OT, but is it my imagination, or did Dennis’ Articles of Impeachment already make it beyond where I thought they would. The floor voted to send them to committee by 251-166. Raw Story says 24 Rethugs joined “nearly all” Democrats voted for sending the Articles to Committee. I wonder what would happen if, instead of assuming a defeatist attitude, Dennis’ efforts got serious support from the citizens. Have all of us written our letters yet? I have, but now I’ll have to adapt it to the Judiciary Committee. I want them to consider these Articles seriously.

I read that the usual suspects, Scalia, Thomas, Alito and Roberts voted against giving these prisoners Habeas Corpus rights. So much for “strict constructionists” who do not rewrite the laws.

Cliff - I noted yesterday that Fred Schaeffer(Frank?) had an opinion piece on HuffPo and referred to McNobrain as ‘a cad’ — that McCain may make claims to carrying on military honor…and hold to ‘no wounded man left behind’ but that he left his wounded wife behind. A cad - now there’s a word we haven’t heard a whole lot of for a very long time.
that by the margin of one vote (5-4?), the supreme court has told the congress and the executive to go to hell?
Much as I’m impressed and ready to do a happy dance that the majority opinion of the SC has decided to recognize that you cannot legally take Habeas Corpus away from people for periods of long duration or for frivolous reasons, I have to wonder how this will effect the elections. We know that we’ve been discussing the SC in terms of women’s rights, abortion rights, workers rights, civil rights, and of course, this decision was based on a civil right. I would go so far as to say, the ultimate civil right. But I wonder if many on the right will portray this as why they need to have that one more at least choice of a justice. I’m sure they’ll portray it as giving the rights to prisoners who are trying to kill you. Will this be a net positive for our side or for theirs?

good point, it’s stunning ANYONE on scotus voted against habeas protection, it’s stunning and depraved
First of all, the Supreme Court seems to have held that the Congress took away Habeas from these prisoners improperly; secondly, the court overturned a lower court that held that the prisoners didn’t have a right to claim Habeas Corpus. My guess would be that they considered overturning the lower court ruling stunning.

i was stunned by how many dems voted for the MCA - congress’ attempt to deny habeas to gitmo prisoners. the whole thing is just stunning to me.
it’s just stunning to me the issue was even in question, of course a president can’t hold innocent people, of course he can’t write new law to keep people who commited no crime to remain in jail, of course a person can show they commited no crime.
it is insulting, the very notion that a president can gather you up, not tell you what foolishness he thinks you commited, not give you the right to show you did not commit that foolishness, and keep you there under the threat of torture

I was stunned at how Harry Reid connived with Bill Frist to make sure they could vote on the MCA before the 2006 elections while the Republicans were still in the majority.

How about womanizer. I’m sure you’ve heard that word a lot, and that is what McSame is. Have you also heard that Wesley Clark attempted to impeach McBush’s military creds yesterday? Apparently he’s done it before. Personally, I wish more of this. The guy was fifth from the bottom in his graduating class, he proceeded to wreck a lot of planes before he wrecked another one that got him captured and held as a POW in Vietnam. I don’t think he’s had the responsibility of any military planning or any strategic thinking along military lines. They say well, he’s been a ranking member of the Senate Armed Services Committee, so that’s the highest extent of his military credentials in my book. It’s better than nothing, but it’s not as good as someone who had actual planning experience and did more than go where he was told and drop bombs. But that’s just me.

they were correct in that it would fall to Justice Kennedy
but I got the talking points - are ya ready ?
Justice Kennedy’s lean towards habeus would bring “a modest lost to executive’s gwot” - (um, not so much)
and - would create “anomalous circumstance” where in terrorism detainees at Gitmo would have “superior rights to those of even traditional defendants in the civilian justice system” in that they would have both habeus and the dc circuit court provisions of MCA”
IOW - ‘Activist justices give babykillers more rights than you!’
