Under the act, the Claims Commission can &lt;em&gt;only&lt;/em&gt; award monetary compensation and is expressly prohibited from retoring title to the lands in question.  You are correct that this was a gross miscarriage of justice, but the fault is in the legislation, not the SCOTUS decision.  Now &lt;a href=&quot;Oliphant v.
