FISA vote could come as early as this evening. No one outside Hoyer, Bond, Rockefeller, WH negotiators and a select few staffers and lobbyist pals have seen the bill.
That includes exclusion of the House and Senate Judiciary Committee, including Leahy and Conyers, who have been rendered utterly impotent on this issue by their own lack of pushback.
The folks who want to work on this can't get their hands on whatever WH/lobbyist-crafted monstrosity is being held close to the vest. I've been on the phone and IM-ing with a number of staffers this morning -- people who work for legislators who have been working their butts off to protect civil liberties and to ensure that anything crafted abides by the law and protects American national security as well.
None of them -- not one -- have been given any opportunity to even view a summary of this proposed bill. Worse, there is a rumor that the FISA mess may be folded into the Iraq funding bill in the House due to machinations by Steny. Just great.

Just consider this Reuters article from yesterday in which anonymous officials decree to us that it's now a fait accompli that the Democratic Congress will enact the FISA/amnesty bill -- an article which the commenter pow wow describes as "carefully-planted PR in the government-mouthpiece media -- anonymously reminding the peons that resistance is futile; the game is up":
U.S. phone companies would be shielded from potentially billions of dollars in lawsuits under an anti-terror spy measure that appears headed toward approval, congressional sources said on Wednesday. . . . .
Democratic and Republican aides and a lobbyist familiar with negotiations said the House would likely approve the measure overwhelmingly. Despite opposition from its top two Democrats, the Senate would then likely give it final approval, clearing the way for President George W. Bush to sign it into law. . . ..
The proposed compromise would allow a federal district court to dismiss a suit if the company was provided written assurances that Bush authorized their participation in the spy program and that it was legal, sources said.
The telecom amnesty bill is something that has been engineered by telecom lobbyists from start to finish, while Bush officials engineer the part of the bill to provide full-scale warrantless eavesdropping powers. While the ACLU and other grass-roots groups have been shut out of the negotiation over this bill almost completely -- it's been conducted, like most important government processes, totally in the dark -- telecom lobbyists are not only fully informed about what is going on but have been participating directly in the negotiations. Along with Bush officials, it's the telecoms' lobbyists who are "negotiating" with Congress over how to write the law providing for their own amnesty from breaking the laws passed by Congress.
This is everything Obama claims so vehemently to oppose, claims he wants to end. And yet the Congress under the control of his party is about to enact a radical bill to legalize vast new warrantless eavesdropping powers and immunize telecoms who broke our country's laws for years....

One thing bugging me is that we do not have the Hoyer draft and neither do reporters; and yet some reporters are believing every single word Hoyer says. Feingold, Leahy, Conyers do not have the draft; the only people who do have it are Rockefeller, Bond, and Hoyer. People who are for the proposal. And yet I have not yet heard anyone question why that is. No sunshine and no one demanding to see the details.
Plus, even if leadership will vote with us, and act like they are on our side, the truth is they control the calendar. Nothing happens unless they want it to. It is so cynical and calculating. And it seems that the unwritten story is that this whole FISA cave in is really all about the DCCC and their worries about freshmen dems getting re-elected. They are not afraid of terrorists -- they are afraid of ads about terrorists. If they were really afraid of terrorists they would just extend the orders. But all they really want is to reward the big telco contributors and get more checks for their campaign coffers. It is all political.

Congress people like Hoyer, Reid, Pelosi, Leahy, Conyers know something that the “people” have yet to realize. Representative democracy is only for corporations, not for the people. It’s all smoke and mirrors or grandstanding for the cameras. They know exactly how the “people” feel about this issue! They’ve been faxed, emailed, telephoned, snail mailed, etc. and what do they do? Just what the Bush Ad. and the telecoms want. Representatives indeed!
Are there some Congresspeople whom it would be strategically efficient to target with calls? I’m calling my Minnesota representatives, who else would be good?

i just called my representative’s office - jim mcgovern (who is vice chair of the rules committee). i wanted to give an aide a piece of my mind for the rules committee’s action yesterday to facilitate the war spending bill yesterday (as well as to ask that he not do the same thing today) but i was told there was no one for me to talk with except an intern who didn’t know what i was talking about. i was told to call back later.
This is a touchstone for Obama. He’d better get his ass in gear PRONTO. Combined with the return of Big Oil to Iraq, a gold mine bought with the blood of millions, I’m just about back to eschewing politics altogether in favor of growing my own food and waiting for the asteroid.

So far it’s showing up as time TBA. I’ve got a coupla feelers out to see if I can get an advanced heads up when a time gets set — but nothing back on that thus far.

