Today is the first day of the October term in the SCOTUS. AFJ previews the term. SCOTUSblog details three cases argued today, and will be posting oral argument links when available. They have also detailed cases coming up this week, including background thereon.
ACLU has some information on cases of concern this term. Stephen Shapiro, ACLU’s legal director, said this:
The upcoming Term will inevitably provide more insight into the judicial personality of the Roberts Court. Some of the most important cases are still in the pipeline, however, including two significant cases involving the ACLU. In al-Marri v. Pucciarelli (08-368), the ACLU has filed a petition for certiorari asking the Court to determine whether someone lawfully residing in the United States can be designated an "enemy combatant" and imprisoned by the military without charges or trial. And, in Northwest Austin Municipal Utility District v. Mukasey (08-322), the ACLU is opposing an appeal that seeks to challenge the constitutionality of the Voting Rights Act, which Congress reauthorized in 2006….
Constitutional rights can be overruled directly, or the ability to enforce those rights can be whittled away slowly without much public discussion or accountability. The cases on the Court’s docket this year open the door to a stealth attack….
John McCain and his 527 allies are trying to raise questions about potential Obama court nominees. Looking at how the Roberts Court has slapped down years of precedent on equality and whittled away at choice, pay equity, civil rights, and civil liberties, I’d think the last thing McCain wants is remind us he wants more Roberts and Alito. No thank you. Prof. Erwin Chemerinsky says "no thanks" to McCain as well.
Should be an interesting term.

Rumor is that there may be three justices all contemplating retirement. And I have no desire to have McCain selecting replacements, let alone Palin. *shudder*

Thus far, the Court has turned down cert on several big picture issues this term. It’s been an odd start, I’ll say that…

I think that may, in part, depend on who comes in fresh and how they comport themselves in office. And what leverage the Dems who have been good on these issues have in terms of pushing a better agenda. With better numbers may come a better set of action…here’s hoping. On my wish list? Getting Feinstein off the Judiciary Committee, for starters…

Why does the answer always seem so easy to the layperson? IMHO, the answer is a resounding No. The term enemy combatant is Addington/Cheney Orwellian and therefore moot. And this country is supposed to have habeas corpus.

Yes, activist judges do not include people like Clarence Thomas, Nino Scalia, John Roberts or Sam Alito. Nosirree. Don’t even think it.
Nothing original but i just wanna vent a little——- Never ceases to amaze me how those people can continue to rail agaimnst “activist” jusges when, as Christy points out, the Roberts Court slaps down years of precedent in several areas. Respect for stare decisis is the greatest measure of a truly “conservative”, nonactivist jurist. Theses guys pee on stare decisis. But continue to wrap themselves in the conservative mantle. Aaarrrggghhhhh.

Thanks Christy for bringing this to the forefront. This is clearly one of the top 3 issues that needs to be talked about with the public but never gets mentioned in the alleged press. The choices made by these two VERY different ideologies will effect the US for generations if not centuries..
Three maybe four Supreme Court justices are going to retire, 40+ Federal judgeships are already ‘on hold’ awaiting the next president with MANY more to follow..
Something else that needs to be discussed and I’m not sure here to put it..That’s the issue of Palin and Darfur. Shannyn Moore (radio host from Alaska) posted this either last night or this morning and it’s disturbing. These are FACTS while 70 million were exposed to lies last week by the Republican VP candidate. This needs to be exposed..because it’s scary..

Scalia rubs me the wrong way personally, too. Seems he fancies himself quite the intellectual. He impresses me as a smart guy– much smarter than me. But i guess what gets me is that there are 8 other extremely smart people on that bench with them but when they disagree with him, he’ll lecture them like ignorant schoolchildren. No respect for his colleagues who are every bit as smart as him. His writing style sucks in that regard and you’ll be seeing it imitated in a whole generation of insufferable right wing judges comming up.
Moments like that certainly puts life in a whole ‘nother perspective … found out last week that a young lady who was very dear to us had passed suddenly.
Family is in deep shock as are we … I can’t bring myself to be strong enough to visit them as yet …

Odds that a question about judicial appointments comes up Tuesday? Biden brought it up and well, i thought, but too subtly for most people probably in the debate Thursday when he was asked if he’d changed. Thing is, even if it is brought up, McCain will bet let off with “interpret not legislate from the bench” and they never get pushed off that dime.
