I’m sure this will draw no media coverage — given the outrage that is questioning John McCain’s ability to be President — how dare the Democrats!
But this sure seems like the kind of bullcrap that we really don’t want from an Administration — even though it is considered huggable by McCain:
In the first case to review the government’s secret evidence for holding a detainee at Guantánamo Bay, Cuba, a federal appeals court found that accusations against a Muslim from western China held for more than six years were based on bare and unverifiable claims. The unclassified parts of the decision were released on Monday.
With some derision for the Bush administration’s arguments, a three-judge panel said the government contended that its accusations against the detainee should be accepted as true because they had been repeated in at least three secret documents.
The court compared that to the absurd declaration of a character in the Lewis Carroll poem “The Hunting of the Snark”: “I have said it thrice: What I tell you three times is true.”
“This comes perilously close to suggesting that whatever the government says must be treated as true,” said the panel of the Court of Appeals for the District of Columbia Circuit.
The unanimous panel overturned as invalid a Pentagon determination that the detainee, Huzaifa Parhat, a member of the ethnic Uighur Muslim minority in western China, was properly held as an enemy combatant.
The panel included one of the court’s most conservative members, the chief judge, David B. Sentelle.

the Uighur (or Uyghurs) are a less known, but no less repressed culture within China, located in a territory with the rather awkward "Mao-tastic" name of the "Xinjiang Uygur Autonomous Region" [which in fairness may just be chinese for "South Dakota"] in the far west of the country and bordering Afghanistan amongst other places. It is in Afghanistan where these individuals were swept up by American forces [along with many others who were not terrorists, but bounty-victims of various warlords taking advantage of American gullibility].
Some of these individuals were tortured and we knew that would happen in advance and helped:

And who is this gentlemen and what plight have we put him in?
Although the decision was a defeat for the Bush administration, it was unclear what it might mean immediately for Mr. Parhat, a former fruit peddler who in recent years sent a message to his wife that she should remarry because his imprisonment at Guantánamo was like already being dead.
American officials have said that they cannot return Mr. Parhat and 16 other Uighur detainees at Guantánamo to China for fear of mistreatment and that some 100 other countries have refused to accept them.
And I guess we would know that because we tortured the poor saps.
Yet, if John McCain had his way, people like Parhat could sit in GITMO and die — disappearing quietly and without notice in the shadows — just like the classic nightmare dictatorship he does not give a crap. George Orwell would recognize the world McCain wants to perpetuate.
Not that this ever gets mentioned by those reporters competing to sit up front with him next to the "Captain’s Chair".

Same reaction as mine. He used to be a conservative (John Connoly, Lloyd Bentson) Democrat and then fell in with Bush and Texas Rangers. I had noted that Bob Schieffer supported the Iraq invasion, but otherwise didn’t realize the extent of the ties.
I have a feeling that Clark is going to hammer this every chance he gets. I would. I’m not a big fan of his but in this I’m with him all the way.
No truth to that story! McCain had nothing to do with the fire on Forrestal. He was simply in the wrong place at the wrong time and lucky he didn’t get snuffed by that rouge rocket. He was lucky to get out of that sucker before it blew. Heavy loss of life on FORRESTAL. On HOPEWELL (DD-681) we were doing gunfire support off the coast so weren’t with the Yankee Station task force. Caught all the traffic on the radio, though.

