Ron, let this be a lesson – you HAVE to back up. There just isn’t any way around it. I’m totally paranoid about that stuff now. I usually replace hard drives before they go bad. If it’s got more than three years, I back up weekly. If it’s to four years, away it goes. I can’t afford to lose data.

Wow – great question…esp since I came to EarthFirst! (by then very much vegan, despite thier roots in hunter/fisher folk) through their work to keep trees vertical…shading the headwaters of the waters I (tried) to pluck salmon/steelhead from.

Sure tried to be a vegan (and on either side, a vegetarian)…but just did not experience health with same. No matter how I tried to supplement (and for the first few years, didn’t even bother – didn’t think it was needed, so I don’t think this is placebo), my bod just didn’t feel OK..nor did I.

Out of courtesy, I would eat “holiday” meals even if non-veggie/vegan (hey, I’d only started veggie/vegan in my late 30’s). To my surprise, noticed a big reversal in feeling crappy when I reintroduced fish (1-2 x/week) and meat (1 x/ week).

Wish I didn’t seem to require sentient critters to feel OK…but despite working with supplements/ traditional healers / excellent Traditional Chinese Medicine faculty, that appears to be the case.

Sadly, none of those folk spared me from failing to switch the propane tanks tonight. Gotta check to see if the ceramic “rocks” cooked the meat.

While no president has ever pardoned himself, the law supports the president’s authority to do so. Scholarly inquiry into the subject was provoked first by fear that Richard Nixon would pardon himself to escape Watergate; later by thought that George H. W. Bush would do so because of the Iran-Contra grand jury; and most recently by concern about Bill Clinton’s problem of a possible post-Presidency indictment and trial. And while a few scholars have concluded that the president cannot pardon himself, many more believe that he can.

Will Bill Clinton do so? We won’t know until he is indicted, for he would have to plead it as his defense. I would assume that we will have an answer to this question by March, or by end of April at the latest — if Independent Counsel Ray proceeds as he has indicated. Although I cannot predict the answer, this much I can promise: it will be interesting.

I don’t think it’s quite that simple, but IANAL.

Notice that Makasey said that the Justice Department wouldn’t prosecute. A person can be guilty as sin of a federal crime, but unless the Justice Department prosecutes, it makes no difference. He said that it’s not legal precedent. Rather it’s a practical matter. And from what I’ve read that is how the Justice Department has always operated.

But John McCain has gone ever further, writing that principle into Section 1004 of his Detainee Treatment Act:

SEC. 1004. PROTECTION OF UNITED STATES GOVERNMENT PERSONNEL ENGAGED IN AUTHORIZED INTERROGATIONS.

(a) Protection of United States Government Personnel- In any civil action or criminal prosecution against an officer, employee, member of the Armed Forces, or other agent of the United States Government who is a United States person, arising out of the officer, employee, member of the Armed Forces, or other agent’s engaging in specific operational practices, that involve detention and interrogation of aliens who the President or his designees have determined are believed to be engaged in or associated with international terrorist activity that poses a serious, continuing threat to the United States, its interests, or its allies, and that were officially authorized and determined to be lawful at the time that they were conducted, it shall be a defense that such officer, employee, member of the Armed Forces, or other agent did not know that the practices were unlawful and a person of ordinary sense and understanding would not know the practices were unlawful. Good faith reliance on advice of counsel should be an important factor, among others, to consider in assessing whether a person of ordinary sense and understanding would have known the practices to be unlawful.

LHP seemed to dismiss DTA Section 1004 on Monday but today seemed to be taking some part of DTA as granting some kind of immunity. I’ve posted a question for her about that at the end of an earlier thread today.

Obama’s doing well enough in John’s North Carolina that it’s unlikely to help there…but if he worked hard over the next few days in Pennsylvania, and then headed out to West Virginia it might help.

It would be wrong to consider the prospect of legal jeopardy unlikely. I remember sitting in the House of Lords during the landmark Pinochet case, back in 1999—in which a prosecutor was seeking the extradition to Spain of the former Chilean head of state for torture and other international crimes—and being told by one of his key advisers that they had never expected the torture convention to lead to the former president of Chile’s loss of legal immunity. In my efforts to get to the heart of this story, and its possible consequences, I visited a judge and a prosecutor in a major European city, and guided them through all the materials pertaining to the Guantánamo case. The judge and prosecutor were particularly struck by the immunity from prosecution provided by the Military Commissions Act. “That is very stupid,” said the prosecutor, explaining that it would make it much easier for investigators outside the United States to argue that possible war crimes would never be addressed by the justice system in the home country—one of the trip wires enabling foreign courts to intervene. For some of those involved in the Guantánamo decisions, prudence may well dictate a more cautious approach to international travel. And for some the future may hold a tap on the shoulder.

On August 11, 2006, Special Judge David E. Melcher ruled Fletcher is protected by executive immunity and cannot be prosecuted while in office. This ruling essentially stayed the case until Fletcher was no longer Governor.

Executive immunity is by no means confined to Kentucky – extends from the president all the way down to surprisingly low levels (although at the lower levels it wouldn’t be termed “executive”, merely a general immunity from prosecution from performing the activities of a government employee).

The only real caveat is that the actions being defended must be found to be “within the scope” of those official duties – though courts tend to absolutely twist themselves into knots, in the majority of cases, to find that those employees were in fact acting within the scope of employment.

Saw them last summer at Boyne Mountain in Michigan and Derek Truck just blew us away. He is really a great guitar player. Very professional and smooth in concert.
