In a report just made public (PDF), the House Judiciary Committee issues a scathing report on the Bush/Cheney abuses against the rule of law. Entitled "Reining In the Imperial Presidency," the report details a myriad of issues which have plagued Congress and the judiciary where the Bush/Cheney administration has overstepped constitutional boundaries.
From the forward by Chairman Conyers:
…The contrast with the Bush Department of Justice could not be starker. In this Administration, too many Department leaders abandoned that proud tradition of independence and integrity, and made decisions based on political objectives rather than the facts and the law. Young political operatives were given control over the most sensitive operations of the Department, and federally protected, non-partisan law enforcement positions were used to provide political patronage. The Civil Rights Division was twisted to obtain partisan electoral advantage, rather than protect the most vulnerable among us from discrimination.
In keeping with its imperial aspirations, the Administration went to extraordinary lengths to hide its conduct from scrutiny and avoid accountability. Thus, the White House refused to respond to congressional subpoenas, and insisted that presidential aides – and even former aides – are immune from subpoena, even though numerous presidential aides have testified under congressional subpoena during past administrations, as every citizen is legally obligated to do. Here, too, the Administration was following the example set by Richard Nixon. When President Nixon suggested such a claim, Senator Sam Ervin responded: “That is not executive privilege. That is executive poppycock.”
The Bush Administration has relied on even more extreme claims in refusing to release documents subpoenaed by Congress. In the end, the Administration has been so recalcitrant in asserting this “executive poppycock” that the Committee was forced to pursue witnesses and documents in federal court. Even after the Committee secured a historic victory rejecting the Administration’s claims, the White House still refused to relent. As of this writing, the matter remains in litigation.
There have been additional transgressions against the Constitution and the country by the Bush Administration. There was the contrived and manipulated drive to a preemptive war of aggression with Iraq. In the words of the Downing Street Minutes, “the intelligence and facts were being fixed around the policy.” There was the unconscionable use of detention without cause; enhanced interrogation if not outright torture; extraordinary rendition; the extralegal use of national security letters; warrantless wiretaps of American citizens; the unilateral weakening of our regulatory system; the use of signing statements to override the laws of the land; and the intimidation and silencing of critics and whistleblowers who dared tell fellow citizens what was being done in their name.
There will be a LOT more on this to come. But I wanted to give everyone a shot at reading along with me in this detailed report (PDF). Consider this a working thread for all of us.
The report is more than 400 pages in length, and while a lot of the information plows old ground for many of us who have been paying attention? To see it laid out in stark detail all at once is beyond appalling.

Let’s hope they do much more than express outrage. Will Dubai extradite? Must we take delivery or can shipment be arranged directly to the Hague? Will we get the package back to try here afterward? Can truth serum be used if the truthee is in favor of torture and any means to get information from a terrorist?
Some days you have to just hang on to that overriding desire to return to democracy. Or should we hope that we actually become a democracy? The republican form of government has done one thing too well. Kept people from being represented. It seems mired in corruption for all involved. That can’t be right.
About 7 years late, but OK.
They issued a minority report a few years ago when the GOP was in control of the House, too. None of these have had enough legs to force prosecutions. This is the most in detail I’ve seen them get and, if nothing else, it is a record of issues with the misconduct so that, even if prosecutions are not forthcoming, there will be something in the official record to decry the action should some future administration attempt to use it as precedential behavior.
Lord knows I’d like more than that, but I’ll take it as a stepping stone.

Well, now it is too little too late…unless you actually intend to do something substantive about it: CRIMINAL PROSECUTIONS. Without investigations and prosecutions, then this document is just a bunch of hollow words.

from the last Congress; that we create a “blue-ribbon” commission or similar select committee,
along the lines of the 9/11 Commission, to investigate these matters and report to Congress, the
President, and the public; and that the incoming Administration finally begin an independent
criminal review of activities of the outgoing Administration, such as enhanced interrogation,
extraordinary rendition, and domestic warrantless surveillance. These initiatives can and should
work collectively and without prejudice to one another.”

