I'll start with a couple of questions for Governor Siegelman--ask yours in the thread!
1) In an apparent attempt to create an excuse for Rove's refusal to show up and answer questions under oath, Lamar Smith gave Rove questions to answer about his role in your prosecution. While Rove denied he had spoken to "Justice Department or Alabama officials" about your prosecution, he did not answer Smith's question about whether he had spoken with "any other individual" about your prosecution. Who are some of the people--outside of DOJ and Alabama state government--that you think Rove might have spoken with about your prosecution?
First, let me say that Rove is showing contempt for Congress by not obeying their subpoena.
Second, even his written non-answers were not under oath and clearly evasive. As you noted, Rove refused to deny that he had plotted with my prosecutor's husband -- Bill Canary (Google this Republican political operative!) -- to get his wife, Laura Canary, the U.S. Attorney, to begin a federal investigation and join with the state investigation which was started by Rove's client, Alabama's attorney general, Bill Pryor. Others who have been named in testimony before the House Judiciary committee include the Republican governor's son, Rob Riley.
According to sworn testimony before the Judiciary Committee, both Bill Canary and Rob Riley were on the call in which Canary said that Karl had it worked out with Justice to destroy me. A business associate of Rob Riley's in Florida told Time Magazine that Rob Riley always bragged about his relationship with Rove.
In addition, Karl Rove's client's campaign manager's wife who pushed the federal investigation after career employees said it should be stopped should also be called before the committee to testify.
Karl Rove built his career in Alabama working with Bill Canary. Bill Canary and Bill Pryor started investigating me in 1999. Laura Canary accelerated the case federally in 2001, she indicted me during the 2006 campaign, and she brought me to trial less than four weeks before the Democratic primary. There is sworn testimony that Bill Canary said that he had it worked out with Karl to destroy me, and that two Alabama US Attorneys would do the job. Both those US Attorneys did in fact indict me. And now, Rove refuses to deny that he talked to Bill Canary about prosecuting me.
Does anyone believe all this is circumstantial? How much more proof do you need? They sent me to prison on less evidence than this.
2) While Lamar Smith made it look like he was asking Rove thorough questions about his involvement in your prosecution, Smith fell far short of doing so. What are some of the other questions that Smith ought to have asked if he really wanted to learn the truth about Rove's involvement in your prosecution?
- "Did you ever have a conversation with your client -- the state attorney general -- or with Bill Canary about the political damage that a criminal investigation would have on Governor Siegelman?"
- "Did you ever discuss with the President how the U.S. Department of Justice was being used as a political tool to go after your political opponents? If not, how can you now claim executive privilege?"
- "Did you use any intermediaries to communicate about Siegelman's case? " (According to sworn testimony by Scrushy attorney Art Leach, Andrew Lourie, Head of Public Integrity at DOJ, told him that the indictment decision was being made above the level of Dep. AG Alice Fisher.)
- "Did you discuss the Siegelman matter with anyone prior to their appointment at DOJ?"
- "Did you play any role in the vetting process of Federal Judge Mark Fuller, US Attorney Alice Martin, and/or US Attorney Laura Canary?"
- "Did you ever discuss Don Siegelman with Jack Abramoff or Michael Scanlon?"
3) Artur Davis revealed that District Judge Fuller, who tried your case, was carrying on secret communications with the US Marshalls about some key emails involving jurors. Can you explain what those emails were and the significance of this revelation to your claim that you did not receive a fair trial?
The emails were mailed anonymously to defense lawyers and members of the media. They were allegedly between two jurors -- including the jury foreman. The conversations in the emails were dated during the TRIAL and not deliberation. They discussed how to get others to go for conviction. One in particular said "Gov is up shit creek." Another said "all politicians r scum." Another said "37 coming along. Keep working on 20." – referring to juror numbers. This is just a sampling.
We filed a motion and asked that the emails be investigated. The prosecution objected and the judge overruled us. We filed an additional motion asking that the servers be preserved in case the appellate court wanted to go back later and investigate. The prosecution objected to that also and the Judge overruled us again.
Now we know that after their protestations about how any investigation would destroy the sanctity of the jury process, the prosecution undertook a secret "investigation." The Judge was informed of the "results." Yet the defense was never notified. The prosecution then told Judge Fuller that the emails were fabricated while the judge was considering our motion for a new trial based on those same emails.
Judge Fuller then sat in judgment with prejudicial information in his mind that was never disclosed to the defense. The defense had no opportunity to be involved in the investigation, question anyone, or ask questions. A per se Due Process violation.
It was an outrageous breach of ethics. The government should never have conducted a secret investigation, the judge should never have been told, and above all, both the judge and the prosecutors should have immediately told us -- yet we were never told until this last week, about one year and three months after the fact.
4) You have started a web petition to get people to call on Congress to hold Rove in contempt. What's the URL for that website and what do you hope to accomplish with it?
I am asking everyone who believes that Karl Rove is not above the law, that he should obey the House subpoena or be jailed, to visit www.ContemptForRove.com and write their Members of Congress! From www.ContemptForRove.com, you can forward an email directly to your Representative and urge them to support a contempt resolution against Rove.
Karl Rove has spit in the face of Congress -- he is showing contempt for Congress and the American people. The American people deserve to know the truth about how the DOJ was used as a political tool to win elections. Only Congress has the power to find the truth.
It starts with having Karl Rove under oath before the Judiciary Committee. We the People must insist that Congress do its job and hold Rove in contempt for failing to obey the subpoena. The house of cards will start to fall soon thereafter.

