The main culprit for the decline are the new numbers out of Ohio, where Rasmussen shows John McCain jumping into a 10-point lead. We have already discussed this particular poll at length. Are the changes caused by differences in measuring party identification? No, not really. Rasmussen assumes a slightly redder electorate than other pollsters, but Obama’s numbers had declined among Democrats, Republicans, and independents alike. Could there be problems related to the sampling of young voters in this survey, who went surprisingly strongly for McCain? That is a more viable explanation. But it still would not account for the entirety of the decline.

There is also new polling out from American Research Group, which has Florida and New Hampshire moving in John McCain’s direction. In Florida, Obama now trails by 2 after having led by 5 points, and in New Hampshire, he leads by 2 after having led by 12.

I think courts are well equipped to unravel this type of legal factual minutia and get to a just result. Immunity from the law is something to be dolled out sparingly.

That poll is a fluke in Ohio. Every other one shows Obama ahead. Including Quinnipiac.

I believe that Blackwater violates the intent of the 2nd Amendment which declares “a well-regulated militia as being necessary to the security of a free State.” Blackwater, and the almost 200 other organizations like them are almost completely UNregulated. The military code does not apply to them, which is highly problematic. Additionally, I do not believe it is in the best interests of the US tax payers to have to pay these contractors. Organizations like Blackwater are driving up our defense costs. US tax payers pay for the training of military experts, like SEALS. The cost of such training is in the hundreds of thousands of dollars. After completing this training, they receive military pay. Unfortunately, Blackwater type organizations can pay up to $1500 per day as compared to $1500 per week and we lose many as soon as they are able. This hurts the US tax payer even more because now the military has to pay exorbitant re-enlistment bonuses to try to keep them. Then who ends up paying them their new large contract salaries? The US tax payers again.

I remember that TV series about the 60’s, with the girl who danced on some TV show. They had Nick Lashay portraying Tom Jones, even let him sing. It was so fucking wrong on so many levels. Nick Lashay sounded like a little kid doing a bad imitation. Way too high a voice for that.

Bourbon Street Pecan Spice Cookies

¾ cup butter, softened
2 cups Chef Paul Prudhomme’s Sweetie Magic™
1 teaspoon Chef Paul Prudhomme’s Ancho Chile
1 whole egg
2 tablespoons cane syrup
2 teaspoons baking soda
3¼ cups all-purpose flour
½ cup currants
½ cup roasted pecans, coarsely chopped
1 tablespoon minced fresh ginger
1 tablespoon orange zest

Place the butter in a kitchen mixer fitted with a whisk attachment. Process the butter at medium speed and gradually add the Sweetie Magic and Ancho Chile. When the mixture is light colored and fluffy, add the egg and cane syrup. Continue to process at medium speed until the ingredients are well mixed. Add the baking soda. Reduce the speed to low and gradually add the flour. When the flour is fully mixed in, add the currants, pecans, ginger and orange zest. Process until the ingredients are mixed in, then remove the cookie dough from the mixer.

Cover and refrigerate the cookie dough until cold, 2 – 3 hours.

Preheat the oven to 350°.

Roll pieces of the dough into 2-inch balls and place about 3 inches apart on an ungreased baking sheets. Bake the cookies at 350° for 20-25 minutes, or until have spread, but are still soft to the touch. Remove the cookies from the oven and place on a sheet pan or wire rack to cool.

Hi Selise. Totally off topic, I agree with your comment downstairs regarding Barak and Cass Sunstein. Barak must take full responsibility for his positions and for his advisers.

That said, however, I think it is useful to us who would like to influence his presidential decisions to understand the forces that he is under and that surround him. The question is how best to leverage the situation. Sunstein for example is a scholar who cares about his scholarly reputation. He’s probably the house liberal in a very conservative department. But no way in hell would he like to be put in the same bin as John Yoo. That fact can be leveraged.

1) obama is supposed to know his constitutional law. if he was not a lawyer, i would be more likely to think he had been led astray. as it is, i have to think that obama’s actions (re fisa for example) reflect his own position and not just the bad advice he’s gotten.

2) are you sure that sunstein doesn’t agree with yoo? sure sounds to me like he very well might.

The government administrative law professor that debated for no impeachment or punishment at the Netroots was an idiot in my book. He was the tall guy losing his hair. The audience disagreed with him while one of the panelist jumped all overover him and the Busgco and congress for taking Impeachment of off the table.

Regarding #2, of course, I can not be sure of anything in another’s mind. The law faculty I’ve spoken with are appalled at Yoo. I suspect that opinion extends to Harvard.

Regarding #1, Obama is now possibly the busiest, most hassled man on the planet. He has to delegate nearly everything. I grant that for a lecturer on constitutional law, HR6304 should have been a no-brainer in the other direction from where he went. If Obama is an out-and-out fascist, I’m fucked and there’s nothing I can do about it. So, the only alternative worthy of discussion is that he is not.

So, let’s assume that he is way busy and trusts his colleague, the most cited law professor in the world. I see two obvious and not necessarily mutually exclusive strategies: we could attempt to A) discredit Cass Sunstein’s views and/or to B) change his mind. If he’s intellectually honest, A would lead to B.

IMHO, Glenn is ready to go on A. The stuff that Sunstein said in that Amy Goodman interview was IMHO outrageously simplistic and misinformed.
