As she faces what is already expected to be a host of hostile questions from the Republican members of the Senate Judiciary Committee in her confirmation hearings, Judge Sonia Sotomayor, President Obama’s first nominee to the Supreme Court, should remember one thing: that it is not she who will be on trial, but the Republican Party.
Rather than allow herself to be put at the center of another racism and sexism-laden political circus around the qualifications of a candidate who brings more real-life prosecutorial and actual judicial experience than any other Supreme Court nominee in the last 100 years, Sotomayor should consider another strategy. She – and we – should instead view those hearings as nothing less than a trial to determine whether the GOP is ready to make restitution for its role in a number of judicial and political wrongdoings perpetrated in the Bush era. Those wrongdoings include unleashing unprecedented and dangerous political attacks on Latinos, and breaching the political and electoral contract the “new GOP” said it wanted with Latinos, one of the country’s most important voting blocs.
The Sotomayor hearings will determine whether members of the Republican Party are ready to renew fundamental principles of justice and the rule of law.
Consider the case of U.S. Sen. John Cornyn, R-Texas. Cornyn supported the nomination of the last Latino to be considered for a high office dealing with matters of justice — disgraced former Attorney General and Republican Alberto Gonzales. Even after Gonzales’s role in crafting the now infamous “torture memos” became apparent, Cornyn raised none of the “red flags” and “lots of questions” he now says he has about Sotomayor.
During the Senate Judiciary hearings around the Gonzales nomination, Cornyn declared that the candidate would be vindicated by history: “The growing consensus behind the president’s decision that al Qaeda terrorists are morally entitled to humane treatment but not legally entitled to the special privileges afforded to prisoners of war under the Third Geneva Convention of 1949 provides compelling vindication to supporters of Judge Alberto R. Gonzales’ nomination to be our nation’s 80th attorney general.”
Even when Atty. Gen. Gonzales came under fire for his role in the firings of a group of United States attorneys in late 2006, Cornyn and other Republicans on the Senate Judiciary defended Gonzales as an “honorable and decent man” who “finds himself in a bad situation.”
Though Gonzales will likely turn into the invisible brown GOP man, or go on a long vacation during the Sotomayor confirmation, millions of Latinos will watch what for them is a historical event of the utmost political and intimate importance. Many of these Latinos will be watching to see any signs of the racism and xenophobia many Latinos blame the GOP for and voted overwhelmingly against in the last election. Latino voters will, for example, be vigilant about what GOP Senate Judiciary members like Jeff Sessions say before and during the hearings.
Earlier this month, reports linking Sessions, the ranking Republican on the committee, to anti-immigrant hate groups filled Spanish-language media. According to the Washington-based America’s Voice, the Alabama senator has appeared at several events organized by the Center for Immigration Studies (CIS), NumbersUSA, the Federation for American Immigration Reform and other groups designated by the Southern Poverty Law Center and other organizations as “hate groups.”
Anything in this must-see Latino political event resembling the anti-immigrant rhetoric that has been Sessions’ trademark will cost his party for years to come. Such concerns about GOP leaders among Latinos, who are only beginning to realize their enormous political potential, pose a gigantic dilemma to a Republican Party that must make inroads among Latino voters if it is to have a political future.
Whatever they say in the hearings, Republicans will be at a great disadvantage when it comes time to counting votes in a Democrat-controlled Senate that will be at, or very close to, the filibuster-proof 60-vote majority needed to confirm Sotomayor.
So it will be the GOP and not Sotomayor that will be on trial in this high-stakes judicial confirmation of the post-Bush era of Republican dominance. Latinos will watch to see if GOP leaders will use the Sotomayor hearings to distance themselves from Rush Limbaugh, Glenn Beck and others many Latinos consider to be anti-immigrant extremists.
And we should all be watching to see if Republicans are prepared to use the Sotomayor confirmation as a way to communicate a willingness to redeem themselves for the great injustices of our recent past.