BTW, coming from a conservative, Obama is a lot of things, but he isn’t stupid. He knows very well if he tries to go down this road with his Justice Department, it will put a lot of resources off the area’s he is wanting to push through. I quit watching the show when life imitated art (Abu Ghraib, etc). The other day my wife mentioned that the show was talked about on NPR and that it was going to go anti-torture or something, so I watched the season opener.
Conclusion? Not much of a change. It starts with the Bauer character coming before a senate panel investigating his unit’s (and his) use of torture. He defends it as necessary and that he’d absolutely do it again even though it was illegal because it saved lives ™.
Bauer ends up being pulled in by the FBI on a terrorism investigation they want his help on. The FBI agents are making a point of being disgusted/repelled by his former tactics and mentioning that such actions don’t play in the FBI. Except when it does…Bauer’s (hot chick) FBI agent partner in the investigation ends up using torture against a hospitalized suspect – the details aren’t shown fully but she digs her gun into the guy’s gunshot wounds through his bandages and when that doesn’t work, crimps his breathing tube until he spills the beans.
While the show is making sounds that “torture is illegal” they are STILL defending it GOP-style as all Amerikken and Apple Pie and necessary.
So, what would you recommend then? And what should you and all of us be doing to push it? No just bitching, thank — I’d like ideas on action from folks who are not satisfied with the status quo. I can’t go to work based on people just griping, thanks…and I’ve had it up to here with a lot of kvetching and no counter-proposal on what ought to be done and how to make it happen.
This isn’t just something any of us can snap our fingers on, if it were, it would have happened years ago when Glenn, Marcy, me and a bazillion other people started pushing it out into the open. Let alone Jane Mayer, Bart Gellman, Charlie Savage and the rest.
So, what’s your idea for a solution? And not just Praedor, but anyone not happy with the way things are. Give me ideas and I’ll see what we can do to help — but just griping isn’t enough to change things. It just isn’t.
No apparent call for a Special Prosecutor. Without one, I am not sure the full story will be told or that those culpable will be held accountable.
Personally, I can’t see anything happening unless Holder can be pressured to investigate. Anything Congress does will be limpdick all the way and be as useful and truthful as the 9/11 Commission Report (not so truthful afterall).
Beyond that, ensuring that as many of these enablers get ejected from Congress in the 2010 election as possible (including Conyers the Impotent Worm) is another good target.
I haven’t found one, yet — but I have several hundred pages yet to read, too.
That’s where Holder comes in. He is either for the Rule of Law and the Constitution, or he is not. If he is the “man of integrity” that Obama claims him to be, then he would have no problem appointing a Special Prosecutor.
I recommend Patrick Fitzgerald.

Turley and others are correct that we need to take care of this business here before we are compelled to do so by the international community. If the incoming administration expects to be able to improve our standing globally, I don’t see how this can be swept under the rug.

There is a lot of confusion in the terminology, special prosecutor, independent counsel, etc. I doubt that it will happen but it occurs to me that if Obama’s line is that he wants to concentrate on “moving forward” then why not kick this over to somekind of independent counsel? It gets it out of his hair. I would think this would solve his problem.
I know this is Pollyannish of me. Neither party wants a truly independent look at the Bush years because both parties have so much to hide, and yes, Nancy, I am thinking of you.

Getting quickly to the heart of the matter, aren’t you? I think that a prime reason that our political leaders and the media are so eager to move forward is that they don’t want to delve into their own participation in the disasters of the Bush Administration.
Christy, Conyers and Obama are both constitutional law men, surely they’ve collaborated on this. Could it be like that ‘now make me do it’ stand that FDR (?) took? and Conyers is going to lead the charge? (I’m still hoping).
Think I’ll write Conyers and committee an inspiring thank you e-mail.

Well for one thing, this is a really detailed amalgamation of all the stuff we knew, brought together in one place.
Collectively the amount of information is overwhelming in a persuasive “where there’s smoke there’s fire” kinda way.
It’s just a report, but it reads like it wishes it could be an indictment when it grows up
I think it SAYS good things. Now we need to force Congress to DO those good things.
It’s a step in the right direction, but this is a journey of a thousand miles and millions of steps. We ain’t there yet
HERE HERE! I have long wanted to restrict Presidential pardon power so that it cannot be applied to anyone with which the President has had a personal, professional, or financial relationship with. Period. Thus, Vice Presidents and staffers couldn’t be pardoned, donors couldn’t be pardoned, advisors couldn’t be pardoned.
Sometimes when I’m in a really cynical frame of mind I wonder if the whole Clinton impeachment thing was meant not to destroy Clinton, but to destroy the whole idea of impeachments and special prosecutors, to clear the way for future Republicans to get away with breaking the law with impunity, and lording it over a weakened and fangless Congress.
Kinda how its worked out, isn’t it?
I’d say bring back the Special Prosecutor law.
And give the Democratic “leadership” of Congress a spine implant.

Conyers is a complete joke. Cheney keeps his toothless subpoenas on a roll in the Whitehouse bathroom and literally laughs at the idea of being prosecuted. Obama will start his term being just one more of the BushCo criminals. Aiding and abetting is still a crime down there isn’t it? If the people don’t hold his feet to the fire he will not do his duty.
this is exactly what i want to look for in the report – is it an attempt to whitewash conyers’ legacy of complicity? or is does it contain some element of self reflection and acceptance of partial responsibility?

perris, At that time I sent a letter of appreciation for their prior work but also pointed out their responsibility to uphold the constitution – - sort of ‘for God’s sake, do your duty’. Most on the House Judiciary Committee did vote against passage of FISA. I will never forgive Obama’s voting for it.

The table of contents on the report is encouraging – appointing a special counsel – clemency for critics – more protection for executive branch officials. The sad thing is that the entire report is full of IMPEACHABLE offenses.
Now they come out with the report? Horse gone, close barn door.
