They’re going to enact massive changes to our spying laws without having the slightest idea what they’re voting on. All they know is that the President demanded this, and that’s enough, because — as Kit Bond says — "when the government tells you to do something, I’m sure you would all agree that I think you all recognize that is something you need to do." In this formulation, "the government" means "The President."

UPDATE: The vote tally on this is not yet up on the House website. But I’ve confirmed the numbers that the total votes was as follows: 293 yes -129 no. Also that the majority of the House Dems voted no – 105 voted yes, 128 voted no. As soon as there is a full vote tally, will get a direct link up and running for everyone.

I just used the BarackObama.com feedback page to inform them that I will make a significant donation to the Obama campaign if Obama acts to defeat the FISA bill in the Senate — as I donated to the Dodd campaign after Dodd’s filibuster in the fall — and that I will not make any donation if he does not act.
It’s within Obama’s power to engineer the defeat of this bill, an doing so would show the kind of leader he can be in the White House.

Only 12 percent of Americans now have confidence in Congress, the lowest percentage in the 35 years that the Gallup Poll has tracked the number.
Americans now view Congress less favorably any of the 14 other American institutions tracked by Gallup, including big business, newspapers and health maintenance organizations.
Even as President Bush’s approval rating languishes at a record low, more than twice as many Americans have confidence in the presidency—26 percent—than have confidence in Congress.
And Pelosi and Hoyer wonder why?
This bill could have been passed in a much better way. They could have consulted, given plenty of warning, circulated the bill for weeks, let others than telecoms comment, then had the leadership go out and educate voters in whatever districts it is they think could have been threatened by a good bill; then scheduled plenty of debate in the House and scheduled it in a time they didn’t know was going to already be a media zoo.
Maybe we would have still lost, but there would have been something resembling a deliberative process, and even some token leadership.
The way this was done was simply a “F* you” to us. I submit we should consider ourselves duly “F*’ed”.

The spokeperson for the FBI, Ryan “Something” (can’t rememebr last name, I’ll find it) specifically addressed this and said the FBI did not have evidence that Osama was responsible for 9/11.
I spoke with Elizabeth de la Vega (”U.S. v. Bush”, great book) about this and suggested she write another book, addressing this issue.
The roll call vote is not up yet, but when it is, it should be Roll Call 437 on Thomas.
As has been pointed out, nays from say, Pelosi or Hoyer are meaningless. They engineered this.

There’s usually a delay between a roll call and when it appears on the register. Going from memory here, but it usually takes a half hour or so. Here’s the page to watch. The new votes appear at the top.
“It’s not the crime, it’s the coverup.” I suspect that the reason this went down so fast is that the Dems as well as the Thugs were petrified at what would be revealed if the Telecomm lawsuits went forward. Such as the major condoning of 4th Amendment violations by muckymucks in both parties.

The ramifications of the bill not being “mentioned” in the Senate today is that first mention will happen on Monday, when Senator Reid asks UC to take up FISA. The UC would probably be, “UC to take up FISA when the Senate completes action on the Housing Bailout,” which is a somewhat indefinite time. If there is objection to that, Reid can file a cloture motion to limit debate on the motion to take up FISA. If he files that on Monday, the cloture vote to limit debate on the motion to proceed would be Wednesday morning, and the 30 hours of post-cloture debate running out Thursday afternoon.
Then, someone (probably REID) would seek UC to vote on passage. Objection can be asserted against that, too.
I’ve frequently seen parallel cloture motions (on an amendment and final passage), but there can’t be a paralleling of “motion to proceed” and “final passage,” because theoretically, the motion to proceed can be rejected, so there is no pending matter (amendment or bill) that could be subjected to a vote.

With House passage on a 2:1 margin, there will be token opposition in the Senate. One vote with a 60 vote margin, no filibuster, etc.

Obama will object with a speech, but he will not raise a formal objection or otherwise assert any procedural power (which he has a RIGHT to assert, as a Senator) that would delay final passage. He will point to his speech, and tell the public, “I objected.”

Hello everyone: I am sad, but not surprised to report, that my rep. Brian Baird–Bush Dog party–voted for this bill. My husband called his office after the vote to register his disgust and ask why he voted the way he did, and the reply was basically that he was afraid of lawsuits that would ensue against companies–obviously that’s not a word-for-word quote, but the gist. His staffer said he would release a statement shortly on his official website.
There is a woman who is running against him in the primary. Her name is Cheryl Crist–every Democrat in the 3rd district needs to be supporting her. At the recent Dem. convention of course Baird was renominated to his position, so I don’t even know if her name will show up on the primary ballot, but my thought is to just write her in. The local party leaders are afraid to lose Baird’s seat to a Republican, so they are not going after Baird. I don’t know if this FISA vote will change their minds–I sure hope so.

I think folks on the left need to get over the whole tin-foil-troofer-eww thing and look hard at the events which have brought us to this point.
The self-hurt imposed on himself by the original Judas required knowledge, acceptance and remorse. Of those, Pelosi, Hoyer (and presumably, Reid, after the Senate vote) have only one. They knowingly intended this outcome, and manufactured a careful facade to hide their leadership and hard work, which yielded today’s lopsided vote to gut the Constitution and public accountability for the chief executive officer of the United States Government.
One good thing about Scott McClellan’s experience is that he doesn’t give an inch to the Goopers trying to slam his integrity. Admittedly, he seems to have come to that as late in life as Nixon’s Charles Colson came to religion. But what he’s now saying seems consistent with much of what we’ve heard and suspected about how this White House operates. Haynes testimony earlier equally refused to give an inch to his questioners. But he was hiding his own and others’ past bad acts to avoid accountability. Mr. McClellan seems, in part, to be inviting it.
That happened when Bush declared himself “Commander in Chief” without qualifiers…and when he declared himself “The Decider”.
I got waylaid by all this–now I gotta go outside and continue planting tomatoes, eggplant and peppers. 83 degrees and warm here today.
Perhaps the Senate will uphold the 4th amendment.
Selise’s list is about the vote in February on the PAA. At that point, the Republicans were playing games and decided to vote against a 21 extension of the Protect America Act. To everyone’s surprise, they were joined by a group of mostly progressive Democrats and the extension failed and the act expired.
What the House voted on today was to re-instate most of the PAA. Those who voted against the PAA in February and today we can safely say voted their conviction. All others who voted No today we don’t know and could well be engaged in CYA. I should note that several of the names on selise’s list voted for the bill today.
But there’s no need to hide his bad acts. This Congress it 100% compromised and there is no accountability anywhere for anything to be had. They could admit to everything they’ve done in violation of the Constitution, federal and international law and nothing, literally, would come of it (except perhaps a “sigh” of disbelief and the shake of a head or two).

The basic FISA framework has a lot good about it. Several “improvements” to FISA in PAA and some in the FISA Amendments Act of 2008 have been in violation of the Constitution.

Hell, on C-Span during the vote, I didn’t hear anyone calling express anything but horror in the first several calls…callers who were Republicans, Indies and Democrats. Simply unconscionable that the House could backtrack like this.

I think there is a mistaken view that we are their constituents. The truth is their constituents are corporations, the wealthy, the connected, and each other. If you look at it this way, things sharpen up and come into focus fast.
