One of the few pleasures to be derived from watching the antics of the American right is that more often than not, the whole scene devolves into something like a Punch-and-Judy show on acid (bad acid, admittedly), which if nothing else has its moments of amusement. If they're not turning up dead from self-asphyxiation dressed in wet suits, they're busy ripping people off -- most particularly each other. At which point much more head-clubbing ensues.
Take, for instance, that erstwhile Neighborhood Watch on Androgenic Steroids, the Minutemen. It seems that even though the Minuteman Civil Defense Corps, whose finances have come under close scrutiny, reported income to the IRS that finally jibed with what they reportedly spent, there's something not quite right about their accounting:
But Stacey O'Connell, former MCDC Arizona state chapter director who is now a member of the Patriot's Border Alliance, a separate Minuteman-style organization, said the money listed in the new 990 filing does not match claims by Mr. Simcox on how much MCDC has actually collected.
Mr. O'Connell said that in past interviews, Mr. Simcox said the organization had collected $600,000 in donations in its first year, along with $1.6 million for a border fence MCDC is building. He said he also is aware of a single $100,000 donation given by an Arizona man. He later filed a fraud lawsuit against MCDC that has since been withdrawn because of a lack of funds to pursue it.
"After reviewing the Minuteman Foundation 990 from 2006, it appears well below the donation amounts Simcox has claimed in the past," Mr. O'Connell said. "Many of us, perhaps thousands of volunteers and supporters, have donated not only to MCDC but to the fence project as well.
"Many of us also feel that the lack of cooperation in showing where the money goes, how it is spent; that there is something very wrong within the organization," he said.
MCDC, on its Web page, said donations have been "used wisely and effectively, and have focused the nation on illegal immigration," saying it "cannot ... accept responsibility for conspiratorial, disruptive and inappropriate speculations about MCDC organizational process and finances, nor will we waste precious time or resources upon those who refuse to accept the IRS nonprofit organization financial accountability standards."
The reality of the Minutemen -- that they really are just another right-wing moneymaking scam, one that mostly takes money out of the pockets of ordinary citizens -- became clear shortly after they split into two organizations in late 2005 -- mainly because the two paranoiac egos that had founded the organization, Jim Gilchrist and Chris Simcox, wound up scarcely able to be in the same room together.
Simcox went off and formed the MCDC, part of an elaborate PR makeover for Simcox. It was built essentially around drafting as many recruits from non-border states into their border-militia concept -- which they could fulfill just by donating. Then Simcox has turned around and hawked the resulting mailing lists to right-wing political-mailing outfits. At the same time, he's embarked on other scams as well, most notably the supposed construction of the border fence that never got built.
Meanwhile, Jim Gilchrist has not fared any better. His Minuteman Project organization has similarly devolved into a predictable right-wing mudpit, with lawsuits and paranoiac accusations flying hither and yon.
It would be a lot more amusing if they could find a way from making demonizing Latinos and other immigrants the reason for their existence.

It also happens at the state level. The now former R governor of Kentucky issued a blanket pardon for everyone in his administration being charged OR investigated OR involved in a civil service hiring scandal except for himself. He wound up negotiating a misdemeanor plea.
While the ostensible reason for Minuteman ogranizations has been their fear of brown people, what it has really been about is rubes scamming rubes.
One of my good friends who lives in San Diego sends me emails now & then with all this hyperventilating shit about how utterly dire this illegal immigration stuff is, and how we must and can round ‘em all up and deport ‘em.
My congresscritter- a re-heeled defeated congresscritter and ex right wing lobbyist- ran and won election in 06 on one issue- illegal immigration. He’ll try to do the same thing again- and ignorant savages are bursting the e-mail pipes with bullshit made up stories about the evil of illegal immigrants. They pass these stories on as truth without noticing that no one claims authorship of the stories and that they contain no factual documentation. They pass on bullshit 24/7 and don’t even seem to understand what would be involved in “checking it out”.

