Republican Jim Tedisco may be running for the House in a district where Republicans outnumber Democratic voters by some 70,000, but with the polls closing in a matter of hours, Tedisco’s campaign is prepping for a loss.
An electoral loss, anyway.
The Dutchess County Clerk’s Office has confirmed to FDL that Tedisco’s people have filed an ex parte motion in order, the effect of which would be to investigate and overturn today’s election results, should the outcome not be to Republicans’ liking.
FDL is trying to obtain a copy of the motion and will post when available. We now have a sloppy copy (PDF), and are poring over it. Here’s the fun that’s right up top (click image to enlarge):
Beyond the standard practice of seeking to impound machines, determine validity of affidavit ballots, etc., the Tedisco campaign goes for this grand overreach–and does so hours before the polls even close. (I am not a lawyer, but the ones we have here tell me this is not standard operating procedure–this is a desperate play.)
This filing come on the heels of a report that Tedisco’s own polling has him losing to Democrat Scott Murphy by a narrow margin.
The race has national implications, especially for the Republicans, who see this as an early test of new RNC Chair Michael Steele’s leadership.
For Democrats, a Murphy victory would hold the seat vacated by the promotion of Kirsten Gillibrand to the US Senate.

So that’s how Republicans see democracy – if you lose, sue. Because the Will of the People is less important than Republican Political strategy. It worked for George Bush, it’s working for Norm Coleman, and now Tedisco. Of course, the Republicans are more willing to sue, because they are more aware of how easy it is to fix voting numbers in elections, having done so many times now.

Seriously, assuming a recount is in the cards, are we in for another MN situation where the seat could remain vacant for months?
Just what grounds will this motion be based on? Will there and how long will be the court fight?

Are Republicans now going to contest every lost election to prevent Democrats from being seated? Clearly they are only pro-democracy when it works to their advantage.
I for one am heartened to see that Republicans have kept their integrity and have not knuckled under to Big Vote.

I don’t think Scott Murphy can be considered a “blue dog” until he at least gets elected.
But why should we care?
Cuz:
1) It puts a crimp into the Republicans plan to use this election to start their “comeback.”
2) It will p*ss off the Republicans to no end to have the Ds hold a seat that should be a strong R seat. Especially since Tedisco started out with an overwhelming lead and watched it all fritter away.
We need to appoint some more judges the GOP only tries this stuff because they know they packed the courts with hacks. Nobody from the Federalist Society, any right wing Preachers bible college or the young Republicans need apply for a government job.
Monica Goodling only hired loyal Bushies regardless of qualification, we will hire ANYONE but a bushy who is qualified.
These nuisance lawsuits have to stop.

it’s a beautiful day here & a few of us from hudson valley for obama have come up to help our cousins in greene county get out the vote.
we’ve had about 60 people knocking on doors & 45 ppl phone banking just in this office & there are 6 other fully staffed offices throughout the voting area.
everyone is in high spirits & there’s a strong feeling in the hood that that scott murphy is going to win!

This would be in NY State courts, not the Federal court system.
True the GOP cannot claim that voters are turning on Obama if they can’t hold that red of a seat.
And it’ll make Steele talk stupid again.
How many GOP Governors appointed state hacks? This lawsuit would not be filed if the GOP did not have some hope of winning.
Seems to me that anyone who has said that he will become a Blue Dog after election is pretty much a Blue Dog. Giving more power to the Blue Dogs definitely works against our interests in the long run, as they actually seem to be more powerful than Republicans right now.
In fact, a part of me would like to see Tedisco win, just to save Michael Steele. With him at RNC, 2010 will be much easier, election-wise.
I like to p*ss on/off Republicans too, but that’s not really what we’re about is it?

I’m in no way a fan of the Blue Dogs but can understand one from a Republican leaning district. I just don’t understand the ones that are in solid Dem districts that act like a Republican.
Didn’t the rethugs always complain about frivolous lawsuits I guess IOKIYAR Sounds like their new complaints about using reconciliation.

It’s not really about Murphy or Tedisco, now is it?
Let’s not forget the voters in NY-20 who lose if this election does become a “protracted legal fight.”
NY’s judges are elected, not appointed.
As far as everyone who is concerned about Murphy being a Blue Dog, take it from someone who has lived in Tedisco’s Assembly District for almost his entire life — NY-20 deserves just about anybody other than him. The man can’t think for himself after 20-odd years of spouting GOP talking points in Albany. He’s a joke. And, on a personal note, he’s also a bit of a prick.
A friend of mine who lives in the district was push polled by Tedisco’s org. She’s very soft spoken, which belies her delight in drawing people into saying things that she can learn from. The call started out asking who she was gonna vote for and she said Murphy. Followed by Qs that would put him in a negative light. About 5 minutes into the conversation, he asked something to the effect that what should happen to Obama if he were caught. She stopped the conversation immediately & asked the caller’s name, saying she would not continue to talk to him unless he gave his name. He hung up.
My friend thinks the substitution of Obama for Osama was deliberate. Her husband (who wasn’t on the call) thinks it was a slip of the tongue. Either way …

I’m Live Blogging & Twittering NY-20. So far, it seems as though Tedisco might know that he’s losing. Exit polls currently show a trend toward Murphy and there is high voter turn out (a bad sign for Tedisco). Although, it’s still early yet so we’ll see what happens.
