President Bush sidetracked a congressional probe by wrongly invoking executive privilege, according to a draft bipartisan congressional report released today

Remember when the House Oversight Committee tried to get copies of Dick Cheney’s interview with PatFitz? The one Pat said was not subject to any GJ or other privilege or agreement as to its confidentiality or other uses?
The transcript that caused Attorney General Mukasey to be threatened with a contempt citation for failing to turn it over to Congress? And then Bush asserted Executive Privilege even though Cheney swears he is not a member of the Executive Branch?
Yeah, well both sides of the aisle thinks that’s a crock. More from ABC news. Oh, and from the excerpts ABC is quoting the report must be dripping with sarcasm.

My guess is he’ll be courted by some combo of white glove law firm/wingnut welfare shop on Wall St so that he can be an eminence grise and provide all the lowly associates with his pearls of wisdom as they await his every pleasure.

Saw Barbara Boxer last night saying investigations and, yes, even war-crimes trials would be worthwhile, in order to be certain that Bush-style abuses never happen again. Difficult for me to believe that will really happen, but, then, I’ve said that a lot the last eight years.

I thought the next step was a nasty case of writer’s cramp for the Decider when he signs each one in the still growing stack of Presidential Pardons.
Bipartisan – yeah, for now. Davis only signed off because the rethugs are trying to put as much distance as possible between themselves and Bush. When the election’s over, they’ll go back to calling it (and any other investigation) a Dem witch hunt.
I heard it a little differently.
The *question* was about investigations and possibly war-crimes, but in her answer all I heard Senator Boxer address (albeit affirmatively) was ‘investigations’.

I accidentally heard Rushbo today talking about Mahoney who replaced pedophile Mark Foley. Rush said Mahoney is worse than Foley because the teenage pages were to blame, not Foley. I do not have a link to the audio yet on this. I guess we can thank Rahm E. for Mahoney.

OT with apologies. This afternoon, NPR host interviewed author of a new book detailing how phone surveillance has been accomplished under booshchenkopf. Mebbe you all already knew. Both ATT and Verizon outsourced the middle link in the process. Use of spy-hopping our calls has risen dramatically. The care and feeding of these intermediaries has resulted in development of a whole new ‘industrial’ complex figuratively & literally right across the street from NSA hdqtrs., as I understood it. I was listening to the story while trying, with mixed success, to stay in my own lane and not explode till I got home without incident. So, best that you check details for yourselves.
Could be…but I think her failure to rule out war crimes charges constitutes a tacit willingness to pursue them, as long as there is the political cover for them to do so.

Assuming Obama wins, immediately after the election, he should very discreetly, but forcefully, communicate to Bush that his administration will consider any and all pardons that are found to conceal or abrogate clear criminal activity to be newly committed crimes of obstruction of justice that will be prosecuted. Just as a friendly advisory. Bush, as President, may have the unfettered power of pardon; but if it is intentionallyused for a demonstrably improper purpose, there is no reason that cannot be an overt act toward an independent crime. That ought to give Boosh a little pause.
That’s a good thought – probably quite a few less. Won’t have that much effect on the noise level, though.

cheney doesn’t actually think “he’s not part of the administration”, what he really thinks is;
“I am both, I am part of the adminsitration when that is good for me to be, I am not part of the administration when it’s better not to be”
that’s what he actually really really believes, he believes he has all the power he chooses to take and the only recourse congress has is to impeach

I don’t think that will work because of the pardon powers defined in the Constitution. The only restriction is in cases of impeachment.

I think Delay has been under indictment for quite some time (although some charges have been tossed on appeals).
But some nice Federal charges would go nicely with the state charges.

I’d like it more if Congress showed some righteous indignation. Barbi Boxer was on Rachel’s show Monday and was asked by the inimitable Ms Maddow about war crimes & malfeasance proceedings under the 111th Congress. Boxer waffled and wagged, but the most she’d sign up for sounded like a Toothless Truth Commission TM.

MADDOW: Would you support efforts to bring accountability on some of the constitutional issues, some of the potential war crime issues that do plague our ability to regain the moral high ground and to be a beacon of hope in the world? Would you see that as looking backwards at the Bush administration, or would you say that as a way to move forward?
BOXER: I think-I think it’s a way to move forward, if it’s done right. It needs to be done right. We need to look at what abuses of power took place, so that they don’t have it again with future presidents, be they a Republican or Democratic or any other party, we need to take a look at that.
So, no, I think, if it’s handled right, of course, we’ve got to keep our eye on the ball. First and foremost, we got to get this economy back on track. We have to end the war in Iraq in a responsible way. We have to continue in our fight against terrorism and Osama bin Laden. These are the things we must do but we also must take a look at, you know, these abuses of power.
One of my worst experiences as a United States senator was going up to some secret room and looking at pictures from Abu Ghraib, a lot of which the public has since seen. I don’t think I’ve ever felt so lost for my country. And, I think, we need to take a hard look at that. As I said, do it in the right way so that this never ever happens again.

A pardon in the usual understanding has to be for a conviction not the chicken shit Ford pardon.
