Trevor Potter, John McCain's lawyer, flips his shit at the notion that there was anything improper about the White House's removal of FEC Chairman David Mason (per Ambinder):
The McCain campaign believes that Commissioner Mason's questions have been answered satisfactorily, and that if he is on the Commission when a quorum is restored he will agree that Sen. McCain's withdrawal from the system was proper. Accordingly, given the lack of evidence that Commissioner Mason thinks otherwise, the controversy about the White House decision to nominate someone else for the Mason seat seems to be a manufactured one.
Really? The Campaign Legal Center, the organization that Trevor Potter founded, strongly disagrees. From J. Gerald Hebert, the Center's Executive Director:
The White House has thrown the wrong FEC nominee under the bus. Chairman David Mason has been cast aside by the White House for insufficient party fealty while the nomination of an unqualified but loyal partisan remains pending. It is a move sadly reminiscent of the U.S. Attorney purges.
Fred Wertheimer of Democracy 21 also had some choice words for the Mason dismissal. Why have so many of these good governance groups finally found their voices with regard to this wanton politicization of the FEC for McCain's benefit? Word has it that the Politico is doing an investigative piece on how the reform committees are too close to McCain. It may have been the impetus for many a "come to Jesus" moment.

Cliff’s post was dated 11:15 on our FDL site, but around 10:00 on his site. Fifteen minutes later, here comes Jane’s post. Feel like I’m running a race. I’m going for a nap.

Now we know why McCain almost flunked out of Annapolis. How can a third-generation Navy man not know that this is a NAVAL TERM that means an individual has lost sight of their navigational standards. It has nothing to do with AGE…Navy men and those that used this slogan were ALWAYS referring to people who had become sidetracked away from their presumed course. Young captains could “lose their bearings” as well as old ones.
Sad that McCain doesn’t even know Naval Terminology!

Frankly I would say “lost his bearings” about anyone who doesn’t seem to be grounded in their beliefs, regardless of age. but opponents want to interpret it as an ageist remark, so throwing the wright issue is fair play. blech.
well, there are so many missing emails…the air in cyberspace is just thick with ‘em, so I was taking it at face value.

They seem to have figured out all the ways to get away with a series of crimes and abuses…
I just can’t believe that there isn’t something obvious to nail them with….they had to have planned this for years and then put everything into place so carefully, so that no one can get to them…but I believe that there is something out there..right under our noses…a thread to pull.
I was thinking that…since it is illegal apparently to use taxpayer money to feed Propaganda to the American people — especially, since the goal was to make a case to put troops into harms way based on “propaganda”…there might be something there that they can’t claim executive privilege to…seeing that the DOD had to release all of those documents via FOIA…and the “missing WH emails” are for the exact same time period and are cited as missing right when the DOD documents get released…it sure looks like they ditched the emails, because they couldn’t produce them or it would incriminate them by showing that they were defrauding the people…so they destroyed the evidence, which is a pattern with them…
I think there is something substantial in this, but I’m not a lawyer…
The DOD documents back up the Downing Street memo. There is some black and white evidence here.
It is by design and what we should do is bust them for failing to comply with the law. There is no excuse. Period. Check this out, Computer World calls the WH CIO “Even Less Credible”. I will provide a second link to a “Where Have All The E-Mails Gone?” which was written about this issue. It has a links page with lots of good information on this whole sorry affair.
What I get from reading David Gewirtz’ pieces is this: the judge is not asking the right questions and is not looking in the right places(these other servers, for example). it’s also obvious that the Bush/Cheney administration is completely and utterly consistent with picking people to do jobs that they are just not equipped to do. Total incompetance and negligence. But again, I think you are right; with these guys, when you have the choice between malicious and stupid, malicious wins out every time. We need a special prosecutor who will pull together a staff of forensic computer people with some real skills…not people looking for 3×5 cards..
Trevor Potter, John McCain’s lawyer, assumes or makes the point of argument “whether or not the FEC has to vote to withdraw from the contract it entered.” He asserts that the answer to this is “no,” that unilateral withdrawal is within regulations.
I have two points. First, I can smell a “no illegal” argument coming up, on the basis that what is being violated (by the combination of a loan agreement and not abiding by limits agreed to by contract) isn’t against statutory law. “Not illegal” will fool most of the public.
Second, while there is a dispute as to whether or not the FEC has a voice in the contract it entered (McCain’s camp insures this is disputed), there is also the question about HOW the FEC will rule when it gets the opportunity to express itself.