Gonzales actually had some kind words for Sotomayor.
How is it that the Rs think they can hold power while pissing off one group of voters after another? I know money is important in elections, but only if it can be used to convince voters.
I’d say these GOP senators had better prepare quite thoroughly, and tread carefully when attacking Sotomayor. She’s an experienced trial judge, she’ll be able to cut through the crap and respond very deliberately. As Obama pointed out, she has more real-world experience than anyone currently on the SCOTUS had. Which means she won’t be like the previous SCOTUS nominees they’ve faced. She’s had to control lawyers on a daily basis, how many of these GOP senators are too-cocky lawyers?
The GOP exploited 9/11, two wars, and an economic meltdown for political gain (with mixed results). The chances that they will treat this SC nomination differently are nil.
I think, regardless of the outcome, you do them undue credit. It is now the main tenet of the Republican Party NOT to “make restitution.”
They are biologically and psychologically incapable.
The GOP continues its long march into the dustbin of history. Which grows shorter with each passing day…

I think the R senators will behave themselves. This is a concerted effort to let their proxies do the dirty work. At the confirmation hearings, they’ll be polite as can be.
It’s a little hard to imagine the thought process that resulted in CNN contacting Gonzales to ask his opinion of the nominee. Somebody needs to make certain Wolf is taking his meds.

It seems like an uninspired idea to argue that support for Gonzalez should somehow blunt opposition to Sotomayor.
Why should voting for Sotomayor be seen as a a vote for “fundamental principles of justice and the rule of law” instead of being a vote on whether Sotomayor would bring a good legal mind to the Court?

Sessions went off message and said that “the Supreme Court sets the law for America.”
And Sessions is getting into trouble for speaking at (or belonging to, I forget which) some groups that are pretty virulent wrt minorities, so, yes, I suspect he’ll rein himself in. But then, perhaps I am projecting.
But if called upon to testify, don’t expect him have any recollection of the details of his service.

He did a sit-down with C-Span a week, maybe ten days ago. He is still playing defense.
As a matter of consistency, I think he will let fly with some uniquely phrased insinuations, then turn the screws.
He has already been rejected by the Senate for a bench slot, and he is in a safe seat.
If he sits on his hands, as you suggest, I will not be unhappy.
Gozales should have said: I cannot recall what I did or didn’t do for my country.

My hypothesis, that the R senators are using proxies to do their dirty work, doesn’t make sense in at least one regard. What do they hope to gain by it? She’s gonna get confirmed anyhow. Is it base-baiting? I know, Jane had a post about using it as fundraising fodder. Is that all there is to it?

Now that Rush and Newt’s allegations of racism have entered the echo chamber that theme is getting picked up by an increasing number of Rs. Clearly, this tactic won’t win over any minority voters so they must be playing to the base, (assuming there is some method to their madness).
Republicans are more likely to attack Sotomayer indirectly by railing against activist judges and invoking original intent. They may also attack litmus tests for liberal judges conveniently forgetting the litmus tests for conservative judges. I would expect them to pose situations which are setups or distort real cases to much the same end.
The real question is whether Sotomayor will give substantive answers on anything. Roberts gave a verbal display but said next to nothing (and then backtracked on even that once he was on the court. Anyone remember stare decisis. Well if you do that’s more than Roberts did.)
Alito floundered around and was a lame witness, but the phony crying jag of his wife was an effective distraction. Democratic weasels like Lieberman would have voted for cloture anyway but it worked as political theater. Maybe if Sotomayor has any young kids, she could bring them along and have them tear up if Republicans start mixing it up with her.
Otherwise I expect lots of lame questions and non-committal answers. And Senators will vote as they would have voted if there had been no hearings at all.
If you are right, teh Goopers hope to singe his wings this time around, letting him know what a more Liberal nomination will encounter when the next seat opens.
That said, Jeff Sessions will never be an ambassador or President or judge – he is a Senator, no higher. He has to run in Alabama – what is he going to do? He is going to play the same politics that got him there in the first place. We all know how that campaign was conducted.
His constituients would never forgive him if he let it be.

Senate confirmations are always kabuki. Then again, any Senate hearing containing a trace of substance is a pretty rare exception.
BTW oil is at $63.38 at the moment. This is about 100% above what its price should be given supply and the state of the world economy. It is amazing how much pure speculation like this can go on under the noses of Congress and the Administration without hearing a peep about it. And you can bet that a lot of banks and BINOs like GS, MS, and JPM are in on it.
Goopers are willing to abandon having any voice in policy right now in favor of stirring up the blood of their brain dead base for the purpose of fundraising. They figure that by next year everyone will have forgotten what dicks they are- but they’ll still have the money. Unfortunately, they are probably right.