To your question: That’s correct. There were several things about Rove’s answers. First, he wasn’t under oath. Second, he wasn’t referring to the correct time period — he was talking about 2005, but the sworn testimony of Simpson identified a phone conversation with Rove taking place sometime around 2002. He didn’t talk about what happened earlier. Third, he said *he* hadn’t spoken with officials, but he hadn’t said that any of his surrogates had not.

A couple of weeks ago, former US Attorney David Iglesias was here at FDL for a Book Salon chat about his book In Justice. Have you read the book, and might fired US Attorneys like Iglesias, Lam, and McKay become part of your appeal?
It strikes me that they might have some very interesting testimony to give that points to a culture at the top of the DOJ that pushed for political prosecutions. It wouldn’t be direct evidence in your case, but powerful circumstantial evidence of the mindset and motives of those at Main Justice.
Congress shows contempt for itself and the “people” in not upholding their oath of office to protect and defend the Constitution.

Are you saying that you, to this day, have not received the government’s report on this emails?
Also, are you saying that the server on which those emails were sent has not been preserved?
Do you believe that you were “spied on”…”wire-tapped”…part of the “illegal domestic spying”….as part of a plan to get info on political opponents in Rove’s attempt to create a permanent Republican majority? If so, what would make you believe that might have happened…any clues?

In 1933 democracy in Germany began to be whittled away by legislation passed in the Reichstag. There would seem to be a parallel occuring in the U.S., where, out of fear, greed and self-loathing Congress allows a lawless and depraved administration to institute a quasi-police state. Congress is a broken, dysfunctional institution.
One would be Kitty McCullough, aka Kelly Kimbrough, who was given credit by the state Republican Party for the computer glitch that resulted in my losing and my Republican opponent being declared the winner in the 2002 gubernatorial campaign.
Also, Rove’s bagman, Jack Abramoff, according to the Congressional report filed by Sen. McCain, shows that millions of dollars of Indian casino money was laundered through Alabama, utilizing Ralph Reed, Michael Scanlon, Grover Norquist, and the Christian Coalition — in an effort to defeat me and defeat my education lottery proposal, which would have sent all of Alabama’s schoolchildren to college for free.

I believe they have spied on ALL our lawmakers, democrats for sure but probably more so republicans, whenever there was a bill too close to call I am certain they spied on republicans to insure the proper vote and to pressure them if they found out otherwise

I have followed you case closely and it is my belief that when it is all said and done your case will be the thing that finally brings Karl Rove down. I agree. I’d like to know if anything strange has come up that points to direct evidence of that…i.e., something coming out from “them” that they could not possibly have known about without having “listened” in…that sort of thing. Something to nail them with as evidence that they have indeed been spying on political opponents. We need to find something concrete.