Every time the subject comes up about prosecuting illegal immigrants, I ask the person how they feel about prosecuting the people who knowingly hire them, and ask them if they believe in equal justice, just selective prosecution of poor people who don’t have the means to protect themselves.
One of the favorite e-mails circulated by the fact free majority is about a Bill that the Senate “just passed” allowing illegal immigrants to collect social security while paying nothing into the system.
It’s been circulating for at least four years. It is dutifully passed on by know nothings with vehement comments attached.
The only thing funny/amusing about the Minutemen is watching their demise. Stupid right-wing xenophobic pricks. Unfortunately, they have had the completely intended effect of coloring the national discourse on immigration and undocumented workers.
Between their hysteria and paranoia they managed to amp up a non-issue to one that will reverberate for a generation or more as the hispanic population increases. The greatest strength America has is the ability to assimilate everyone over a long term, even the slack-jawed, toothless forebears of the minutemen who were probably kicked out of every respectable country in “old Europe” (apologies to National Lampoon’s “The Immigrants” sketch for that one).

I tried talking to the one who sent me the email. I used Obama’s bitter/cling “gaffe” as an opening. I got anger filled emails right back at me. My “friend” wasn’t going to vote for Clinton or Obama or McCain. They were all jerks in her opinion.
I think I finally got through a little bit though. One common point was that we both thought Carol Lam was a good USA in San Diego and shouldn’t have been fired. Before she was fired she prosecuted the owners of a fence company for repeatedly hiring illegal aliens. (And yeah, they did have a contract for the border fence but insisted they didn’t use illegal on that project.) Carol Lam wanted the owners to spend some time in jail. After she was fired the new USA accepted an agreement where they just paid a fine. I explained to my friend that paying a fine is just the cost of doing business and won’t change anything. If we really wanted to stop getting illegal immigrants, the only effective way was to jail the owners.
The second thing I told her is that maybe we really don’t want to stop all the migrant workers. Some farmers are now moving their entire operations to Mexico because immigration policies are threatening their labor supply. Seems like a good idea at first. But if you think about it, all of the jobs associated with agriculture could move too. It could devastate our economy. We could become some kind of agricultural “rust belt”.
I’m getting no google hits on that case. (And I had been led to believe that Ford’s pardon of Nixon had never been tested in court.)

Y’know, at one point I had the link. It got shot down at the appellate level (some cat had sued Gerald Ford over it) and never heard by the Supremes. It stands, the case law precedent essentially being that the president’s pardon power is in fact plenary, with the sole exception of cases of impeachment.

Could it have been a different case. The power of the president to pardon crimes not yet charged is very well established. In fact, I’ve read that it was well-argued during the consitutional convention. Somewhere along the line, Alexander Hamilton note that in times of rebellion, often a deal can be cut via an offer of mass pardons, and so on.
I believe that I’ve read that the pardon of uncharged crimes has also been tested in court.

Murphy, a Michigan attorney, brought suit for a declaratory judgment against President Gerald Ford invalidating the pardon on grounds that a pardon could not be legally granted to an individual who had not first been indicted or convicted of a crime. Chief Judge Fox said: “The fact that Mr. Nixon had been neither indicted nor convicted of an offense against the United States does not affect the validity of the pardon. Ex parte Garland, 4 Wall. (71 U.S.) 333. In that case the Supreme Court considered the nature of the President’s Pardoning Power, and the effect of a Presidential pardon. Mr. Justice Field, speaking for the court, said that the Pardoning Power is ‘unlimited,’ except in cases of impeachment.”

That was my thought as well. The reflexive commonsensical answer is “no” (given that the pardon power is essentially political, not so much “legal” in terms of restraints) but it hasn’t been tested — prospective presidential indemnity for future crimes via the pardon power.

We assume the language “crimes against the United States” refers to those already committed prior to the granting of the referent pardon, irrespective of whether they’ve yet been charged or even discovered, but neither the Constitution nor the case law explicitly say so. Som a push-it-to-the-firewall cat like the Yoonitary Executive could claim the power to put someone beyond the reach of the law going forward.
The only apparent redress would be impeachment — but even that would be problematic were he to do it on his last day in the Oval Office. Such a tactic, though, would provied the opening for The Supremes to call bullshit and circumscribe the power and outlaw “future crimes” pardons.
