as voting the same way as him, negotiating with him, doing a deal with him on some thing or other, agreeing with him on this subject. You platformed with him. You and he march under the same banner.
Constantly reading the Firesheep saying that Jane is all about principles not personalities is pretty hard, because the truth is she is binning what principles she has to attack a particular personality. The incredible spinning of the faithful is not making that less so, nor the constant bitching at Kossacks, who have their faults but on the whole have the merit of it on this issue.