I do not beleive there is any way to “compel” rove to testify, he simply won’t show up, the justice dept will do nothing about that and the democrats will simply raise their eybrows

I understand the limit to trial-court testimony during the appeal itself. Should the appeals court order a new trial, however . . .
Something to keep in mind.
You raise an interesting point that I tried to make on MSNBC with Dan Abrams last night, and that is, if anybody needed proof that my prosecution was political, all they need to do is read Time Magazine’s expose on selective prosecution (October 15), where they make the point that the government’s own key witness identified high-level Republicans engaged in criminal activity. The federal investigators told the witness that they didn’t believe him when it came to the Republicans, so why did they believe him when it came to me, the Democrat?
While Time Magazine covered this story, the Alabama media has largely ignored it. The American people, including the American mainstream press, seem not to want to believe that a President would lead us into a war that we didn’t need to fight, or that elections in America are stolen, or that innocent people are prosecuted for political purposes. These things are so un-American that the traditional media, for the most part, simply don’t want to “go there.”

Governor, everyone focuses on Rove, and granted for good reason, but I am also interested in the judicial structure that has factored into your ordeal. At both the Federal and state level. To the extent you feel comfortable, would you please discuss the role that judges have played and what their motivations are, or may have been? I perceive all kinds of issues, from evidentiary dismiss motion rulings, trial conduct, sentencing and release conditions. Also, would you comment on the strange and, to the best of my knowledge, unheard of delay in transcript production? Modern court reporting equipment utilizes computer transcription programs that are generally 98% accurate, give or take; a substitute reporter could have done the corrections and had those out in a week. What happened?
To address the known and unknown [and the known unknown] crimes and excesses of the Bush administration — including your prosecution by two USA’s in Alabama — bloggers have long discussed the need for some form of Truth and Reconciliation Commission.
Others are now taking up that call. Some of them propose that such a Commission only “document” problems, that it have no power to fix or recommend fixes to the correct officials or Congress. That suggests an intent to hinder also its powers to verify and document the record — ie, through compelling testimony and the production of documents — which would likely be extraordinarily embarrassing to state and national GOP figures.
In other words, it could be used to obscure and whitewash the record rather than clarify it. Less subtle critics of the idea demand that we “do nothing”, while others hold out for routine or special prosecutions.
Do you think such a Commission a good idea? What powers ought it to have and what kind of person should serve on it? Would you serve on it and, if so, why?

I’m not sure if you followed the case againt Geoffrey Fieger here in MI. The jury acquitted him of all charges, largely through the good work of Gerry Spence.
But before that, he came very close to making the case for selective prosecution, close enough that the judge in the case had his doubts. However, because the government could claim that the allegations against Fieger “came in through the front door”–a disgruntled former Fieger employee brought his allegations to the FBI, then went on to having a Republican lawyer represent him in a belated case of wrongful termination against Fieger–the prosecutors ultimately convinced the judge that the demonstrated involvement of several of Fieger’s old Republican nemeses was not relevant to the case.
Is it possible something similar happened here–that the state level folks dug up dirt on you, and then someone seemingly independent brought that dirt to DOJ so they could claim the dirt was not directly tracked to Riley and Canary and Rove? Michael Mukasey seems to have suggested something like this happened when he testified before SJC earlier this month.
First, the government’s report on the emails was contrary to the judge’s order, in violation of the canons of ethics, and on top of that was a bogus investigation.
The judge had specifically ordered that no such investigation take place, yet the government — behind our backs — conducted an investigation, and then had the US Marshalls whisper in the judge’s ear that the emails were fake.
This was all at a time that we had motions pending before the judge for a new trial, based on the validity of the emails. The real violation here was that neither the judge nor the prosecutors told us what was going on behind our backs.
A motion was filed to protect the servers in case the appellate court, at a later date, wanted to do a fuller investigation. That motion was denied. The servers were not preserved, under a specific order by the court that they not be preserved.

Not any longer. Immediately upon my release from prison, contrary to the orders from the 11th Circuit Court of Appeals, I was specified as a “special prisoner,” meaning I was treated like a member of the mafia or a suspected terrorist.
Thanks in no small to part to Thom Harmann of Air America and bloggers, this decision was quickly reversed, and now I have a much more lenient test to meet when I wish to travel.

Can you explain why the investigation was bogus. And who was in charge of executing the bogus search? USPS? USMS?
And of course it goes without saying that the US Postal Service (which Muksaey referred to yesterday) is not part of DOJ–another area of the government that Rove’s denials do not extend to.
I think that there is a natural tendency to want to put things off, and I think that some Members of Congress are perhaps afraid that by holding Karl Rove accountable before the election, it will somehow be a distraction from the presidential election.
I don’t see it that way. We can’t afford to wait. Time is of the essence. That’s why it’s so important that you write Congress and urge them to hold Karl Rove in contempt.

