
UPDATE: 10:18pm Stupak Amendment passes, 240 Yeas to 194 Nays, and John Shadegg voted “present.”
The Stupak Amendment went down about 8:12 p.m. ET, more Nays than Yeas on a voice vote. Rep. Stupak immediately asked for a recorded vote, though, but the vote was delayed until after the Republicans had a debate about their own substitute health care reform bill.
It’s a dangerous zone, between the first vote when everyone could hide behind the cover of an anonymous Nay/Yea, and now, when they will have to go public. There may be some votes shifting in this period of time, and it could make a difference. David Dayen noted at the end of his last post on the Stupak Amendment,

As Jane Hamsher said in comments below, our uteruses belong to Stupak. [I think I'm going to be sick.] It’s going to take more than Republican Rep. John Shadegg at this point to fix this horrific mess in the next few minutes, with only 37 votes left and no “present” votes.
UPDATE: 10:18 p.m. ET — it’s all over. The Stupak Amendment passes, 240 Yeas to 194 Nays, and John Shadegg voted “present.” Good for him, although National Right to Life has now painted a bull’s eye on his back and counted his vote as a Nay.
I am so disgusted; there just aren’t words for this. It’s like the vote for cloture before Justice Alito was seated on the court. THIS was the vote, Blue Dogs, not the health care reform bill itself or the conference committee.

Large corporations are generally SELF-insured and only use the insurance companies as administrators. The question I have now is, will self-insured plans using private insurance companies as administrators be allowed to cover the full range of women’s health care IF the company issuing the plan receives any federal funds.

I think these are the major differences:
Original bill: you could get coverage for abortion in a version of the public plan.
Stupak: Now you can’t
Original bill: you could get coverage for abortion in any plan in the exchange that got a subsidy, provided there was a mechanism to separate the funds so that only the person’s funds, and not the federal subsidy, paid for the abortion.
Stupak: now you can’t; if you get a subsidized plan, you can’t have one that covers abortion.
That’s an interpretation and may not be precise. Check back about 2-3 posts for better explanation.

I watched NOW last night and David Sirota was on taking about the Left feeling let down by Obama. Whether it is the War, wiretapping, DADT, marriage equality in Maine, or healthcare, Obama has not kept his campaign promises and, in fact, pulled a 180. Sirota speculated that DEMs are slipping away and it could mean big trouble for them in 2010. I am one of those that is beyond fed up. This is NOT what we worked our tails off for last year before the election. It is hard to believe that Obama really thinks the base will be there after all this crap. Why work for a Democrat? You get betrayed by all of them.

The REAL kicker is that anyone recieving subsidies to purchase insurance is prohibited from buying ANY policy ANYWHERE WITH THEIR OWN MONEY that has abortion defined as a defined medical procedure.

My quarrel with no federal funds being used for abortions — presumably because if I am anti abortion my tax dollars might be used — is that my tax dollars are used for a lot of things, like TWO WARS, that I am opposed to.
If abortion is a legal medical procedure, between a woman and her doctor, then the government and the Catholic bishops should have no say in it.
An idea: Jane, how are your contacts? Any chance some pro-choice Dem could offer THEIR OWN motion to recommit after this vote? And that motion would have the instruction, the only instruction, to remove the Stupak language?

Not only that…but the female employees of an employer that wants to put his insurance on the exchange.
This will set workers against workers…those who want reproductive rights will want their firm to compete outside the exchanges. Those who want lower rates will say “let’s change”, lets get on the exchange.
This will make workplaces into battlefields.
Anyone else have the thought that the Dems are ‘betting the house’ on this for the 2010 elections thinking they’ll get enough seats to push thru changes to this ‘set up to fail’ plan?

Because the current Federal law only deals with direct support for abortion procedures. This applies to every subsidy the government provides, and to the “administrative costs” of managing exchanges. So if a woman or family receives a subsidy to cover part of their health care that woman or family cannot receive an abortion using that health plan.
Furthermore a woman whose employer decides to shift the company-employee health care to the “exchange”…to get more competitive premium rates…would LOSE her coverage for abortions. She would have to seek insurance elsewhere…but with so few companies offering it she might have to pay exorbitant costs. Or she could try and buy a complete insurance…but as an independent buyer (rather than on an exchange) the prices would be sky high.

Yes…no abortions can be funded through a public option plan…nor from plans on any “exchange”. Thus if a comapny shifts their insurance to an exchange employees could LOSE their coverage for abortions.
That’s a tough question as many of the families and women using a corporate plan may receive subsidies on the basis of their income. Given that they cannot use that money for a PLAN that contains abortion services I’d say that women, even off the exchange, are screwed over TOO.

I share LindaR’s question above, “why isn’t this unconstitutional?” Planned Parenthod v. Casey is the operative Supreme Court decision. The plurality opinion in that case struck down any governmental provision that places an “undue burden” on a woman seeking an abortion An “undue burden” is defined as any statute that has “the purpose or effect of placing a substantial obstacle in the path of a woman seeking an abortion of a nonviable fetus.” Surely a federal law that has the effect of making it extremely difficult for a woman to get coverage for abortion is an “undue burden” by this definition.
