		<description>&lt;p&gt;Because Feingold is under the FALSE impression that “advise and consent” of the Senate means that the senate can express an &lt;i&gt;opinion&lt;/i&gt; (advise) but MUST consent - that “consent” is a command of what they must do rather than what the President must seek.&lt;/p&gt;

		<description>&lt;p&gt;That Scalia court opinion has been the outrage beyond outrages for me personally over the past few days.  Court opinions from historically the most dignified branch of government should never, NEVER use the type of scare-tactic rhetoric of the worst of the right-wing blogosphere.  They should be detailed, thoughtful, and often dry explanations of previous case law that only a trained lawyer could fully understand.  But there is his dissent, in the same Supereme Court tomes of Brown v. Board, Loving v. Virginia (is that the right state?), and Rove v. Wade.  Bonus points to Judge Roberts for adopting a different blogger style, in the form of the Duncan Hunteresque praise of how these detainees have never had it better when it comes to their human rights.&lt;/p&gt;
&lt;p&gt;I realized hearing some NPR reports on the youth vote that there are voting-age people that have lived their entire teenage and adult lives under this Bush-world, where government leadership and media elites do not debate policy in an intelligent way, but rather deploy depressingly crude arguments and posturing strategies to stake out their views.  I do remember pre-2000 (no golden age) when President’s were articulate, Legal scholarship was above politics, and media types dissected political rhetoric based on some laying out of the facts at hand.  Now, to a younger generation (even though I’m 27), government and the institutions that are supposed to hold it accountable have been debased to the point where “Bring It On”, “Suck On This” and “[this opinion] will almost certainly cause more Americans to be killed” are positions in policy debate and formulation.  They have to be legitimate, because the premier executive, judges, and journalists in this country have made them and have not been laughed out of their positions of power.&lt;/p&gt;
&lt;p&gt;I can’t imagine how teenagers can sit through a basic High School Civics course these days without snickering uncontrollably.  What Obama will do this country after these 8 years at this basic level almost makes me forget his shortcomings.&lt;/p&gt;</description>