One reason I ask you about a Truth and Reconciliation Commission, Governor, is that an obvious step from such a Commission would be to recommend a series of Presidential pardons. In effect, via a new subset of the pardon process designed to deal with this administration’s abuses.
The purpose would be to promptly free others convicted of federal crimes by this administration’s political prosecutors, but who haven’t your prominence or resources.
That would allow other aspects of the process of “clarifying the record” to proceed at a normal bureaucratic pace, predictably encumbered by the intense political opposition, footdragging and stonewalling that this administration has perfected.
All of the above, plus, after my re-election, I was intending to hold the Bush Administration accountable for its policy in Iraq, as well as its failed economic and education policies. Having been a former Secretary of State, Attorney General, Lt. Gov, and Governor, I was planning on using my contacts in key electoral states to hammer this Administration on its failed policies.
My indictment came on the day I was leaving on my first fundraising effort, flying to New York to meet President Clinton to raise money for Democrats running for Governor.

OPR only recently asked your for evidence of misconduct in your trial. Were you able to provide them with information they had not looked at previously? In your interactions with them, were you able to get a sense of how seriously the OPR investigation into your case is?
It would not matter what information was dug up on the local level. It took someone at a high level in DOJ, or in the Administration, to pull the trigger on the case.
There’s been testimony that this decision to prosecute came at a level higher than criminal division in the DOJ. We know it started with Karl Rove’s client, and the wife of Karl Rove’s political associate in Alabama, but the trigger was pulled by someone above the level of criminal division in DOJ.
All roads lead to Rove.

holding rove in contempt means nothing, he will site and the president will grant “executive priviledge”, whether or not it applies does not matter
congress needs to do much more then hold this man in contempt, they absolutely must jail him for inherant contempt and keep him there until he testifies

We’ve had a lot of support from smaller local newspapers, but the Newhouse chain (which reaches the majority of Alabama citizens) has always been highly Republican and highly political.
Yes, I’ve spoken with Rep. Artur Davis. He has been a real hero on this issue, a strong voice on the House Judiciary Committee. He, Chairman Conyers, Congressman Wexler, and Congresswomen Sanchez, Baldwin, and Wasserman-Shultz all deserve a real pat on the back.

Yes, I noticed that Rove made no mention of the Andrew Lourie comment to Schrushy’s lawyer in his “answers.”
The only reason I asked about the “going in through the front door” is to establish a pattern. The Fieger investigation started under and with the approval of Noel Hillman and he, along with the local Republicans who had been gunning for Fieger, were never asked to testify about their involvement.
To the best of your knowledge, no one has ever asked Lourie what happened, have they? Do you think OPR has?

this president has ignored all of our law, when we pass law he claims he is above it, when he is discovered to break our law he gets congress to write new law that allows it, when his corporate pals are discovered stealing our intelectual property he gets congress to write law that makes that theft legal
he is above the law, there is no law, he is beyond law
congress has no power unless they use their power and they refuse
a new president, even a democrat, will mean nothing if these criminals are not brought to the bar of justice, their crimes must be exposed, their decisions must be rebuked and they must be written for history as a pox on this nation

Pardon me for my OT and may i say thank you to Jane and Marcy. Governor Siegelman is my hero.
Arriving too late to participate, but I want to raise one more time something I have raised every time I have the opportunity. Everyone makes such a big deal of “under oath” but why would we believe that Rove would be truthful under oath. His behavior says clearly that an oath would be meaningless. The only advantage would be the ability to clearly prove perjury, and I understand (IANAL) that’s not an easy thing to do in the best of circumstances.
I cannot imagine how frustrated I would be with how slowly congress moves, if at all, to do anything about the myriad injustices the Lawless Branch has committed. If I were more personally involved like Gov. Siegelman, I don’t know if I could be as strong.
I’m frustrated now as a citizen, but I’d lose it if I was waiting for a hearing on whether or not to hold in contempt the bastard who cheated me out of my job and took away my liberty. Much grinding of teeth and renting of garments here.
