Remember Tim DeChristopher? He’s the University of Utah student who gave us all an early Christmas present when he wrapped up 22,000 acres of our Federal land, thus protecting it from Bushie auction to Big Carbon. Last December, Tim showed up at Bush’s "last great gift to oil and gas," the Bureau of Land Management’s giveaway auction in Utah, where he entered the high bid on almost one-sixth of the public land at risk. Tim upset the cozy energy interests when he bid so actively he widely drove up auction prices, thus bringing in more money for taxpayers—unheard of behavior among the cartel usually bidding at BLM auctions. This obvious breach of the usual custom upset Federal officials, who halted the auction and hauled Tim in front of "officials" for questioning. The land grab Tim disrupted was itself so questionable that in January 2009, US District Court Judge Urbina halted the leasing process, granting the NRDC and others a temporary injunction. In February, Obama’s Interior Secretary Salazar outright canceled the Bush-era leases, citing the BLM’s failed pre-leasing review process.
Last Wednesday, US Attorney and Bush lackey, Brett Tolman, indicted Tim on two Federal counts carrying up to ten years in prison. Yep, you got that straight. The leases were so bogus, a Federal Judge wouldn’t even let BLM cash the auction checks, and the new Interior Secretary canceled the whole scam — yet USA Tolman wants to put a non-violent student who stood up to the con job away for ten years.
Is this what "looking forward" means to Obama’s DOJ?
And, speaking of prison. . . Brett Tolman is Orrin Hatch’s protegé. He’s also the attorney who betrayed his client when, as Senate Judiciary Committee counsel, he secretly inserted language in the Patriot Act reauthorization that "basically removed Senate oversight and approval of US Attorneys." He also betrayed his boss, Arlen Specter. (Don’t feel special, Haggis, Brett betrayed the Constitution, too.)
To "punish" Brett’s treachery, the Bush Administration appointed him—and the Senate confirmed him—as US Attorney for Utah. Yes, Utah. That’s where Orrin Hatch serves his sponsors in oil, coal, mining, et al. And invests with his sponsors in oil, coal, mining, et al. And reads his sooty sponsors’ script as frontman for their astorturf group.
In choosing to prosecute Tim DeChristopher, is US Attorney Tolman following the chain of command from President Obama through Attorney General Holder, or is Tolman once again perverting Federal office to serve Orrin Hatch’s pals?
Team Obama can find the time to look around for loopholes though which to push banksters’ bonuses and look backward to prosecute Tim DeChristopher, yet can’t find the time to look backward and prosecute high-level officials complicit in torture. Who is Obama serving? And why?

He is charged with 2 felonies (sounded very thin to me). If found guilty he faces up to 10 years in prison and $750,000 fine. hmmmmm – where they gonna get a jury to convict him?

Lots of people with lots of influence over government policy have a vested interest in maintaining the status quo regarding drug prohibition. Obama isn’t going to invest any of his political capital on the issue, which he demonstrated with his snide and dismissive response to a question on the subject during his recent virtual town hall.

Ron didn’t have a detached retina. He has junk in his eyeball. The doc said that a piece of colestorial broke off from the inside of his corroded artery and went to his eye. It is gone now but he has to have some kind of doppler test on his corroded artery. Worrisome since he has huge artery issues already.

Tolman is the aide who silently and secretly dropped into legislation the AG’s right to appoint interim USA’s without the Senate’s approval. He is as political as it gets, which is saying something for Bush’s DoJ.
This is not a case a rational prosecutor would pursue; the defense would seek to open up the trial in an attempt to get in his underlying motivations, which do not serve Utah’s resource rippers or the GOP’s in general. Nor does the harm done remotely justify criminal prosecution or the status of a priority case for already overstretched USA’s. It deserves five minutes with the Sec’y of the Interior and a “thank you” from the president.
This case should encourage the reluctant Mr. Holder to recommend replacing the Bush holdovers on a much faster pace. After the scandal of the USA’s firings, it is unbelievable that Obama/Holder haven’t done this already.
I accept they are playing chicken with the obstructionist GOP’ers in the Senate, and perhaps waiting for Franken to take his seat from Minnesota. But Justice delayed is Justice denied. That was the Bush motto and objective. Mr. Holder should return the DoJ to the professional team Justice Jackson demanded that it be.

Made a donation right after Tim did his good deed and the first appeal went out…….unfortunately, time to pull out the checkbook again.
The current economic crisis has at least been vocabulary expanding. The finacial collapse taught us the term moral hazard. Tim’s case provides a “man-behind-the-curtain” moment for rent-seeking, particularly as it has been practiced by the mineral and hydrocarbon extractive industries in recent years. Politicians in low- population Western states are particularly good buys for rent-seeking corporations (e.g. the late Craig Thomas’ brave rescue of mineral extraction firms from resource extraction fee hell).
Rent seeking generally implies the extraction of uncompensated value from others without making any contribution to productivity, such as by gaining control of land and other pre-existing natural resources, or by imposing burdensome regulations or other government decisions that may affect consumers or businesses. While there may be few people in modern industrialized countries who do not gain something, directly or indirectly, through some form or another of rent seeking, rent seeking in the aggregate imposes substantial losses on society.
