Good news! As soon as the health care bill is passed, the Senate will finally turn its attention to confirming Dawn Johnsen as head of Department of Justice’s Office of Legal Counsel. Yippee!
The investigation into the OLC’s role in the use of torture under the Bush administration is virtually complete, but the Obama folks are taking the extra step of having it reviewed by David Margolis of the DOJ’s Office of Professional Responsibility because they don’t want any of the targets of the investigation to have ANY ground to contest the report process. Yippee! Let’s hear it for “belt and suspenders” legal work.
However, it is expected that the OPR report will be out BEFORE Dawn Johnsen comes up for a vote. Yippee!
Why yippee on that last one you ask?
Well, those who shall remain nameless, but who seem to have some advance inkling of the report’s contents, are ready to dare, DARE I tell you, the Republicans to try to filibuster Dawn’s confirmation vote. The OLC investigation report will be taken to the floor of the Senate, and every time there is any sort of delay or lull, a passage from the report is going to read aloud; presumably to punish the GOP for burning floor time.
Which implies that the report is going to be a humdinger. Yippee! We may finally get some answers.
Oh, and you know that legal defense fund former OLC Assistant Attorney General Jay Bybee set up? It may be because, once again, folks are using the word impeachment in the very same sentence with his name. He’s a federal judge these days, and is subject to removal by impeachment.
Hang onto your hats, pups, it may be a wild ride.

The report has damming evidence of some kind that nails the WH and or the GOP Senators voting?
If this report is so good why wasn’t it released before the healthcare vote? We could have used the leverage.
This report has something on the Senate GOP. Any hints?
I have not seen the report. But asked someone who ought to many of the specifics of it, whether I should get all worked up in anticipation, and was told YES, with a very big grin.
I was told I would find it very interesting and entertaining. More likely, knowing me, it will make my blood boil if further details come out, but I’m guessing that my source thinks the conclusion in the report will make my heart go pitter patter
Just that whatever these passages are, will so embarass the Senate GOP that it should get them to stop wasting time in order to MAKE IT STOP
Cynthia, tell us about Margolis. During the scandal over the fired US Attorneys, his role seemed like a mixed bag, at least to me.
Because the targets stalled in their review and comments and then DOJ gave it to Margolis for 45 days, since they were already in the thick of the healthcare turmoil.

I hope the Oracle is right on Ms Johnson. As to the worth of the report on the OLC, how good can the investigation be where the perps and their counsel get input for the final product? Is Bybee’s defense fund only for prosecution related expense or does it include costs of peeking at the OLC report too?
I don’t expect anyone in the prior Regime to pay for their transgressions of law with Congress complicit and too lazy to investigate or impeach and Obama’s forgive and forget approach to war crimes.
Republics aren’t able to feel embarassment. After all, they blindly followed Decider Bush for eight years.
Margolis is a career DOJ guy. Folks I know seem to have faith in him. He is not ONE OF US, but neither is he ONE OF THEM.
To the extent he has any bias, it seems to be in favor of DOJ and its traditions, which in this case is proabaly a good thing.
When Jim Comey left DOJ, he transferred supervision of PatFitz’s Special Counsel investigation to Margolis to protect Pat and the investigation from Gonzales.
Margolis must have some steel in backbone to have played that role.

I remember Comey’s HJC testimony, and he said Margolis was colloquially referred to as “The Turk”, the guy who had no problem firing and doling out discipline.
And he apparently clobbered Inglesias for conduct after the firing.

It is hard to stay motivated as a defender of democracy when Bybee is on the bench and Yoo is in the classroom. But an unemployed single woman writes a hot check to purchase milk and bread for her starving babies receives the full benefit of our criminal justice system.

An impeachment of Judge Bybee is just a start. Hopefully, the confirmation of Prof. Johnson will lead to more disclosures of the illegal actions of the Bush regime.

I think it IS UNIQUE in the history of the Office of Legal Council(OLC) for its memebers to be investigated by the Office of Professional Responsibility (OPR). But OPR does multiple investigations each year.
I don’t know about the reluctance to use existing procedural manuevers.