Just what pray tell was Bush vs Gore a ruling for which it was declared no other court could use as a precedent?
I think a Dem should ask her in the confirmation hearings if any court should make a ruling that can never be used as a precedent.

In Congress, Noot’s strategy was to attack the majority constantly using any issue at hand. He did nothing else but attack and it worked. He got constant news coverage and lead the Republics into power. He’s simply repeating that strategy as he runs for President.

Hard to say if people so divorced from reality think coherently about anything. But I would say Republicans best bets are to limit losses and try to hold on in 2010 when Obama’s programs such as they are will have their largest effects and aim more at 2012 when it will be obvious that Obama’s economic policies have failed.

BTW, eCahn, I saw at Calculated Risk that banks are wanting to get in on the PIPP as buyers, so they could sell at inflated prices and buy with the government putting up most of the money and their getting essentially all of the upside. This would, of course, blow the purpose of the PIPP out of the water since it is supposed to remove these crap assets from the banks’ books. Hopefully, they will not be allowed to do this, but gamers will always try to work the game as much as they can.

I grabbed the Alito hearing transcripts and am going to wade into them this weekend. In a ‘conventional’ confirmation there would be reference points with which to lash the Republicans. But as I recall, Alito said so little that there may not be plums. It may actually be more fruitful to look at the opening statements of Republican Senators.
Next we bring up TV and Radio broadcast licenses Media Matters I’m sure has lists of lies told by the MSM’s bigger talking heads and the media’s silence after these rumors are shown to be false.
Broadcast licenses are given and can be taken away if a story is reported but not checked well maybe a Lefty blog can do a better job and they should get the license.

The old Wilco guitar player, he moved back there a while ago.
At 45, Mr. Bennett had already played with and been fired from a nationally famous band, Wilco. He also played in local bands such as Steve Pride & His Blood Kin and Titanic Love Affair.
He was from Urbana. I probably went to school with him although he was a few years younger. Of course, he probably wouldn’t have seen me unless he was in Carle Park or walking by my ‘67 Chrysler parked over on Michigan with smoke rolling out the windows.
I lived at oops, Vine and Oregon for years.
It’s a treat to see repubs flailing around, trying to find a handhold or foothold to pull themselves to a ledge from which they hurl effective rocks at Sotomayor. But instead of moving upward to their ledge, each attack seems to dislodge more rocks down upon the GOP itself.
Her’s my take. Purely as a psychologist. There are some people, who when you see photos of them or see them on TV make an instant impression of warmth. Sotomayor is one of these people! Indeed, in my view the contrast between this warm, strong, intelligent woman and the hard-edged harpies the GOP is sending out to try and take her down is so shocking – like shock and awe – it literally damages the image of repub women and elevates Sotormayor into the stratosphere. You see this warm, compassionate lady judge. And these nasty repub women, with hardly a shred of female warmth or compassion, and only the nastiness of your worst nightmare of a female. As I say the contrast is so shocking as to literally destroy in people’s minds the idea that repubs care.
I’m sure we’ll see another side of her at the hearings. But I honestly think the warmth, the compassion, the alegria, the sense of mujer simpatica is so strong I think it will drown out her detractors and make them look like deranged people. There really isn’t a translation for the Spanish words to describe her – maybe a something like “you just want to be around this person, share a meal, be her friend.” Repubs may find the image of that kind of Supreme Court Justice to be reprehensible. Maybe they’d prefer someone with a bun and severe glasses and the air of a Dominatrix so they could really go after her and tear her apart.
But they’re stuck with this lady who comes across like a neighbor you’d like to have, like the Judge you’d want if you were to bring a case before the Court. And the GOP harpies especially come across like the person you’d never want to move into your neighborhood or be on any panel that might ever have to decide your fate.
Just some thoughts. Because this kind of thing has such a powerful effect. Woe unto those who try to take down this lady! They’re going to find themselves in the gutter while she’s dancing in the sunlight!

The GOP cannot reach out to Latinos without losing its base, small as it is. I expect a number of GOP Senators to cross over — Lugar, Collins, Snowe, maybe even Hatch. But the Southern Taliban? No way.
Sessions, by asking for the maximum time to “research” will wind up shooting the GOP in the foot. Their best option is to confirm her and get it out of the media. Sessions will not do that; there are too many fundraising letters to write, a point that Sotomayor might should find a way to gently suggest.
Sotomayor will just quietly let them hang themselves.
