Mark Penn’s ignominious departure rather obviously raises the judgement question, as has having Michael O’Hanlon, Martin Indyk, and Jamie Gorelick as advisers.

On the issues, Clinton is (slightly) more progressive than Obama. But, wrt judgement both with respect to advisers and issues, she seems to be Republican light. Which is predictable from her DLC affiliation and her A*P*C support.

Well, last January, when I made my teaching schedule for the semester, I canceled classes on April 8 and 10 in order to have individual conferences with my students (mandated to do this some time during the semester). Last week, I noticed that KU was going to the Final Four, so I moved the conferences to Wed and Thurs. So, that must be why they won tonight.

I can still hear downtown noise from my house, about three or four miles from downtown. Classes are canceled tomorrow at KU, but my celebrating high school son must get up and drag himself to public school. The mother refuses to excuse him. So, Rock Chalk Jayhawks!

in prep for whenever the discussion happens…..first we need some big disclaimers.

1) people of intelligence and good will can see things quite differently.
2) even when racist or sexist language is used, that doesn’t necessarily mean the person using it is particularly racist or sexist - we live in world imbued with these language biases and we wouldn’t be human if we didn’t pick up some of it.
3) conflict isn’t necessarily a bad thing, so long as it is handled with good will and mutual respect. imo, conflict gets us thinking and pushes us to re-evaluate our assumptions.

… just want to make sure that discussions of past conflicts are not used as a spring board to give anyone grief.

Typically, they need permission from the host country to extradite, and Paraguay is apparently unwilling to sign up! S.A. countries have been hesitant to sign onto the I.C. and Geneva treatises… It’s a long standing standoff, that’s why the Nazis fled there…

A slightly more sober answer. Many European countries believe in the doctrine of “Universal Juristiction.” The Pinochet case is the paradigm for some damn fool think that he can torture people on his yacht (the Esmeralda) and then stroll about Europe. They may try him locally, or they may extradite him to the Hague.

Per Philippe Sands:

PHILIPPE SANDS: Well, that argument is complete rubbish. When you violate an international criminal law, like the Geneva Convention or the Convention Against Torture, you expose yourself to the risk of criminal investigation or prosecution. That was dealt with by US federal law. In June 2006, the Supreme Court gave a judgment in a very famous, very important case called Hamdan v. Rumsfeld, and they said the administration got it wrong. The administration, by deciding that no detainees had rights under Geneva, had violated US constitutional law.

Justice Anthony Kennedy put in a separate opinion. He was with the majority. And he opened the door to war crimes possibilities. He said this means that war crimes violations may well be investigated in relation to situations in which the Geneva Convention was not followed. The administration recognized the threat that it faced, and within three months it had adopted legislation in the Military Commissions Act which created an immunity for any person who was involved in the interrogation of al-Qahtani, as well as many other people. That immunity applies within the United States.

But, as I write in the article in Vanity Fair, it doesn’t go beyond the United States. And I describe in the Vanity Fair piece, in much more detail than in the book, the meetings I’ve had with a European judge and a European prosecutor, who basically said the fact that the US has created a domestic immunity significantly increases the prospects of international investigational prosecution, if any of these people set foot out of the country. And as the prosecutor said to me, that was a very stupid thing to do, to create an immunity.

JUAN GONZALEZ: So, in essence, your sense is that it’s a very real possibility that in the future some of the individuals involved could be exposed, at least in foreign countries, to prosecution for their acts?

PHILIPPE SANDS: I think it’s a real possibility. The judge and the prosecutor have asked me for all of my materials. They were not aware of the details. They were not aware of the immunity that had been granted. And I think what it does do, at the very least, is expose some of these individuals, including the lawyers who form part of what I’ve called the torture team, to the possibility of investigation, if they set foot—well, they’re going to be investigated irrespective of whether or not they set foot outside of the United States—the possibility of the tap on the shoulder, what happened to Senator Pinochet when he was in London, I think becomes a real risk in relation to some of the individuals at the top.

Five hundred U.S. troops arrived in Paraguay with planes, weapons, and ammunition in July 2005, shortly after the Paraguayan Senate granted U.S. troops immunity from national and International Criminal Court (ICC) jurisdiction. Neighboring countries and human rights organizations are concerned that the massive air base at Mariscal Estigarribia, Paraguay is potential real estate for the U.S. military.

While U.S. and Paraguayan officials vehemently deny ambitions to establish a U.S. military base at Mariscal Estigarribia, the ICC immunity agreement and U.S. counterterrorism training exercises have increased suspicions that the U.S. is building a stronghold in a region that is strategic to resource and military interests.

The Mariscal Estigarribia air base is within 124 miles of Bolivia and Argentina, and 200 miles from Brazil, near the Triple Frontier where Brazil, Paraguay, and Argentina meet. Bolivia’s natural gas reserves are the second largest in South America, while the Triple Frontier region is home to the Guarani Aquifer, one of the world’s largest fresh water sources. (See Story #20.)

Not surprisingly, U.S. rhetoric is building about terrorist threats in the triborder region. Dangl reports claims by Defense officials that Hezbollah and Hamas, radical Islamic groups from the Middle East, receive significant funding from the Triple Frontier, and that growing unrest in this region could leave a political “black hole” that would erode other democratic efforts. Dangl notes that in spite of frequent attempts to link terror networks to the triborder area, there is little evidence of a connection.

The base’s proximity to Bolivia may cause even more concern. Bolivia has a long history of popular protest against U.S. exploitation of its vast natural gas reserves. When Secretary of Defense Donald Rumsfeld visited Paraguay in August of 2005, he told reporters that, “there certainly is evidence that both Cuba and Venezuela have been involved in the situation in Bolivia in unhelpful ways.”

Military analysts from Uruguay and Bolivia maintain that the threat of terrorism is often used by the U.S. as an excuse for military intervention and the monopolization of natural resources.