Unlike some here I like Clark. I’ve met him and discussed various issues, education…corporate boards and their efficacy, and I believe our nation would be better off if we had a lot more like him and a lot less like Bush and McSame. Geez – I really didn’t make myself clear at all. I was talking about the demonstrators being fed up, had enough and nothing was going to stop them from protesting. If we had that kind of anger now, we wouldn’t be where we are today. The Dems are not going to believe how angry we are until we show them in some way.
Clark was 110% correct. Military experience (particularly from an aircraft) in no way magically qualifies one to be a president (or Dictator as it has now become…oh wait, ALL it takes to be a dictator is military experience!).
Bailing out of an aircraft is not of any value whatsoever in building leadership qualities or social/civil feelings of responsibility. Being shot at in an aircraft has nothing to do with anything except being shot at in an aircraft (or in a foxhole, for that matter).
As a flyboy (air force) I can and do say that the WORST persons to be in charge of the country and the military are flyboys. The Air Force is by far the worst in this regard but it also applies to the flying wings of the Navy – aircrews are in a special, privileged position: they rarely take fire (especially these days) and EVERYTHING they do from firing their guns to dropping bombs is totally, 100% impersonal and disconnected from anything.
I was in B-52s. You know what being shot at feels like in a B-52? A little adrenaline rushy but other than that highly abstract. You sit there and wait to see if something is going to happen. You know what it feels like to drop tons of bombs on a target? Like pretty much nothing. You feel a slight vibration in the airframe as a button is pushed (as backup to a computer in modern times) over a coordinate on a map.
Then you turn and fly away.
Totally impersonal, disconnected, theoretical, and video-game-like. It is SLIGHTLY different in a fighter/bomber but not by much.
There is a reason why the fliers (particularly the Air Force) are so eager to blow things up: there is little cost emotionally or physically to fliers. It it 500% different than the ground pounder in the dirt with bullets, mortar round, grenades, rockets, etc, flying back and forth and landing amongst you. It is totally different than being within actual personal visual range of your target. No comparison AT ALL.
Fliers see war as a rather tidy, antiseptic, easy endeavor while grunts see it as their ass. People from the air, if you see them at all, look like specks or ants. Sometimes they are just coordinates of a building or copse of trees. Push your button and VOOM! The rocks bounce at those coordinates, the building caves in, or the trees blow to shreds and that’s it.
You cannot trust fliers to be CinC. They think war is simple, fast, easy, clean. They think nothing of dropping tons and tons of munitions on targets. They don’t give a fig that they create the most civilian casualties of any other form of attack. McCain is like that…and he was a flier.
Maybe a million plus in the streets of Denver will give them some idea.

However you may disagree with him I think you need to remember that he is a black man who is the Democratic Party nominee for President of the United States in a country where racism runs wide and deep. For me as an EWO (Electronic Warfare Officer) on the B-52, an attack on the plane consisted of blips on a radar detection/analysis screen. That and a warning buzzer for missile guidance detection (meaning one was on the way). No windows. Beeps, blips and pops on audio and scratches/fingers on a very fancy oscilliscope-type screen. AAA may or may not have “sound” associated with it – if it was radar-guided, I’d hear it. Other than that, it is flashes of light in the sky if it is dark or puffs of smoke if day.
You sit there with your hands, if not otherwise occupied, ready to jump to the ejection seat triggers and pop you out into the noise and screaming air. No explosion sounds inside the plane – it makes too much noise itself to hear any nearby exploding AAA or even a missile. If you take a hit, it may or may not be a big, sudden shake/vibration in the plane. The only ones with any eyes outside that might SEE a hit come in is the pilots. Again, it is nonetheless very dissociative, antiseptic, and impersonal (except in your own thoughts). It was also rather a rare occurrence. Most of the time the flight is straight forward and unremarkable.

I was a two-timer: I supported Dodd and Edwards in the primaries. After they fell out, I didn’t give a crap who won…but disfavored Hillary slightly more than Obama (because of DLC shit, and the seeming attitude that it was somehow “owed” to the Clintons – that the Party was theirs and it was her turn).
Now, I almost wish Hillary were the winner. At least her healthcare proposal was MUCH better than Obama’s.
She has balls no dought about it…however she sleeps with the enemy, very untrustworthy and it’s too bad for the future of Old Dem Party.

I must admit that I find the amount of invective I see being thrown at Obama disturbing. There is no way he even comes close to being as dangerous as McCain, yet some would like to paint him as the great satan.
Wrong! While I’m at it I see the same invective being thrown at Pelosi, Reid, and fill in the name of any other member of congress here _________ who doesn’t live up to our personal definition of the perfect progressive.
I’ve got news for you folks, no one is going to live up to these kind of expectations 100% of the time. While holding their feet to the fire, we better be damn sure we don’t burn them, ourselves, and our country all in one big egotistical swoop.
As for me, I’m ready to kick some ass, and it ain’t Democratic ass. It’s Republic ass. I will vote for Obama, and feel quite good about doing so.

I’m only about half way thru the comments, and there’s a new post up already, so I’ll just ask: I thought some of the uighurs had already been released in another country, although I can’t remember which one. I know that three had already been adjudicated and proved not guilty over a year ago, perhaps as much as two years ago, and were still returned to their cells and chained to the floor of their cells (you would have thought that we’d have at least had the decency to give them better accommodations and no longer chain them to their cells. We could have at least tried to make innocent people more comfortable and supply them with a way to contact their loved ones!) But ultimately I thought they found at least the first three a country that would take them. I also have questions about how or if they get reunited with their families. I find what we’ve done to these people unacceptable and inexcusable.

I loved the DC Circuits ruling. I’m hoping that this ruling, that even had the very conservative Judge Sentelle joining it, will encourage more of the Bush rats to desert their sinking ship in an effort to cover their own butts by spilling the beans about other Bush lawbreaking to the Press.
