"It’s unfortunate, obviously, but it’s not the end," Schwarzenegger said in an interview on CNN this morning. "I think that we will again maybe undo that, if the court is willing to do that, and then move forward from there and again lead in that area."
This is a governor who twice vetoed marriage equality bills that reached his desk after being passed by both houses of the California legislature:
"This will be part of his legacy," said Geoff Kors, executive director of Equality California, which sponsored AB43. "He single-handedly is standing in the way of lifting the cloud of discrimination for millions of Californians."
Arnold demeaned the fight for civil marriage equality further today by comparing it to his bodybuilding career:
Today, Schwarzenegger urged backers of gay marriage to follow the lesson he learned as a bodybuilder trying to lift weights that were too heavy for him at first. "I learned that you should never ever give up. . . . They should never give up. They should be on it and on it until they get it done."
Thanks, Arnold, for all you’ve done for marriage equality in the state you govern: two vetoes, a broken promise to "always be there to fight against" Proposition 8, utter silence throughout the entire campaign, and now, today, comparing our fight you made possible in front of the Supreme Court — to your bodybuilding.
We won’t quit, Arnold. Why did you?

Ahnald is a Republican like I an waffle-iron. They were simply shameless enough to back him, so he was theirs.
And there are, or were a few good Republicans in leadership, but are largely squeezed out. That is a real shame.

I think it may be time for “the alphabet people” (as a friendly sexologist friend calls them) to stage their own civil rights movement. Being nice and patient does not seem to have been to successful. Much harder to ignore you when you are right up in their faces.

The challenge is framed entirely within state law, with no federal component whatsoever. No one wants Scalito and Roberts to have a whack at our marriage equality. This will be decided, finally, by the California Supremes, with no federal involvement whatsoever.

That reminds me. The first place I ever taught was a community college in the western suburbs of Chicago called The College of DuPage. Their most illustrious alumni were the Belushi brothers. for CT at 54: ianal, but everything I’ve read says that since the arguments are framed without any recourse to federal law and entirely as a state constitutional issue, the decision would not be appealable to SCOTUS. That’s why the original decision, handed down on May 15, could not be appealed to SCOTUS. It only involves California law, and so SCOTUS has no interest in hearing it. There’s no way to craft an appeal. But, ianal.

Maybe after Obama makes some appointments to SCOTUS we’ll get a proper ruling at the federal level. It’s a lot to hope for and a long way off but at least it would end the back and forth. Remember Everett Dirksen, quoting Victor Hugo when speaking about the Civil Rights Act of 1964.

I have a friend who graduated from DuPage, didn’t know the Belushi boys were alums.
We could always expand the Supreme Court to 13 justices (Congress gets to set the number) and make them totally irrelevant.

Replacing ”Liberal” justices with ”Moderates” isn’t a step forward.

I have been proposing SCOTUS-to-13 for some time now; the Edwards campaign was particularly interested in the idea. I’d better find all that research and start writing about it again. It needs to happen, and the next President should name the bill after William Rehnquist, who was always complaining about the workload at SCOTUS. That would shut up the right-wingers, for about a minute.

Mind you, some of the more ”liberal” justices were appointed by Republicans, sometimes you don’t know what you’re getting. Having said that, the conservatives on the court will do anything (including taxidermy) to stay until the next Republican administration. Let’s hope that takes so long some of them choose to retire sooner.

I guess my point is that, given the composition of the Senate, these justices who are about to leave are about as reasonably just as we are likely to see. I wouldn’t bet against the Goopers putting holds on SCOTUS nominees if you put a gun to my head.

I wouldn’t be a bit surprised if Ahhnuld is considering running for Barbara Boxer’s Senate seat in 2010. If Ahhnuld had been a more vocal opponent of Prop H8, he wouldn’t be able to get the support he needs from the religious knuckle-draggers.
