During the Clinton administration, the FBI had access to records of gun background checks for up to 180 days. But in 2003, Congress began requiring that the records be destroyed within 24 hours. This requirement, one of the many restrictions on gun data sponsored by Rep. Todd Tiahrt (R-Kan.), meant that Hasan’s investigators were blocked from searching records to determine whether he or other terrorist suspects had purchased guns. When Hasan walked out of Guns Galore in Killeen, Tex., the FBI had only 24 hours to recognize and flag the record — and then it was gone, forever.
As former FBI agent Brad Garrett has said, “The piece of information about the gun could have been critical. One of the problems is that the law sometimes restricts you in what you can do.”
The Tiahrt amendments passed by Congress interfere with preserving, sharing and investigating data on gun purchases by terrorist suspects. If that weren’t bad enough, Congress has also failed to close a gap in federal law that prevents the FBI from blocking a sale to an individual under investigation for terrorist activity.
Even Dubya thought this was a bad idea:
The Bush administration asked Congress to authorize the FBI to block gun sales to terrorist suspects, to no avail. Last week, Attorney General Eric Holder reaffirmed the Obama administration’s support for this legislation — for good reason. A Government Accountability Office report published in June found that individuals on the terrorist watch list had purchased guns and explosives from licensed dealers in the United States on 865 occasions over the past five years.
Whether or not Hasan turns out to be the islamofascist terrorist mole the conservatives say he is, the Fort Hood shootings are another tragic reminder that their own extreme pro-gun legislation actually makes it easier for Islamic terrorists to buy guns without the government being able to stop them or trace them. Nice going, Daddy Party! Way to keep us all safe!
I just don’t understand the logic of destroying most of the Bill Of Rights in the name of catching terrorists, and then expanding the only Amendment that would make it easier for those same terrorists to buy deadly weapons. Hey, terror suspects! You may not be entitled to a fair trial, but you can have all the guns you want!

Also, why should they have stopped Hasan? He had no record, and he wasn’t diagnosed anywhere as mentally ill. (If they saw he was military, they probably assumed he knew what he was doing with handguns.)
And that’s why the states and countries with tougher gun laws all have such high incidences of violent crime!

Are the gun purchases minimized? Do they wipe clean all the online communication with my debit card issuing bank or credit card company, or just a file they keep of purchases for 24 hours? Seems like an awful lot of work just to ensure the 2nd amendment gets the respect it deserves; why not just ship the data to the Feds, who seem to lately exhibit an insatiable appetite for the stuff?

I don’t see what the point of this post is. That progressives should support the denial of civil liberties to people on the terror watch list?
There are approximately 1.3 million people on the list, the vast majority of which have never been suspected of any crime. The list is permanent and there is no way to appeal, despite the fact that it causes you to be harassed whenever you fly and employment discrimination has also been reported.
I’m sure the corporatists will be more than happy to further abridge our civil rights in the name of homeländ security. I see no reason we should help them.

There may be a medium term solution: have Congress draft a law that says the largest caliber a man can own is the caliber into which his Cheney will snugly fit. That would maximize caliber size, especially amongst wingnuts, to roughly a .22-short. Not the perfect solution, obviously, but still in line with the “keep and bear arms” proviso.

You know since most of you people do not seem all that knowledgeable about guns, let me give you a few pointers. Consider it kind of a public service.
First, I recommend all of you own at least ten guns, three rifles and seven handguns. The three rifles should include one assault rifle and one with a telescopic sight. The seven handguns should include at least three revolvers (more dependable).
If you can’t afford ten guns, then at least own five.
Use at least a 38 Special. A lesser caliber has a good chance of getting you killed by not stopping the intruder. Also, hollow point bullets are preferred in self defense. You want to kill the intruder but you don’t want the bullet to go through him (or her) and hit someone else. Hollow points will prevent this.
When you feel you life is in danger (intruder) remember don’t pull the trigger, squeeze it. Also, when you aim, you want to hit your target dead center. To accomplish this aim up and slightly to the right to compensate for the natural tendency to shoot low and left.
Fire two shots then count to two. Then fire two more shots and count to two again. Continue until you run out of bullets or until you hear a loud thud.
If you don’t think you can remember this, print off my post and tape it up somewhere at home.

Just because some people believe that the police are there to protect them(big myth) does not mean that they can force their antigun rules on the majority of citizens in this country-there are, as of the last time I looked, CCW laws in 38 states and as of today, I do not see the bloodbath predicted by the antigun people. If someone breaks into your house, what will you do to defend yourself? The police will clean up after and maybe catch the crook, but you are still dead. But you did not protect yourself, so you must feel pretty good about that, no?
FYI My 13 year-old daughter does pretty well with a .357 Desert Eagle. Her 16 year-old brother does even better with a .44. And, I am about as politically liberal as you can get. One of my goals for the new year is a concealed carry permit. I think you would be surprised how many of us “progressives” believe it is an individual right.

Where the hell do you live? The last four intruders I had were last Thursday morning — four mule deer does in my backyard at about dawn. Two were laying down, watching whatever deer watch, one was munching grass, the other sneaking some bird seed out of the bird feeder. That’s the most “intruders” I’ve ever seen at one time in seventy years — unless I would have counted the blackbirds in the spruce trees when I was a kid.

Not to speak for frugalchariot but I think that’s the point – very very few people “need” a gun of any sort.
Actually, I learned how to shoot when I was ten years old and yes, I owned gun/guns until I matured and realized that since I no longer cared to hunt, why should I have a gun? That was fifty years ago. Interestingly enough, no one has killed me, nor have I been forced to kill anyone who was trying to kill me. I even retired my pea shooter. Guns are useless. Except, of course, for males with small Cheneys, or for cowards — assuming there’s a difference.

I am a firm supporter of gun ownership just as I am a strong supporter of gay marriage rights, a strict separation of church and state, and sweeping reproductive rights but this gun law is completely insane. Insane doesn’t even cover it.
This law is so defective its perpetrators should star as the crazies on the crime show Criminal Minds. This 24 hour law is born of pathological pugnacious paranoia. Its obsessive compulsive and belongs in a study of stupid laws.
