Welcome back to another day in CrazyWorld CheneyWorld, or as we like to call it, the "Fourth Branch". The NYTimes via AP is reporting that Darth Cheney has declared that he, and he alone, has the power to decide which, if any, of his papers are covered by the Presidential Records Act.
– Dick Cheney’s lawyers are asserting that the Vice President alone has the authority to determine which records, if any, from his tenure will be handed over to the National Archives when he leaves office in January
Clearly, he thinks he has more expertise in these matters than, oh say, the National Archivist, ya know? A person who is a professional in these matters?
The 1978 Presidential Records Act requires all presidential and vice presidential records to be transferred to the National Archives immediately upon the end of the president’s last term of office and gives the archivist responsibility to preserve and control access to presidential records. The law ended the tradition of private ownership of presidential papers, opening White House records to the public and historians. But the law carves out exceptions for personal or purely partisan records.
National Archives officials have said records of Cheney’s dealings with the Republican National Committee would not require preservation under the law. As of November, it had not made a final determination on the status of Cheney’s records produced when he acts as president of the Senate, which he says are exempt.
But the law is unclear on how disagreements will be decided about the preservation of disputed records, said Steven Aftergood, a government secrecy expert at the Federation of American Scientists.

Look, SOMEBODY better slap a subpoena on this mook before he shreds all the evidence of what has actually happened for the last 8 years. I don’t care who, Congress, DOJ, a Qui Tam plaintiff, somebody.
If he shreds in the face of said subpoena, he could be on the hook for contempt and maybe even obstruction. Even without a subpoena, if anybody assisting in the shredding ever flips on him, and he shredded evidence of his own criminality, he would still have an obstruction problem.
So, Darth, how SURE are you that your people will stick by you?

My bet is that both Shooter & W have already destroyed a large portion of their records. I figured out that they were going to do this in the summer of 04 or 05. And we have had the evidence of the trashed emails. So how could it be otherwise.

The moment he comes into office, President Obama should order the NSA and CIA to figure out how to get ahold of all files to which the public is entitled under the Presidential Records Act. They should have the hacking and surveillance technology to do it, if anybody does. All that electronic surveillance and infiltration technology shrub’s secret policemen developed to illegally spy on Americans and foreigners should be (legally) employed to secure public documents hidden in shrubco’s secure file servers. Some wiretaps on Darth’s phones would be good too… permanently.
Maybe this is why David Addington actually responded to the Capitol Hill subpoena and showed up: there are no outstanding subpoenas applicable to the Fourth Branch.
I expect a sternly worded letter from Leahy or Waxman, nothing more. Remember, Cheney still has all the NSA raw intercepts. And he uses them, of that you can be sure.
He may have their signatures in blood on contracts.

Maybe a private plaintiff could pull of something with the right timing and right judge, but the streets are littered with the bodies of people who were holding their breath, waiting for Democrats to do the right thing.
I do think a private plaintiff like Arar or the Rasul crew should be serving him, esp after his admissions to ABC, with a subpoena and should also be arguing that his participation in the OLC and DOJ solicitations to torture should kill privilege on anything that isn’t property and strictly classified (like the legal reasoning of opinions) bc, you know, if those opinions were rendered for the CIA, or Pentagon —- um, Cheney isn’t a part of those orgs and apparently isn’t a part of the Presidencey either.

must include transcripts of his mockery of Karla Tucker, and probably the orders I’m heard he issued for condemned prisoners, on the eve of their execution, to be publicly paraded (complete with announcement of their names and crimes) in front of mocking demonstrators on the street outside their prisons. Hope we never have another person like Cheney even near the presidency. He is a total dictator and all the freedoms would be gone. He managed to get rid of quite a few even as VP. The world will be a better place without him.

Look at how much government business this White House poured through the RNC and its computers. We can expect them to claim that all those data flows are “partisan” and, hence, are outside the reach of the PRA and related judicial orders. Such arguments would be intended to obscure that the Act applies to records of governmental business regardless of who carries out that business. The bottom line for these guys is that it’s all partisan, all the time; there is no “government business” apart from partisan business.
Mr. Vice doesn’t feel obligated to follow laws the breach of which carry the death penalty, such as war crimes legislation. Why would he bother with a law the violation of which carries no penalty? Which is why court orders, etc., are necessary, to supplement that law.
Until now, the PRA’s obligations were deemed so obvious, it didn’t need teeth. I guess Congress ought to think again.

I thuink those are both good arguments that I would be very comfortable making in court. It is not settled that either of those arguments would win, no matter how much I wish they would.
