You are about to hear some folks on your TeeVee talk about the FACE Act. That stands for the Freedom of Access to Clinics Entrances Act. The man who shot Dr. Tiller may have violated it repeatedly, and the failure to prosecute him then, left him free to murder Dr. Tiller now.
Discussions on laws regulating abortion protest mounted after individuals and groups associated with the abortion protest movement had begun resorting to more intrusive and extreme methods, such as obstructing clinics, vandalizing property, the intimidation of clinic patients and personnel, tresspassings, clinic bombings and arsons, assaults, kidnappings, and murders. Prior to the passing of FACE, the U.S. Supreme Court had ruled that other existing statutes were not applicable to control anti-abortion protest. In 1993, the Court decided in Bray v. Alexandria Women’s Health Clinic that an 1871 statute against the deprivation of civil rights by private groups (the so-called ‘Ku Klux Clan Act’) could not be applied to prevent abortion clinic blockades. In 1994, the Court ruled that abortion clinics need not show an economic interest to bring RICO action against anti-abortionists should they engage in racketeering activity. Yet, in 2003, the Supreme Court decided that anti-abortion protest did not fit the definition of extortion in the Hobbs Act, which requires the obtaining of someone’s property under threat of force (National Organization for Women v. Scheidler 1994; Scheidler v. National Organization for Women 2003).
The FACE Act makes it a crime to 1) obstruct a clinic entrance, 2) interfere with someone trying to worship in place of worship, or 3) do property damage to a clinic. Dr. Tiller’s protections under FACE were apparently violated in all three ways:
Tiller’s clinic, Women’s Health Care Services, was bombed in mid-1980s. In the ’90s, it was the subject of blockades, bomb threats, and a shooting attack — Tiller sustained gunshots to both arms. Just this month, Tiller’s clinic was vandalized, with security cameras and outdoor lights damaged and the downspouts plugged, causing rain to pour through the roof. Protesters routinely gathered outside Tiller’s church. In 2007, two men were arrested for disrupting services to speak out against him. Tiller often had a bodyguard by his side.
Rachel Maddow and the Washington Independent (see video above) are reporting that enforcement of the FACE act by the DOJ which had averaged about 20 per year (with a high of 17 in 1997) under the Clinton administration fell to an average of 2 per year (with 4 being the highest yearly total) under the Bush administration. Yep, and 80% fall off in enforcement of any criminal statute sends a pretty strong message to the "evil doers" that it’s OK to do their particular brand of evil.
Here’s what the DOJ Civil Division Resource Manual has to say about the FACE Act. It doesn’t say anything about not enforcing it, does it?

Wow! My lawyer could have used the Hobbs Act against my neighbor who was trying to run me off my property so he could “possess” it.
I’m not even vaguely surprised that Bush didn’t enforce the FACE Act when he was trying to stop abortion access altogether and didn’t’ give a fig about ANY law not his own signing statements.
While I’m not very happy with what Obama has done or is doing on a lot of issues, at least we don;t ave to watch a thug act like president up there anymore. That’s a relief in itself

Also, there’s an article in the Miami Herald about the steps that Dr. Tiller took to protect himself.
I had wondered if Dr. Tiller had private security. This answers my many questions about what steps he took to protect himself. Wow. It’s just so awful. Truly a modern lynching crime with local law enforcement’s blessing.

I question whether abortion serves our species. Newton, for example, was like the 12th (or so) child out of 16 (or so) children.
Killing Tiller was a crime.
But I ask, does abortion serve our species? I’ve met lots of unwanted children who do as adults a lot of good.

I thought Rachel’s piece on this was great, as was the guy she interviewed. He was good at disagreeing with parts of her interpretation while being upfront about the failures of law enforcement in this case, and without dismissing her concerns wholesale.

Shows that although SCOTUS has not reversed Roe, they seem to have done little else since to actually protect access and providers.
Dr Maddow has a point: the terror tactics are working quite well enough…reversing Roe is all but irrelevent in an awful lot of places and for an awful lot of women who don’t have financial or political/financial/class resources and clout.

I so agree. There are dogmatic theocracies which are dangerous. And, for whatever reason, they are thriving. Part of the be very afraid bs bullet points we are being fed. Dangerous, I say again.

And many a female’s life is ruined before they even get a chance to live a full life. Usually the child doesn’t have a very happy existence either despite what you say about great individuals. An unwanted child always knows.
How many children have the pro-life group adopted?
How many pregnant mothers have the PL group take in to support during their pregnancy?
Have you looked into the stats about children born into poverty, unwanted, or other states? Many end up in prison but if you want to support the private prison industry?
btw I adopted 2 children, fostered 6 children…. but never wanted to be forced to carry and raise a child I do not want.

They do not support prenatal or postnatal care, or any other support for the mother or baby.

Welcome! We are generally (although not blindly, I hope) pro- the human species here at the Lake.
So I take it you are also in favour of other human-beneficial policies, such as universal tax-paid health care, minimum living wages for all working people and a guaranteed living income for those who cannot work due to age, infirmity, or economic conditions, working to end war and poverty in policy and practice, and liberal immigration/emigration policies as well?
I have no idea if anyone is still on this thread, but I would like to speak to ART 45…what might be has little place in the abortion debate. We cannot predict that and even if we could, would you demand that Roeder’s mother have aborted him while she was pregnant? Or Hitler’s? The women who went to Dr. Tiller and the 2 other doctors willing and competent to provide this medical procedure were facing a horrible reality. They did not wish to terminate a pregnancy but found themselves unable to bring a much-desired life to term. I cannot imagine their pain (and that of the fathers.) For some, the service that Dr. Tiller provided was the only reason that they were subsequently able to bear children. If you value life, you cannot dismiss how many women’s lives were saved in this very brave man’s clinic, nor how many healthy children were later born to families who had nowhere else to turn.
