The EU Human Rights Convention negates the need for individual member countries to have their own Bill of Rights as the EU HRC overrides these and is obligatory for all members as is access to EU judicial process if and when all avenues within a member country is exhausted.

A whole bunch of our political ideas (contract between Government and citizen, e.g.) comes from there. And that stems from a long history of individual rights based largely on property rights.

Another advantage to that approach (if you want to consider it that), is the govt may be the only entity with the power to work around the stickier legal issues involved in the origination and slicing and dicing of mortgages. These issues are surely headed toward tying up the courts for some time.

Ultimately, there may be no rational alternative.

Govt could even elect to be a power for good with respect to the borrowers.