Thank you for expressing your views on the National Security Agency’s warrantless surveillance program.
In December of 2005, it was first reported that President Bush had authorized the NSA to monitor communication between U.S. citizens and terrorist suspects outside the United States without first obtaining a warrant. Serious questions arose about the legality of this program and its compliance with the Foreign Intelligence Surveillance Act of 1978 (FISA).
Congress recently passed revisions to FISA expanding the authority of the Attorney General and the Director of National Intelligence to conduct surveillance of foreign targets. Under this legislation, which I opposed, the administration is permitted to conduct surveillance on individuals overseas, including American citizens, without a warrant. Upon initiation of surveillance, the administration must submit information to the FISA court on the measures used to select targets; however, the court’s review is limited to determining whether the government followed its own procedures. In addition, the bill provides retroactive immunity from civil liability for those telecommunications companies that participated in the unauthorized wiretapping program.
While I agree that developments in technology may require some modifications in our intelligence laws, this legislation overreaches and infringes dangerously on the basic rights of American citizens, while removing their right to seek legal recourse. The United States needs to ensure that its citizens are safe and secure, but the administration has provided little evidence to demonstrate the effectiveness of the surveillance program and the necessity for such an assault on our civil liberties.
It’s in the portion of bmaz’s post quoted above — but it’s re: the Iraq bill, not the FISA bill individually. It’s a “new action” without any particular tag on it to what it pertains — an open ended TBA, so to speak.

Not knowing exactly what you are talking about (no bill number particularly) will get head scratching from the interns answering phones. What concrete information can I reference when calling?
It “must pass” both House and Senate before June 27. The more the timeline is compressed, the less time the language is available, the less time the public has to get wind of it, analyze it, and contribute informed suggestions and complaints.
The pols are dickering over which of them will pull the short straw - with the clear understanding that the eventual result will be passage.
Congress is purely self-interested. They don’t WANT the public to be involved in the public’s business.
FWIW early this morning Hoyer’s and Obama’s voice mailboxes were full.
Yesterday my Congressman’s office (MA-08) a strong opponent of allowing immunity, defended the leadership, saying, ”Judge the leadership by their record. They have never introduced a bill with immunity in it.” You can be sure I will be judging them on this record.
I am simply amazed the House leadership didn’t just tell the GOP: if you want this vote so much, go out and get the signatures on the discharge petition yourselves.
Hoyer is literally acting like the Republican floor whip on this.
For 90% of them, the “hide the ball” strategy is risk free. See reelection rate.

Christy - I got my husband on board and we emailed, faxed and called our rep and our senators(Hillary’s taking a break), and(though it is totally worthless) Hoyer. This is beyond horrific.
I think I have e-mailed both Pelosi and Obama every day this week. This morning I told Nancy that I would hold her personally responsible for the passage of the telecom bill and that she was taking away the rights of the people.

I am really getting tired of the Repubs framing the issues. The Dems are either cowards or complicit to allow it. I also am to the point that I don’t care what the Repubs says - the Dems should just do what is right and let the Repubs do whatever they are going to do.

Just got off the phone with Senators Leahy and Sanders, and Conmgressman Welch - all receptive phone calls, urging them to get out in front of this and provide some leadership against this blanket whitewashing of criminal wrongdoing.
I’m just as angry as hell. Taking a deep breath before calling Hoyer, whoever picks up the phone is likely to get an earful.
I called Obama’s campaign and the response was VERY good. Tyler (the phone rep) googled greenwald while we were on the phone, and then went to strange bedfellows.
I told Tyler that while I liked Obama and had planned to vote for him, if he let the Stainy Whore
Protect AT&T ActFISA Amendments Act pass, it would be a dealbreaker. “My Fourth Amendment Rights are more important than any individual politician, and we have already raised nearly $200,000 to get Steny Hoyer and anyone else connected with this. Oh and the Ron Paul money-bomb people? The guys who raised $6 million in 24 hours? Yeah, they’re on board with this too: we’re gonna raise a HUGE chunk of change and start running ads in their districts.”The guy was very responsive and said “we have an excellent messaging system, I’ll make sure this goes to Policy right away.”

BTW when calling a rep who is not your rep, such as Hoyer, if questioned about where you live, my feeling is that someone who is Majority Leader is in that role representing all Americans, not just his constituency.
Called my Senator Ron Wyden and Congresscritter David Wu. They have already voted against Telco immunity and Warrantless Wiretapping. Each office indicated that they will continue to do so. Wu staffer was interested and noted that I was calling “BS” on Steny and his behavior.

OT - also called last week to the Foreign Intelligence Committee re: permanent bases in Iraq and the ”agreement” that Bush is trying to get through. I reminded them that the ”agreement” sounded like a treaty to me and reminded them that the Constitution reads in ”ARTICLE II, SECTION 2

Yeah, it’s a good thing that the Democratic Congressional leadership is on top of this. Otherwise it might seem like a cheap sellout. I have to admit that I am skeptical now of all Democrats. It isn’t just Hoyer or the rest of the Democratic leadership or the rank and file. It’s supposed standard bearers like Dodd and Feingold. There are as many ways to block a piece of legislation as there are to get it passed. And so far I see no real substantive action to oppose this disaster. It seems a pretty thin reason at the moment for our main rationale to support Democrats is that they are not Republicans. Because right now I don’t see a difference.

