God, I hope so. A difference in degree, but not a difference in kind.

1) obama is supposed to know his constitutional law. if he was not a lawyer, i would be more likely to think he had been led astray. as it is, i have to think that obama’s actions (re fisa for example) reflect his own position and not just the bad advice he’s gotten.

2) are you sure that sunstein doesn’t agree with yoo? sure sounds to me like he very well might.

Regarding #2, of course, I can not be sure of anything in another’s mind. The law faculty I’ve spoken with are appalled at Yoo. I suspect that opinion extends to Harvard.

Regarding #1, Obama is now possibly the busiest, most hassled man on the planet. He has to delegate nearly everything. I grant that for a lecturer on constitutional law, HR6304 should have been a no-brainer in the other direction from where he went. If Obama is an out-and-out fascist, I’m fucked and there’s nothing I can do about it. So, the only alternative worthy of discussion is that he is not.

So, let’s assume that he is way busy and trusts his colleague, the most cited law professor in the world. I see two obvious and not necessarily mutually exclusive strategies: we could attempt to A) discredit Cass Sunstein’s views and/or to B) change his mind. If he’s intellectually honest, A would lead to B.

IMHO, Glenn is ready to go on A. The stuff that Sunstein said in that Amy Goodman interview was IMHO outrageously simplistic and misinformed.
