Tang was used by the NASA Gemini[1] space program. A NASA engineer working with the Gemini Space Program on a life-support module explains the story of how and why it was used. Paraphrased:

Nixon was never impeached. The House Judiciary Committee voted out articles of impeachment, but they had not been acted on by the full House. What Ford pardoned Nixon for was any and all crimes he may have committed. He had not been indicted or charged with any crimes. I’m pretty sure about this one.
But, if she brings up impeachment and he is charged in the house, but he is cleared of all charges, which he would be in the senate, there’s no going back. No double trials in the USA.

But when he leaves office he could be criminally indicted. Or if the Hague could serve process before he escaped to Paraguay, he could be charged with war crimes. Aquittal in an impeachment trial would not negate those. I believe.

Ah, too true but in the case at hand, I believe that the overriding thing would be that “Executive Privelege” does not survive and impeachment inquiry (I seem to have read that somewhere). That would mean that every bad piece of paper the sumbitch ever saw/wrote/talked about would show up in the committee, and could be used for a criminal prosecution even if his term ran out. I don’t think he could pardon himself, and his only option might be to appoint Darth on Jan 19th and resign pending a pardon (ala Tricky Dick). Ick. Republicans are so slimy.

Nixon created more liberal programs and agencies domestically than did Bill Clinton. He was the only president to come close to openly questioning the efficacy of our war on drugs. He started the EPA. But his DOJ was almost as criminal as is Bush’s, and he killed more people in Asia than has W. For nothing.
The books he wrote after his presidency were uneven in quality and ideas, but they were not neo-con, and he proposed in his books many ways toward negotiating international problems that are worthy of review. Had he gone to prison, he probably would have not have written the books, or they would have been far different in content.

You’re right, for sure it’s got to be congress. I’m just wondering if congress is not thinking that it’s better to wait until after the elections at this point for the following reasons:
1. There is not time (the dems weren’t kidding, we had no idea how the justice and executive would work together to stall investigation of anything.)
2. If anyone is charged or convicted, they’re pardoned
3. The whole process is much cleaner and easier with an honest justice department under a democratic president…better late than never
4. The statute on the most important crimes will not be lost, and there is no statute on war crimes.
No idea if any of this is right, just random thoughts.

Yet the Nixon pardon was not challenged by anyone that had standing. The only challenge was thrown out because the principal was ruled to not have standing, and the court specifically said that it was up to Congress to challenge. It didn’t…so the merits of the issue have never been assessed beforea Court.
It doesn’t mean that what Ford did was constitutional, it means that Congress wussed out. That’s a major difference.

But there’s this: since the day Chimpy got his first secret opinion from the DOJ’s Office of Legal Counsel as to the legality of any particular criminal activity, they have considered that the menu from which they could pick. If OLC says it’s legal (think Yoo, Bybee, Goldsmith, etc.), they consider themselves indemnified, and that may be as much as they need to prolong it for 10 years.

No Suzanne, Congress CAN challenge the pardons.
They (and possibly the following President) do have standing according to the one Court to rule on the Nixon case. They threw out the challenge, not because they adjudged it “Constitutional” (if that had been true the petitioner could have appealed and headed up to the Supremes. Instead they stated that the challenger didn’t have standing.
There are two issues that arise that haven’t been determined. Can a President issue pardons for “any and all crimes committed in office” whether these are enunciated or not, charged or not. In other words, can a President issue a “license to kill” or violate the same Constitution that provides him with his power. Can the President, who swears an oath to defend the Constitution freely destroy that obligation? If so then the Constitution has no meaning. The Executive can do any crime, and absolve itself.
Second, can a President execute a pardon for a crime that he himself is directly involved in. There may be, in fact, State cases that actually have been issued regarding Gubernatorial pardons on this very matter. But certainly there is reference to such an issue in the Federalist papers #69, that refers to the abuses of King John II in pardoning his own agents who committed crimes under his secret authority.
Certainly such a challenge is possible…we don’t know what outcome would occur in the current Supreme Court.
Then there is impeachment. Conviction under the current Senate is unlikely, though not impossible provided the evidence is overwhelming (but the Media as currently constituted would make it an uphill battle). If there is a substantial Democratic victory this Fall, especially in the Senate, a post-tenure Impeachment is legitimate. This would prevent any of those pardoned from receiving “future or present office or grant of honor, profit or trust under the United States”. At the very least the impeached/convicted individuals could never return to government service, receive or lobby for contracts, receive Federal grants, receive Secret Service protection, keep their pensions/health care, use any title or position of office (or the regalia thereof).
No Presidential Library, no Speaking Tours using “President of the United States” unless accompanied by the preface ” the only impeached and convicted”..etc.
Most importantly, the ability to prevent investigators or researchers from examining the Presidential or Vice-Presidential records would be dissolved.

My best guess – all opinions by OLC, “granting” the Executive Branch extra-legal authorities, would become the Executive’s reliance of legality. “Hey, my lawyers told me this was legal (Constitutional).”
Which leaves us exactly where? No idea.

Suzanne, we’re talking new law here. I would imagine that the Statute of limitation would be not on the pardon, but that would relate to the SOL on the underlying charges that might arise. If the “universal” pardon is voided…then a future DOJ can charge the individuals with any crimes they discover as long as the SOL hasn’t voided yet. In addition, since there hasn’t been a prosecution there is absolutely no “double jeopardy” issue involved.

Precedent relates to court decisions, not whether someone opts to challenge a law.
Of course, the current court might decide anything. After all they decided against Bush vs. Texas in the recent situation. I actually disagreed with that decision (as they also apparently decided against the Right of Congress to establish treaties that are the law of the land).
I’m not going to argue against a bunch of people who say that Congress will never act, and the Courts and the White House have it all set up so that Bush can do anything. It’s a position of sheer nihilism and hopelessness. I personally don’r see the point except to make people think challenging the Administration is useless. It’s almost like this is a “concern troll” designed to make people give up.

Shit, I almost forgot. People can be pardoned because at some point in time they may be charged with crimes that are hidden from the prosecutors. Hidden crimes, secret crimes. Bush can wave his wand and pardon all in his kingdom who may be guilty of any secret crimes. Nobody will ever know what these crimes are, but they must be challenged before W’s magical DOJ is out of business in January. After that, the secret is locked in with skulls and bones…

For the record Impeachment is on the table legally. This ruling diminished the legal power of Senate-ratified treaties, e.g., The Convention Against Torture and the Geneva Conventions.
The Supreme Court ruled that until Congress canonizes treaties in federal law, a president has no power to enforce them.

..my 19-year-old daughter is with me…she’s on spring break from college in the US, and took this trip with me…and we’re going sight-seeing on a few islands around Hong Kong today…
We had a grand time. I have a couple of pix, and now I have to try to figure out Flickr or something. On the other hand, I may rely on Mr. Marion in Savannah to do something about getting them “postable.” He’s the camera buff. Meeting her felt just like re-connecting with an old friend you haven’t seen in a while.
The bitch of it is, after the 2006 election I put a “Pelosi 2006″ bumper sticker on my freakin’ locker. I was ready to get impeachment of Bush/Cheney outta the way and have a President Pelosi in the White House. Even my own Rep Baird has not disappointed me as much as Nancy has.
It really is enough to make you grind your teeth, isn’t it? I remember the sense of hope when she took the gavel… I hope and pray that we get enough of a shift in Congress after the 2008 elections to have solid majorities, and then maybe something can be done to get someone with some cojones (not necessarily physical ones, ya know…) into her chair. Optimism. It’s about the only thing that keeps me going at this point.