I called Sestak’s office this morning. I’ve got a meeting scheduled with him in early July and I told his scheduler that the meeting would be useless if he caves on FISA. I told her about the fact that the base is really really angry at Steny and what he’s trying to pull and that we raised over $80K in 24 hours to fight him and any of our own who cave and will raise lots more. That got her attention. I pleaded with her to pass the message on to Joe. This is SO important.
After getting off I looked up Joe on OpenSecrets.org and saw that he doesn’t get big money from telcos so hopefully he will hold true. From my meetings with him so far I think he has the integrity to do the right thing. I sure hope so!
Will call Snarlin’s office and Casey’s when I get home in a short while.
i just called too - and got through (choose option 6 to get past the recording). the person who answered the phone knew all about the issue (including the problematic barrow support) and asked what i wanted obama to do about it. wasn’t prepared for that question - a good one that i, having made a couple hundred calls on this issue alone, haven’t heard before. i asked that obama call the congressional leadership and ask that they put a hold on fisa legislation and that obama give a press conference today about the 4th amendment and why spying on americans without a warrant wrong.

He has said repeatedly that he will never vote for any bill that will grant telecom immunity for spying on Americans. We’ll see.

My letter to Obama:
Dear sir,
I spent a gret deal of time on the web defending you against unwarranted attacks from Clinton supporters. I would be proud to support you as the Democratic nominee and as President.
However, the current Democratic attempts led by Steny Hoyer to pass a FISA bill that will immunize telecoms and retain the worst excesses of the President’s illegal spying program and the PAA are a dealbreaker for me. It is not enough that you oppose this dangerous and senseless bill you must use your authority as the Party’s presumptive Presidential nominee to stop it.
A 6 to 9 month extension although not the best answer is a sufficient one for now and would move the problem into your Administration where it could be more reasonably and sensibly assessed and handled. It is far more preferable than the current backstabbing, secretive sellout that Steny Hoyer is pushing.
Again I would like to support you for President but I will support no Democrat who can stop this travesty and does not.

Norm Dick’s office said they just recieved the bill and that they will be voting on it tomorrow. The staff member said that Dick’s has not been in favor of immunity in the past. I asked him to please read it and vote for no immunity.
I just wrote to Art Pulaski at the California Labor Federal asking for his help in the getting out the word. I am trying to come up with more ideas about untapped resources.
I have called Stainy Whore on two different phone numbers and spoke to staffers. The first one seemed really anxious to get off the phone, the other listened politely and didn’t say much. I wrote a letter to Pelosi early this morning (it’s posted on late late nite FDL). My rep is Denny Rehburg (R-MT) and he’s useless. I will also call Sens Tester and Baucus later today after I see my clients. They both voted against the telcom immunity in the Senate so hopefully they will stand firm.

Hmmmm….depends upon the meaning of “communications”….this is so broad it could protect everyone from Bush to Blackwater to interrogation contractors…..seems like.
I called Dennis Rehberg (R-MT) anyway and talked to his staffer. She said that he had not been able to get a copy of the bill either, and wasn’t too happy about it. We had a nice conversation - I stated that I agreed the original FISA bill probably needed updated due to new technology but that this current bill from what I could gather way over-reached in that area. I asked what his position on the immunity was and she claimed she didn’t know. I asked for a response and gave my info.
Called my senators and rep [Lautenberg, Menendez, and Pallone (D-NJ06), to urge in the strongest possible terms to vote against the FISA bill as written. Until there is transparency, with adequate review by Senate and House Judiciary Committees, this bill represents a huge giveaway to Bush, Cheney, and the other war criminals.
Called my useless rep, the staffer said he had no comment, but I have no doubt that he will vote for the bill. I also called Obama’s election hotline, the staffer was somewhat exasperated at getting another call on the topic. She reluctantly allowed me to speak on the topic for a minute or two, but her attitude was one of “I’ve already heard all this”.
Got thru to all 3 offices: Nadler, Schumer, Clinton. They know nothing of substance about the bill either, but I let them know I’m BEYOND outraged at this, that I’d be watching their votes carefully. Penned a letter to Pelosi, in which I consign her to the circle of Hell I used to reserve for the more craven Republicans (did it in a civilized manner, of course). E-mailed the DNC, which had sent me a pledge form for a contribution; told them I was dropping it in the trash, just as the party has apparently decided to drop the Constitution in the trash. Thanks to one of the posters upthread, got Hoyer’s office number, got a live person, gave him a short, emphatic earful. Never called this many congresscritters all in one sitting, but damn!
When there is no accountability, and no justice, what else can one do? I’m mad enough to march! But where?
I’d also suggest Chris VanHollen (D-MD), who’s head of the Democratic Congressional Campaign Committee [raises $$$ to hand out to all Democrats] and his counterpart in the Senate, Chuck Schumer (D-NY).
Tell ‘em you won’t be giving $$$ to them, but to individual Dems — good ones — so that there’s no chance your hard-earned change goes to Blue Dogs.
Remind them also of how effective Glenn et al. were in raising a lot of money fast. They might want to call for tips.
Dr. Dean would be on my list, with the same message.

Call Obama and ask him to speak out publicly against the bill.
Call his Senate office (202 224-2854) where a person will actually answer the phone and take the message.(Don’t call the campaign, you can’t get through.
