Even after miserably long 8 years, George W. Bush’s ignorance still has the ability to shock me:
"We’ll abide by the court’s decision," Mr Bush said in Rome. "That doesn’t mean I have to agree with it."
"It was a deeply divided court, and I strongly agree with those who dissented. And that dissent was based upon their serious concerns about US national security."
Really? Doesn’t their dissent have to be based on, you know, their interpretation of the law? Isn’t this stuff written down somewhere?
I know Bush obviously doesn’t give a shit about the law, and he views the Court — the institution that awarded him the Presidency made him King — as a rubber stamp. But it’s pretty disturbing to hear someone who swore an oath to defend the Constitution continually demonstrate his total ignorance of it.

Bush’s only motivation in life was to be a contrarian asshole. He graduated to mass murderer due to family connections. Anything outside of himself has no meaning. Like the constitution and other humans.
Real question. What tools does the Supreme Court have to enforce its decisions? The only thing I can remember is when they used the guard to integrate a school back in the beginning of the Movement. But that was hen Eisenhauer agreed with the decision.

And while I agree that Bush is an idiot, talking about National Security within the context of Supreme Court decisions is not a sign that someone lacks an understanding of the nature and function of Constitutional government.
But it’s all okay. Pelosi and Reid are keeping us from the nuisance of IMPEACHMENT. You know, we don’t need no stinkin’ impeachment. If Bush doesn’t like the Constitution of The United States of American, well, that’s his choice. He’s our fearless leader, dontcha know.
What’s even more disturbing is that it is not at all disturbing to Republics.

I’ve got a lady at work in her 70’s and she said she’s not voting. Wouldn’t vote for McShitForBrains but can’t vote for Obama. Won’t come right out and say it but colour is the issue. “I just don’t like him.” Sad.

The upper echelon of agency officers will have checked out early or, having resigned themselves to the fate of political appointees at transition time, have the next phase of their lives planned. It’s been used subsequently, but almost always as a contrast to the decision ultimately being made…illuistrating that the Constitution can protect individual rights while the government CAN protect its citizens without stripping them of their Constitutional protections.

Matter of fact, I have had serious doubts of some of the Justices that got nominated and appointed to begin with.
This should have been a 9-0 vote not 5-4. By one vote reason and logic trumped fascism…….. Scalia is a dysfunctional!
The Constitution says that anyone in American control is entitled to habeus corpus. Clearly Guantanamo is under American control even if it is in Cuba. Bush and his legal authorities made a mistake when they thought they could sell the Guantanamo is in Cuba distinction. Had Bush put these people under Iraqi, Afghanastani, or other non-American control, our Constitution would not follow them, but you can’t have it both ways. If you want an American in charge, you must abide by American law. You will find that helpful if they ever come for you.
This was not a political decision, it was a legal one. Seven of the nine Supreme Court Justices were appointed by Republican conservative presidents. Of the five who upheld the habeus corpus right, Ginsberg and Breyer were appointed by Clinton, Kennedy by Reagan, Stevens by Ford and Souter by George H.W. Bush. Undeniably, Reagan, Ford and George H.W. Bush cannot be classified as liberal presidents, but I know for a fact that the presidents who appointed dissenters Scalia, Thomas, Roberts and Alito were all Republican conservative presidents. If the claim of politics has any merit, the only proof of legitimacy is that the four dissenters were all appointed by Republican conservative presidents.

Sometimes the appointing president is surprised. Eisenhower regretted appointing Warren who he considered too liberal. GHW Bush regretted appointing Souter. I guess he remains glad he appointed Thomas. Looks like Roberts and Alito will not disappoint GW Bush. Way back in the days of “Archie and Mehitabel” (the spelling doesn’t look right) the typewriting cockroach who typed out “The Supreme Court follows the election returns”, the court was political more than legal. Courts follow precedent unless they don’t. We wouldn’t have the arguments we have over who’s to be judge, if the judge’s worldview didn’t matter.
